" " . - Gollty Rnd Not Guilty. - The jury in the caSe of the state against Levi and Glen Spacht of Sargent , brought in a verdict Tuesday evening finding Levi guilty and Glen not guil ty of the charge of assault. The case was enc in which M. F. Brown of Sargcnt , had the boys arrested on the charge of assaulting Mrs. Francis Brown , his wife on June 24. The trial developed that trouble between the parties was of long standing , especi lly between Mrs. Brpwn and Glen Spacht , a young man seventeen or eighteen years old. On the morning of the culmination - tion of the differences that resulted - ed in the arrest , Glen in passing the barn where Mrs. Brown w s milking her cow threw a block against the barn , She carried the block of wood to the house with her and preserved it and had i on exhibition in court. Shortly after the throwing. of the block Glen was passing in front of Mrs. Brown's residence when she availed herself of the opportunity - portunity to use a raw hide whip 'on ' him , inflicting twelve or fifteen - teen strokes with vigor from her door. The affair was witne sed by a number of Sargent citizens who chanced to be in sight at the time. That little affair would doubtlessly have passed into history with notice to the general public had it not been for Levi , an older brother , who heard the fracas rushed , out of the store to ad vise his brother in the premises not to staud and take the whipping. For his interference - terference Levi was made to feel the weight of the raw hide across his hand. This he resisted and in his attempt to wrest the weapon - pen from his assailant they both tumbled over the threshhold or chair onto the floor in the room where he held her until assistants came to the rescue. The court fined the defendant , the jury found guilty , en dollars and cost. ' . The defendants filed complaint of assault oq. Glen Sl'acht against Mrs. Brown , Wednesday - nesday , .1I1o.rni g. . The at- torney's..aBTeed , to submit it to J"udge Armour to decide on the evidence introduced in the former case. Tlle Judge fined her. $10 and : cost which she paid. The attorneys in the first case were A. R. Humphrey , H. J. Shinn and C. W. Beal for the state and Judge Sullivan for the defend- ants. Most of our people spent the Fourth in our valley. Some of them attended the picnic at Mr. Waddington's ; some spent the day at their homes , while a party of young people celebrated at Mr. Dav's in the good old-fash- ioned way. From the hurrahs , reports of torpedoes , etc , WhICh echoed through the valley , they certainly were patriotic. When evening- came they dispersed , asserting - serting that they could not have had a more pleasant time. At the session of court just , held by Judge Grimes , one of the 1 most important actions was in 'connection with the affairs of the s defunct Farmers Bank ; the Receiver - ceiver C. H. Holcomb , and the - stockholders , led by Harve An- r drews and Tieroey estate , through their attorney , Judge' e Sullivan , sought to have the receiver - - ceiver discharged , and the court t to order that the stoc .h01c1ers be 11 not required to pay what they owed the bank. 'N. T. Gadd for Creditor Stock. ham filed objections , and insisted that the stockholders were Ihlblc at least to the amount of the stock. held b ) ' them , und that they must pay into the hands of the receiver the amount. Judge Sullivan and the recei'er maintained that as the bank owed Mr. Andrews as a creditor about $600 , Andrews could off set the amount due on his stock which is $500.00. and thereby avoid the payment of the $500.00. This proposition was opposed by Mr. Gadd , who insisted that Andrews must pay in the $500.00 , and then receive his prorata share as ; ) creditor . of whutevtr ; dividend there might be , aud Grimes held Ie with Mr. .Gadd. . . s. . 'rhe result was Judge Grimes sustained the contention of Mr. G:1(1I\ : \ nd ordered t h Recei v rte to proceed to collect froUl the stockholders the amount of their stock , and instructed him to not. pay any dividends to any stockholder - holder \vho was also a creditor , but to hold the money and apply it on the stock. S. K. W ar ick was elected , chairman of the meeting and Mrs. J. G. Brepizer , secretary. Mr. Rublee reported that a , train of six coaches and a baggage' car could be had for $350. The terms were accepted , on . condition the grounds at Ra\'enna were found to be in good condition for the picnic , and A. R. Humphre ) ' was appointed a committee to v.isit the grounds Friday. The plan is to furnish free transportation for all Sunday . school pupils under fifteen years old in t1 e - diS-j trict and give everybody whether they belong to a Sunday school. . or not au opportunity to join in , . . t.he excurS10n and have a day of outing that care to go.
