You and each of you are hereby noti
fied that on the 20th flay of May, 1905, the
above named plaintiff, Henry J. Amen,
commenced an action against you and
the other defendants above named, the
object and prayer; of which are to remove
certain clouds upon the - plaintiff's - title
to lots three (3), four (4) and five (5), in
block one hundred ninety-seven (197) "in
the City of Lincoln, Lancaster County,
Nebraska, and to quiet plaintiff's title
therein as against all of the defendants
In said suit, including each of you, and
plaintiff alleges as the basis for said ac
tion that a certain deed appearing in the
chain of title to said real estate from
Champion -Mayfield , and the defendant
Nathaniel Atwood, Was made by mistake,
and that the grantor therein had ; no
title to said real- estate, and "conveyed
none by said deed, and also that on the
24th day of April, 1889, one J. J. Kepner,
who was then the owner of said real es
tate, executed a warranty deed, which
purported to convey said real estate to
Perry & Co., a partnership, composed of
Ell Plummer, Roscoe A. Perry and John
Fitzgerald, Sr.; said t deed beingr given in
fact to secure a, debt due from the grantor
to said grantee, but this fact was not dis
closed on the face of the deed.
That on the 4th day of April, 1890, said
debt having been fully paid, said Plum
mer, Perry & Co.,' "attempted to recon
vey said real estate to said J. J. Kepner
by quit claim deed, but plaintiff states
that said reconveyance was defective and
irregular as it was not execpted by all of
the members of said partnership, but was
executed in the partnership name of. said
firm, and that by reason thereof a .cloud
Is cast upon plaintiff title, which plaintiff
seeks to remove by said suit. - .- ;
Plaintiff prays to . have said " several
clouds and defects removed from said
title, and title quieted in him.
You are required to answer said petition
on or before the 3rd day of July, 1905ror
the .allegations thereof will be taken as
true, and a decree entered accordingly.

MAYOR TOM JOHNSON'S PLAN
Proposes a Holding Company for Man
agement of Street Railways
Mayor Johnson of Cleveland has
evolved a novel sort of compromise
scheme for the regulation of street
railways. ', By means of it he hopes
to avoid the worst of the dangers
feared by the opponents to public
ownership and at the same time ob
tain the chief, advantages that the
favorers of municipal control contend
for. The' plan has the further great
excellence of being tentative; it does
not ommit the, advocates of either
poiici to -an investment from which
they could not withdra without big
loss , .of .time ,and money. If the at
tempt at improvement does not work
well it will be quickly self-corrective.

Mayor iJohn?onr is a favorer of mu
nicipal ownership, - and a contender
that fares should be reduced from 5
to 3 cents, ; The Cleveland Electric
Railway company has offered to
meet him half way with "a four-cent
fare,if the city .will extend thefran
chises for twenty-five years. Johnson
refuses this, but offers instead,, his
original plan of compromise. He pro
poses that the railways be turned over
to " a . holding company, , a board of
trustees', appointed mutually by , "the
electric cor.pany and the city. The
holding company is to guarantee pay-ment-of
interest on the bonds of the
electric company and the regular 5
per cent on its stock. Out of any sur
plus it is to make needed extensions,
to provide. :a sinking fund for jthe
bonds, and. to reduce fares. Johnson
believes ' that five " months of . such
management . of- the railways will
prove his contention that three-cent
fares are feasible. If the holding
company fails to make good the pay
merits of "interest and dividends as
promised, that failure will work for
feiture and the property returns to
the control of the electric company.
