A lecent decision of the district court of Webjter county to tho effect that district navine bondb are not i.n obligation of an entire municipality, but of the d'str.ct ithclf has sadly dis turbed the holders of bonds of tli.it character issued by second c'ass cities of the .stute, and they have employed a high-priced firm of Omaha attor neys to secure a reversal of that de cree in the supreme court. In 1919 tho citizens of part of Red Oloud, feeling themselves flush and being possessed of nn urgo for civic improvement, did a lot of paving. A year later tho city didn't have enough money to pay the interest on 4,he bonds, and the city council proceeded to issue refunding bonds that arc the obligations of the entire city and pay able out of general tax levies, interest and principal. Citizens living outside tho paved area went into court about it, assort ing that the paving specially beneficed tho property abutting thereon and that it is contrary to law an equity to com pel everybody to pay tho cost of pav ving thnt directly benefited only a few property holders. Tho district court held with them. In a brief filed in supremo court Tuesday extensive arguments aro sot forth by the attorneys who appear as friends of the court in support of tho legal thesis that district paving bonds are tho general obligations of the city. It is asserted that it is tho power and tho duty of a city to raise by general taxation a sum sufficient to meet any deficiency caused by the failure, in tho first place, to levy sufficient money by special assessments to pay all of tho cost. They also interpret th" x isting law to support their contention. It is pointed out that tho city is within its legal authority when it or ders an improvement mado thnt does not specifically benefit any pieco of property, nnd that it power is not limited by tho cost of tho improve ment whore it exceeds tho special benefits conferred.
