In this case, the provoca tion to crime was great, and while it does not justiJv. vet it serves to extenuate, and my actiidi m tliepieiuises was based upon the petitions of a large number of the citizens of said county, fourteen members ol the grand jury bv whom he was indicted, and upon the recotuniendation of the Prosecut ing Attorney and the District Judge who passed sentence upon him. The mover or commutation has heen used bv me iu two cases, vi.: Ceorge Hart, under sentence of death, from Hall County, and j John IJ. Polin. under sentence of death from I Cass Couutv. Iu these two cases the sen- tence or deatn was cnaugeti xo imprison ment for life in the State Penitentiary.
