Roll Call Being Taken on U.

Indianapolis, Ind., Jan. 30.—Unof
ficial tabulations gave the adminis
tration forces of the United Mine
"Workers of America a majority of
113 votes on the roll call of the dele
gates to the biennial convention and
retained to them the appointive pow
ers of the organization. The unoffi
cial vote was 2,120 votes in favor of
retaining the present secretary of the
constitution which permits the ad
ministration to appoint organizers
and other officials and 51 against.
Indianapolis, Jan. 30. — Appointive
powers of International President
John L. Lewis hung in the balance
. today as the roll call of delegates to
the United Mine Workers convention
was resumed, following a partial roll
call yesterday, which gave a vote of
1,528 to 1,475 in favor of the proposed
change.
Insurgents have given their entire
y length to this fight, their leaders
announced and they expect to main
tain their lead throughout and ac
complish the change by a safe mar
gin. Administration supporters on
the other hand, declared the lead of
13 votes gained yesterday will be
overcome when the districts of the
southern and western states vote and
that the president will be upheld by
a majority of between 200 and 300
votes.!
Districts that administration sup
porters count on to accomplish this
are those in Iowa, which will be
called first his morning and then
West Virginia. Kentucky, Tennessee,
Alabama, Colorado, Wyoming and
Montana. They expect to lose Kan
sas. Maryland, Canada, Nova Scotia
and Michigan districts.
This roll call will consume the en
time morning's session, it is expected.
Afternoon rereading of constitutional
amendments will he resumed. Hope
that was bright Monday for adjourn
ment this week-end was clouded to
day and should more prolonged argu
ments develop today it was declared
almost certain the sessions will con
tinue until next week.

New York, Jail. 30.—A perform
ance was in progress at the Caruso
theater, a vaudeville and motion
picture house in tile lower east side,
last night, when smoke began to
drift across the stage and into the
audience. Hut Instead of rushing
for tlte exits, a majority of the
1,200 persons in the auditorium at
first refused to leave the building
without assurance from the man
agement that the price of admission
would be refunded.
Finally as the theater manager
argued with the crowd from the
stage, the smoke became so thick
that the crowd reluctantly aban
doned the demand for a refund and
filed through doors and fire escapes
to the street. The tire damaged the
property room and first floor of
the theater.

Chalon-Sur-Saone, France, Jan.
30.—The assize court has acquitted
Count Ferdinand De Jouffroy Dab
bans. former attache at the French
embassy in Berlin, on a charge of
bigamy.
Count Dalibans is a member of
one of the most aristocratic fam
ilies of France. He is a descendant
of Marquis JouITroy Dabbans, who
tirst applied steam to navigation.
The count was born in Sail F’ran
i isco while his fqther was French
consul there. At tile trial it was
k brought out that he had married an
|ev . Knglish woman named Charlotte,
llin In Folkestone, England, In
1914. In 1919 he wedded a French
heiress. Marie Do Saint Innocent,
although the first marriage was not
dissolved by the court at Dijon un
til 1922.
The count contended that the
first wedding was onfy a Joke and
that no one ever considered it valid
since the bans were not published
in France. The Judge sternly re
linked the defendant, asserting that
lie had played with tho law and
was trebly guilty on account of
birth, education and his association
with the diplomatic service.
However, the jury was more in
dulgent and acquitted Count Dab
bans after five minutes' delibera
tion. ,
$5,250,000 Suit Is Dismissed.
New York, Jan. 30.—After three
weeks of trial, the 13,250.000 suit
brought by Mux Hart, booking agent,
ngainst the B. F. Keith Theatrical
Exchange, Inc., tho Orpheum Circuit,
Jne., and other vaudeville Intereats,
was' dismissed Tuesday by Federal
Judge Augustus N. Hand.
Tho suit was based on charges that
tho defendants conkpired to boycott
acts booked by Hart so as to ruin hla
business. Judge Hand Held that as
actors traveled with tliclr parapher
palla from stato to state, tho business
of booking them did not fall within
interstate commerce provisions of
Hie fcihernian anti trust law.

on Radio Bill
Omaha radio enthusiasts are due to
receive a rather out of the ordinary
treat Thursday night, when a pro
gram is to bo broadcast during the
dinner hour. '
For the first time In a year Hugo
Heyn and his orchestra will go on the
air, playing what they term "sym
phonic dance arrangements." Several
of these arrangements recently have
been completed by Edwin Kahn,
pianist, and by Mr. Heyn.
Ex-Congressman Dies.
Baltimore, Jan. 30.—Frank O.
Smith, former Maryland representa
tive in congress from the Fifth con
gressional district, died suddenly
while at the supper table at his home
at Dunkirk.
