By pleas in abatement, attorneys representing the seventeen packers and other per sons indicted by the federal grand jury on a charge of 'conspiring to monopolize the meat business at tacked the position of the government today. The attack was made against the impanelling of the jury; alleged improper service of a summons on John Murray, one of the jurors; un lawful secrecy at the time the Jury was drawn from the box; unlawful presence of a stenographer in the jury room during the hearing and the subsequent writing of the shorthand notes; that the indictment was re turned in the eastern division of Illi nois, although the jury which found the indictment . was sitting in the northern division of the northern dis trict. The plea, which is very lengthy, ws filed late this afternoon with Dis trict Attorney O. B. Morrison, after an all day's conference between At torney John S. Miller, general coun sel for the packers and a number of associate counsel in the case. There were no court proceedings, and the plea has not yet been properly filed with the clerk of the district court, but this will be done tomorrow even ing. The main ground upon which the defendants stand in their plea, is the presence of John Murray on the jury. It is their claim that the jury was drawn from the box previous to March 3, M which time a law redis tricting the northern district of Illi nois went into effect. Previous to this Kankakee county was in the northern division of the northern dis trict of Illinois. By the terms of the new law this county was placed" in the eastern division of the northern district, and therefore not within the jurisdiction of the court.
