misquotcd him last week in his
ruling in thc Armstrong caseand
that he did not hold that thc
shcriff could charge for each in-
di vidual cxecu l on fiom t he count -

not hear the judgcd instructions
we acccpt his correction. But
we mainiain that the law does
not warrant thc vcrdict in that
case. In our opinion somebod ) ' is
at fault. If the law means what
it says when it spccifIcally pro-
vidcs that the fee shall be live
cents a mile "actually and ncccs-
sarily tnl\'ellcd , "i t docs not mcan
that a sheriff can start with ten
distrcss warrants on partics five
miles apart , thc farthcrst enc
bcing tift ) ' miles from the county
seat , round trip 100 milcs and
legally charged therfore 550
miles e\'en at 2 ccnts a milc.
By that method it would cost the
county S13. 5 for tra\'elling 100
miles , when at. fivc cents. for the
miles actually travelled , it would
cost bu t S5.00.
