Lease Is Valid,
Referee Holds
H’rurtee of Bankrupt Mercan
tile Firm Given Option of
Holding Contract
as Asset.
Ths seventeen »n<1 one-half-year
lease on the four-story building of
the former Burgess Nash company at
Sixteenth and Harney streets was de
clared by Referee In Bankruptcy B.
H. Dunham to be valid Saturday.
Dunham also ruled that Herbert
Daniel, trustee of the bankrupt com
pany, could either accept the lease as
• n asset of the bankrupt estate, or re
ject It, within a reasonable time.
As matters now stand, the lease Is
hubject to an option of Daniel.
The court further restrained the

Its secretary, and their servants and
• gents from In any manner Interfer
ing with H's possession of the leased
premises by Daniel until further order
of ths court.
Baum to Appeal.
. Daniel Baum Saturday said that he
Would appeal the order of ths cgurt
to ths federal court, and If the order
Is sustained would appeal It to the
circuit court.
"Ths order may cost the creditors
Df the company lots of money,” said
Baum. “All the trustee has Is an
rmtlon on the building. He has de
^^rf^ulted In his rent for this month,
hasn't paid any taxes, and is keeping
s. dark building in the heart of the
retail district of Omaha that we can
rent Immediately. Many persons are
being kept out of work. We have a
prospective tenant that would take
possession of the building and employ
between 500 and 600 persons Immedi
ately.”
Baum said the Baum Realty com
pany, as owner of the building, en
joined from interfering with posses
sion of the leased property, was given
only 48 hours to answer the restrain
ing order, when a much longer time
was needed.
Daniel’s Petition.
On February 5. Herbert S. Daniel,
ns trustee of the company, filed his
petition, setting forth the facts upon
which he hopes to establish his claim
of an option on his part of the build
ing within a reasonable time or to
accept the lease as an asset of the
bankruptcy estate or to reject the
same ns burdensome.
Dunham on that day Issued an or
der fixing the hearing of the petition
two rlays later and ordered the Baum
Realty company to answer In writing
to the petition on or before that
Cinte.
The hearing was postponed on
• greement of counsel until February
11, when the Baun Realty company
filed the answer and Daniel his re
piy.
Rental 8 Per Cent.
The rental on the building Is based
upon 6 per cent of (he valuation. This

^TpAppralsal. The lease also requires
l that the lessee, In addition to the rent
al payments, pay all taxes, imposts,
assessments and charges of every na
ture and description pertaining to and
arising from the property, or which
may he levied by the government of
the United States, the state of Ne
braska. the city of Omaha, or any im
provised district or governmental
agency.
Daniel said Saturday he had sev
eral prospective tenants for the cor
ner.
Burglars Take
Variety of Loot
Ranges From Copper Boiler
to Chiffon Hose and
Child's Bank.
Many things ranging from copper
hollers to chiffon hose were stolen
Friday night by thieves and prowlers
in various parts of the city, police
reports show.
On a ladder a thief mounted the
dining room window of Mr. and Mrs.
If. T. Gittlngs, Bedford apartments.
Twenty-second and Jones streets,
stealing chiffon hose and other
clothing worth $150.
The lock was pried from a door of
H, J. Knudson's grocery, 4567 Cuming
street, the cash drawer was pried
open and the picaroon got $2 69 for
his efforts.
^^Asq^n overcoat, ring and woman's
cnaln with topaz were taken from
the home of Robert I’ettey, 4915 Ames
avenue, the thief entering through a
window.
A man was en^cged to clean the
furnace at 1912 I ! street. When
he left, Clevelan on found he
had been "clenne -ray and tan
suit also. Alum.i nd brass In
sacks to the value < i 5 were stolen
from L. Weiner. 1509 Nicholas street.
A copper boiler and galvanized gar
bage can were stolen from 2037 Dodge
street, home of Mrs. Walter Hamil
ton.
D. Donaldson, 2616 Corby street, re
ported that a thief entered his domi
cile with pt pass key and stole a purse
with $14, child's bank containing $1
and $2.80 from a dresser drawer.
' WAVRIN QUITS
AFTER CHARGES
Patrolman Joe Wavrin, who was
iscently suspended pending a hear
ing of charges of conduct unbecom
ing an officer, handed Ills resigna
tion to Chief of Police Van Deusen
Friday.
Wavrin was suspended after two
persons whom he arrested last Satur
day complained that he was drunk.
Neither Chief Van Deusen nor
Wavrin would comment on his
resignation. The charges against him
