said dty, and In all cases where thu tracks of
any street railway run lcugthwlf, for any
distance, of any street, allej or highway of
saldi-lty, the railway tracks and tin space
between the rails and for the distance of one
foot without the Hue of the rails shall be kept
and maintained on a level with the street
surface, adjaci-ufto such railway and shall
be ki pt In repair mi that such tracks may be

all directions on such alley nnd highway by
wagons, carrlaucsand other vehicles without
obstruction to travel on such highways, and
It shall be the duty of the person, company
or association, owning operating or conduct

to the Mayor and council that the Hue of
tracks of any street railway or any part

to the requirements of the preccedlug section

may, by resolution, direct that any portion,

tracks thereof, huso changed as to conform
to said requirements within such reasonable

Provided, however that tho owner or oper
atorsof such street railway, by applying to
the Mayor and council therefor may be
granted such additional time In which to
comply with such resolution, as thu Mayor
and council may deem reasonable and
necessary.
Section VI. Any owner, operatoror mana
ger of any street railway mentioned in sect
ions ono or two, hereof orany olllccror agent
or employee of tiny of them, or any person
engaged In the -actual operation of such
street railway, who shall willfully fall or re
fuse to comply with or shall obstruct or pre
vent the carrying out of any of tho provisions
of this oullnance, shall be deemed guilty of a
misdemeanor and upon conviction shall bo
Until In any sum not less than ono dollar nor
more than ono hundred dollars.
Section VI I. Tho said Ordinance Ne. 69, as
now existing and all ordinances and parts of
ordinances In couillct with any of tho provis
ions hereof are hereby repealed; and this
ordinance shall he In force from and after Its
passage, approval and publication according
to law.
