the act did not refer in any way to an
Independent act creating the stato
normal school at Kearney which says
the normal board now In control shall
manage (hat Institution. To hold tho
now act was amendatory of this
separato net would bo contrary to the
constitution and to hold tho new act
constitutional would result In retain
ing tho old board In control of tho
Kearney school and tho now board In
control of tho Peru nchool and Junior
normals.
Tho opinion says: "Tho amendatory
act contains nn attempt to amend and
repeal tho governing statute of the
Kearney normal school by amendment
of nn Independent s(ntuto relating to
the stato normal school at Peru and
for (hat reason contravenes the con
stitutional provision that no law shall
bo amended unless the new act con
talus tho section or sections so amend
ed and tho section or sections so
amended shnll be repealed."

or In the brief of (he relator, and
therefore should not beeoiihiderod.
The answer to tho suggesilon is that
this is an action on behalf of tho state
brought by tho attorney general to

validity of the statute in order to
further tho educational interest of tho
state, and If for any reason wo are
convinced that the statute Is uncon
stitutional wo ought to so determine;
for if the courts can, under such u pro
text, nullify the constitution, wo will
soon find ourselves openly defying
tho provisions of the fundamental
law which we havo solemnly sworn
to uphold."

state penitentiary, has tho finest drove
of red hogs in Nebraska at tho state
im-'tltutlon. I'ho state drove numbers
something ovor lui) of which 100 have
been born within tho last three weeks
and Mr. Smith says lie does not In
tend to lose a pig. In addition to the
hogs at tho penitentiary Mr. Smith
farmed soino 500 acr s and now has
stowed away some 900 bushels of po
tatoes, his crop, he said, being al
most a failure; ;!50 bushels of turnips,
200 bushels of carrots and 11,000 head
of cabbage.

Requisition for Auto Thieves.
Governor Shnllenlierger honored a
reuulsltlon from tho governor of Iowa
for the return of two unldentllled
men to Sioux City on tho charge of
stealing an automobile. The men ran
away with an automobile owned by
Dr. Sawyer of Sioux City, In,, and
were caught in tho town of Jackson.
Judge Sedgwlck'c Expenses.
It cost Judge Samuel Sedgwick $113
to lie elected to tho supreme bench.
Of this amount his statement Hied
with tho secretary of state shows
$200 went to the republican stato
committee and $200 at a later date
was "promised" the committee. H.
r. Good, the democratic-non-partisan-populist

No Quail Season.
That the season on quail has been
Indeilnitely closed in Nebraska is a
matter which seems to have been for
gotten by many hunters of tho state.
Dan Gellus, stato game warden, has
received many Inquiries during the
last few weeks in regard to tho opon
season and a Hue of $5 and costs may
be Imposed on anyone who kills a
quail or is found with quail In his pos
