tified that on the 17th day of July,
1905, Moses Herrick commenced an
; action against you in the district court
of Lancaster coun-ty, Nebraska, for
the purpose of foreclosing a mort
gage executed by said William Hol
man Jennings and his wife, Addie L.
Jennings, on the 6th day of June, 1904,
on lot twelve (12) in block two (2)
Pleasant Hill Subdivision of lots three
(3), four (4), five (5) and six (6) in
the northeast quarter (N. E. i) of
section thirty-six (36), township ten
(10) North of range six (6) east of
the sixth P. M. in the city of Lincoln,
Lancaster county, Nebraska, which
mortgage, was filed for record in the
office of the register of deeds of said
county on the 7th day of June, 1904,
and recorded in book 135 of mort
gages, at page 279. Plaintiff alleges
that one of the notes secured by said
mortgage is past due; that the delin
quent taxes for 1904 have not been
paid upon said real estate, and the
insurance on the buildings not kept
up and maintained, and that the con
ditions of said mortgage have been
broken, and that there is now due
on said mortgage debt the principal
sum of $2,100.00 and the taxes for
1904, and the insurance paid by the
plaintiff to protect his mortgage se
curity. Plaintiff alleges that the de
fendant, William Holman Jennings, is
insolvent; that he is a non-resident
of this state, and that the value of
said real estate is insufficient to pay
said mortgage debt, insurance, taxes
and accrued interest and costs, and
that the improvements upon said
real estate are being damaged and
destroyed. Plaintiff prays for a fore
closure of said mortgage and a sale
of said premises according to law,
and for the appointment of a receiver
to collect the rents and profits pend
ing the litigation, and for general
equitable relief.
The plaintiff will apply for a re
ceiver for said real estate on the first
day of the next term of said court,
or as soon thereafter as counsel can
be heard.
You are required to answer said
petition on or before the 28th day
of August, 1905, or the allegations
thereof will be taken as true, and re
lief granted to plaintiff in harmony
with said petition.

Plaintiff claims a first ' lien upon

years 1887, 1888, IC90, 1891, 1892, 1893,
1894, 1895 and 1896, and subsequent
taxes paid upon said premises for the
years 1897, 1898, 1899, 1900. 1901, 1902,
1903 and 1904, for which taxes with
interest and penalties thereon the
plaintiff prays for a decree that the
defendants be required to pay the'
same, and that plaintiff have a first
lien upon said premises, and that if
defendants fail to pay the same, that
then said premises may he sold in
accordance with law .to satisfy the
amount found due.

Mr.'Wm; Aldrich of Ord, Neb., was
on the market July 21 with a very
nice car of heifers that sold for $4-80,
a very satisfactory price considering
the condition of the market. They
were sold by the Nye & Buchanan
Co. Mr. Aldrich kept two head at
home which he expects to make very
fancy by about the holidays. They
were making exceedingly good gains
and he kept them partly as a mat
ter of experiment J.o show what
ould be done in the way of putting
on flesh.
