'l'here is no cliange recommended for the 12th. the counties composing it being Buffalo , Custer , Dawson and Sherman. Should the bill become a law it will save the state $16,000 a year. ! When the Bee and Herald were fighting for the local assessment of railroad tcrminals they entirely ignored the interests of the rural com- muni tics , hosc taxes would be increased by the decrease of rail- rend v luation along the line of road. B t whcu they discovered that Representat 'rooley's bill provides for apportioning of the one-fourth state school fund equally between the school districts - tricts instead as formerly on the ' . school population , they enter a . . . . . . . . . ' ; - , , vigorous protest. But it is medicine - icine of their own Jdud and now let them .take it. - . Representative Tooley only secured - cured 41 votes in the HouseTues- day for his reaportionment bill while there ' \tere 48 recorded against it. It was on the re- aportionmel1t issue Mr. Tooley was el cted. The bill has not been passed upon by the Senate wli r it is also on file and it is a bare possibility that it will pass that body and be returned to the Ho lse for its coucurrence. But if such a thing should occur it is ha'rdly protmblc that the house would change its vote. Personally - ally Mr. Tooley has our sympathy - pathy as that bill was his whole . stock in trade. But he succeeded in attracting the attention of the public through his bill and got not a " little notoriety out of it for effort. The Kearr1ey papers are inclined - ed to find fault with Judge Gutterson's appointment to succeed - ceed Judge Sullivan as Judge of the 12th Judicial district because HIe office had been held by two Broken Bow lawyers previously. 'rhe Kearney papers evidently must think that Kearney is the only city in the district that is enHtled to Judicial honoxs. : As a matter of fact Judge Gutterson is only the third person that has held that position oi Broken Bow since the organh..ation of the county twenty six years ngo. . If ollr memory serves us correctl ) ' all the other occupants of the bench for the district have. been , Kearney la wyers. They were Judge Gaslin , Judge Savage , Judge Hamer , J.l.1dge SinCHl'ir and Judge Grecn. ] t is also true "that that three of the abo'e men attained - tained to the position byappoint- ment. In all of that time Kearney - ney has had the court reporter whose salary is nearly as much as that of the Judge. It comes with poor grace for Kearney to kick. ' The Omaha papers are vigorously - ously opposing Tooley's State Apportionment bill on the gfounds that it takes the money from Douglas county and distributes - tributes it to the smaller counties of the state. It was on that issue that Mr. Tooley made his campaign and no doubt won him enough votes to rlect him. kt the time we maintaine that as the money was apportioned on the basis of school population that Douglas county was entitled to her full share though she had less number of school districts than : some counties with a much less : population. But since Omaha : sects to local1r a"'ess the railroad - . road terminals and thus deprive : the rural com\l1t1niti s of their hgitmate rights from thie source we fell that it will be equally as as fair for the rural school districts - : tricts to profit by Omaha's lar'ge ! school population. The main features of the bill had been agreed upon by the member , , th < : , actual work of the compilation - tion had yet to be done. , On this a r.ommittee of six lawyers has put in a solid week , and a report . of the finished product is expect- . ell in a day or two. 'In the me.an time it is noticeable that faith in the ultimate passage of a revenue. bill has grow"n amon'g . tne members - bers of the legislature , as well as among outsiders. This shows a considerable confidence in the members of the revenue com- mittee. , . ' " * ' " On account of the pending revenue bill , the events of the past week have not been of great interest. Appropriations for state institutions have been reported - ported and discussed in some cases , but it is conceded that most of them must wait until the one important matter is disposed of. There has been discussed in both ends of the house regarding the prevailing methods of letting bridge contracts in the countries and bills to encourage honest contracts and shut out combl11a- tion bidding have ot fairly well started in botli ends of the legis. . lature. They call for practically the same thing , which is , that any person be allowed to build an elevator adjoining the railroad right-of-way at station , and compel - pel the company to run a side track up to thc elevator.
