hitherto counted as one of the most
conservative republicans in the house,
has brought trouble to the door of the
party leaders by introducing , a bill
of a substance bo strongly paternalis
tic that it casts some of the radical
measures into the shadow and by com
parison makes the others appear as
bulwarks of conservatism.

poration in the country that is en
gaged in interstate commerce In fuel
or food supplies.
Two years ago Representative Mar-
tain forced consideration of his reso
lution asking for an Investigation of
the affairs of the beef industry. The
resolution passed the house and the
beef inquiry was on. The pressing
of this resolution was not taken by
congress to mean that the South Da
kota representative had departed from
the path of conservatism, for he rep
resented a great cattle raising state
and his stand was taken in obedience
to the wishes of a large body of his
constituents. '
! The measure of this Dakota con
gressman provides that every cor
poration, joint stock company or other
association engaged in Interstate and
foreign commerce . in food supplies
shall first obtain from the secretary
of ' commerce and labor a franchise
permitting it to conduct business.
i Must Prove It is Not a Trust
Before thecompany can be licensed
it must prove.. it is not overcapitalized
and that its capital represents a fair
valuation of its rights and properties,
and it mus"t be made plain that 'the
company is in no sense a trust, that
it is not its intention to enter any
combination or conspiracy in restraint
of trade, and tha there is no thought
of attempting to monopolize the par
ticular business in which it is to en
gage." J" '. ' ":. ' :
Fees for examination are to be
charged and a price is set on the li
cense, all moneys paid for the service
and the franchise to be put into' a
fund for the promotion of the work
of the bureau of corporations of the
department. Every year, or oftener if
the department demands it, the' cor
poration is to make a report sworn
to by its president, its manager, its
treasurer and a majority o fits board
of directors, setting forth the prop
erties, the earnings, the profits, the
dividends and lastly- the business
methods.
Forfeit of Franchise
If the corporation does not come
to time with its report on the date
set, its franchise is to be suspended
until it complies with the rule. If
it be proved that the corporation has
violated any law against monopoly or
in restraint of trade it shall forfeit
its license, but on a proper showing
of amendeed conduct it may recover
its franchise. If, however, it offend
a second time, it shall forever be
barred from business.
The measure provides that the re
sponsible officers of any corporation
of the kind specified in the title that
shall attempt to do business after
July 1, 1906, without the proper au
thority or in violation of the provi-j
sions of the act, shall be fined not
more than $5,000 or imprisoned for a
term not exceeding one year, or suffer
both penalties, at the discretion of
the court.
Goods May Be Confiscated
If any corporation attempts to
carry on interstate commerce In food
or fuel without a license any goods
that it may have In transit are to
be seized and confiscated by the gov
ernment. Such are botup of the provisions of
this measure introduced by Mr. Mar
tin of South Dakota and at the bill
and at the man behind It the republi
can members of congress are looking
fairly aghast.
This bill has gone to the commit
tee on Interstate and foreign com
in free.

Senor Quesada, Cuban Minister to the United States, is an orator born. la
an article in The Outlook for July, 1899, by George Kennan,who heard Quesada
