Sko. 13. All persons applying for
relief shall be required (o show by the
affidavit of himself and the affidavit
of two freeholders, residents of tho
oounty, who havo personally known
tho applicant, for rollof for six months
immediately preceding tho passage of
this act,'that he is entitled to such ro
lief; that ho has beon a bona fldo resi
dent of said oounty wherein tho ap
plication is mado for relief and of tho
stato for moro than fix months im
mediately prior to tho passago of thin
tot. That he is 'Without ruonoy or
other means wherowith to supply him
self with tho articles applied for, All
applicitioos must comply with tho
rules and regulations prcitoribed by
tho relief commission; Provided, that
in no case shall a sum greater than
ten per cnt of this appropriation be
distributed in and for any ono county.
Sec. 14. Any member of tho Stato
Relief Commission, of tho county
central committee of relief, or of tho
sub-prcoinot oommittee knowingly dis
tributing supplies to individuals not
in need, or who arc ablo to procure
supplies for thcrasolves, shall be deem
ed guilty of a misdemoanor. and upon
conviction shall bo fined in a sum
not exceeding $100.00, or imprisoned
in tho county jail not moro than thirty
days.
Sec. 15. Whereas an emergency
exists, this act shall toko effool and
bo in force from and after its passage.

procuring Bccd and feed for teams
used in cultivating tho land on wbioh
tho seed is planted; to provido for
tbo sain of tho same, and to punish
tho violations of the provisions of
this act.

Bo it Enacted by tho Legislature
of tho dtate of Nobraska:
Sec, 1. That tho county board of
any county of this stato shall havo t!?
authority to issuo tho bonds of suoh
county, to an amount not to exceed
five per cent, of the assessed valuation
of tho aounty, or tho year 1894, but
not to exoeod tho sum of fifty thous-
sand dollars, for the purpose of rais
ing money to procure seed to bo
planted and sown during tho year
1895, and feed for tcaini" used in
planting and sowing said seed; Pro
vided, a special election shall be called
at which tho question of bonding the
county shall bo submitted to tho peo
ple aa provided herein.
Sec. 2. If the people of any coun
ty in the stnto of Nebraska shall bo in
a dcstituto and dependent condition
on account ot the failuro of crops
from dfouth or other causes over
which they havo no control, a petition
setting forth fact that the people of
suub county, or n large number of
them, on account of tho failure tf
crops in said county are in a destitute
and dependent condition, and stating
the cause of tho failuro of orops sud
the amount of funds which will be
required to supply suoh people with
seed and feed, signed by at least one
fifth of the resident electors of suoh
oounty may be filed with tho county
olerk praying the county board to oall
a special election to vote upon the
question of issuing the bonds of tho
oounty to raiso suoh funds. Where-
upod said board shall oall an oleotion
as prayed for in said petition, and the
oounty clerk for suoh oounty fcball
give uotice of suoh eloetion by publi
cation in two consooutive issuea of
one or more weekly papers publish) d
and of general circulation in such
oounty, and by posting a notice at the
polling placos in each preoinot, and if
a majority of the votes legally cast at
suoh eleotion shall be in favor of tho
issuing of suoh bonds, thon the couu
ty board shall issue the bonds of the
oounty payable in ten years with the
option of the county to pay the whole
or any part thereof after the expira
tion of five yean from the date there
of, with interest at seven per cont por
annum whioh said interest shall be
payable annually,
8eo. 3. If any county of this
state shall issue its bonds under this
aot, tho board of commissioner!1 pio
vided for in seotion one of Article
VIII, of the Constitution of tha state
of Nebraska are hereby direoted and
it shall be their duty to invest any
part of tho permanent sohool funds
available, in said eounty bonds at
their par yaluc, if offered to them by
tho propor officorc; Provided, how
over, that tho officer of tho county or
countio issuing bonds under this
aot, shall nrgotiato sad bonds at tho
highest obtainable price not less than
par valuo
Sec. 4. Tho county hoard shall in
vest the proceeds of said bonds, or so
much thereof as may be nccecsary, in
procuring seed and feed for teams, as
provided in seotion 1 of thisaor, and
shall sell tho aamo to nuuh persons
only as aro engaged in agriculture, at
a uniform prioo to caoli and vrry pur
chaser; and shall tako therefor uc!
form of security for tho payment of
suoh purohaso price as will, in theii
judgment bo just, and best protect the
interest of tho oounty. Provided,
that the wholo of said purchase priee
shall bo duo and payable on or before
tho first day of March, 189G, with in
terest thereon at tho rato of ten per
cont per annum until paid.
Sec. 5. No party shall bo permit
ted to purchaso any of said seed oi
feed until ho shall havo first mode and
filed with the oounty board an affidav
it showing that ho i actually engaged
in farming; that ho has no seed or
feed for his team and is without means
to purchaso tho ramc, or. if ho has
any, stating tho quantity thoreof, the
number of aores ho owns or has rent
ed, and the number of acres ho in
tend! to put into crops for the season,
and that ho will uro said sped and
feed for no other purpose than than
provided for in this act. Ho shall
also furnish tho affidavits of two ored-
iblo residents ot said county and of
his neighborhood to tho effect thut he
is a rcputablo citizen of suid county
and that they verily believe that the
statements contained in his kffidavit
aro true; and. upon suoh affidavit br
ing mado and filed, tho siiii-j to be
preserved in tho office of ihe county
clerk, the county board may sell to
said party such amount of seed or
feed, or both, as thoy, tho said baard,
shall deem just and proper.
Sec 6 Any person who after hav
ing obtained soed or feed as herein
provided, shall transfer or in any man
ner dispose of said seed or feed other
wise thau is contemplated by this aot
shall bo deemed guilty of a misde
meanor and shall on conviction thereof
be fined in any sum not exceeding one
hundred dollars ($100) or be imprison
oned in tho county jail not oxecediig
three mouths.
SEC. 6. Tt'shall bn lawful for the
county board to designate some per
son to sell tho said bonds, and, under
their direction, to invrst the proceed
thereof in seed and fmdaud sell tho
sumo as provided for in this act.
whioh said party so designated shall
give a bond for tho faithful porfor
manco of his duty, which bond shall
not be less than double tho par value
of the bonds to bo negotiated, for the
purchasing of seed and feed and sell
ing the same as herein provided, and
tho person who shall sell said bonds
and purohase and sill said seed and
feed shall make a full exhibit and
settlement with the oounty board on
tho tenth day of June, 1895..
Sec. 8. If any person entrusted
with tho selling of said bonds or tho
the proouring and selling of said seed
and feed shall fail to aooount for and
settle in full for tho money, seed or
feed placed in or coming into .bis
hands, or shall oonvort any part there
of to his own use ho shall be deemed
guilty tf embezilement and upea con
viction thereof shall be punished ac
cordingly. Sxo.9. The county board of any
oounty Uiu'Dg bonds under the pro
visions of this aot shall levy a tax for
interest on bonds as it becomes due;
Provided, that an additional amount
shall be levied and collected suf
fioient to pay the principal of skid bond
at maturity; Provided furthor, that not
moro than twenty per cent of tho prin
cipal of said bonds shall bo loviedand
oalleoted in any one year.
Sec. 10. If any person shall swear
finely in the affidavits provided for
in this aot ho shall bo deemed guilty
of perjury and shall upon oonviotion
tbcfjof besubjeoted to the legal pen
alty. Sec. 11. Whereas an emergency
exists this aot shall be in full foroo and
take tffectfrom and after its passage.
Tna people of this oounty will tako
notice by tho aboe law that if any
aid is to be had they must circulated
petition as provided in the abovo act.
