HIS SUIT IS FAKE
Tv-Road Fireman Confesses
He Perjured Himself in
$25,000 Damage Case.^
By Associated Pres*.
North Platte, Neb., Feb. 27.—John
W. Sukumlyn, plaintiff In a $25,000
damage suit against the Union Paci
fic railroad for alleged Injuries re
ceived at Paxton, Neb., while in the
company’s employ as a locomotive
fireman was arrested last night on a
charge of perjury, having admitted on
the witness stand while under cross
examination that his story was false
and his scheme but an effort to ob
tain easy money. He will be given
a hearing on the perjury charge this
afternoon, having signed a confes
sion late-Thursday evening, exposing
the entire deal.
Sukumlyn claimed he received
serious and permanent injuries while
taking water on an engine. He made
a good appearance before the court
and jury and told a convincing story
of his accident and the serious in
juries resulting therefrom which kept
him from further work.
Activities Traced.
Suspicion w’As early attached to
Sukumlyn’s claim, and Tom Watts of
the claims department of the Union
Pacific learned that Sukumlyn had
been employed at the borax mines in
Nevada shortly after the date of the
alleged injury, and later had re
entered the service of the Union
Pacific as a freight brakeman at
Ftawlins, Wyo., under the alias of
John Ij. Hester, and was so employed
until appearing here for the trial.
Attorneys T. »F. Hamer and J.
Keefe for the railroad in cross-ex
amining Sukumlyn allowed him to es
tablish his claim that he had been
unable to work and then dramatical
ly confronted him with proof that
quickly broke down his story and he
confessed to perjury.
Judge Rebukes Him.
A death like silence prevailed in the
courtroom when Judge Nisely took
matters in his own hands and de
livered a scathing rebuke to Suk
umlyn and his attorneys, Hoagland
and Carr, withdrew from the case
when Sukumlyn admitted that he had
perjured himself.
Judge Nisely then ordered that
Sukumlyn be taken into custody by
the sheriff and directed County At
torney Jomes to file charges of per
jury against him.
