that the act of the last Legislature of the
Territory, designating the County Commis
aioners as the pioper persons to enter Town
Sites, is not recognized by the Commissioner
of the Laud Office.
II is a question of doubt whether the Judges
of Probate, or the United States Judges, can
bo regarded as "Judges of the County Court."
As soon ns that doubt Is removed, notice wi.l

the "Judges of the County Court" are given
the authority to enter "Town Sites." In this
Territory there are no such officers ns "Judges
of the County Court," but the Legislature has
recognized the "County Commissioners" as
the proper persons to' enter Town Sites,"
and we have, in view of the spirit of the law,
permitted such entries, in the hope that it
will meet the approbation of Ihe Department.
