The state elections in New York, Mas
sachusetts, Pennsylvania, New Jersey,
Connecticut, Wisconsin, Minnesota aud
Nebraska, and the local elections In some
other states, have resulted generally in
large Hepubhcm gains. It is truo that
the democrats claim the election of their
state ticket in NVw Yoik, except governor,
Cornell having a handsome p'urality for
that office, but we have besides thu gov
ernor secured the legislature, which will
give a U. S. senator next .year in place of
Kcrnn. So the substantial victory is
ours. Beyond New York nil is one
way, and the grand and sweeping giins
in Pennsylvania. Wisconsin, and elsewhere
are demoralizing to the dcmociats. They
show bejoad a doubt that we will ghin U
S. senators in Connecticut, New Jersey,
and Pennsylvania, as well as in the em
pire state next year, and have secured all
the northern states except New York for
tho Republican candidate for President
next year, as to New York it is. demon
strated that no democratic presidential
candid ite except Tilden would be allowed
by the Tihlenites to have an chance at
all. On the whole, therefore, the Repub
licans arc greatly please! with the result,
and they would be very ungrateful not to
tw so.
The Republican headquarters presented
a lively appearance last ni?ht. Gov.Fos
ter of Ohio was then? lending his good
natured chesr to Mr Fisher, of the (Jon
gressional Committee, who was in charce
in ahsenca of chairman Hubbell. The
crowd besrigrd the houo nearly
all night, and the glorious news
from all qnarlers was greeted with shouts
that made the night resound again aud
again. The jollifications have been all
one way this ytar. The results already
reported place in a rather ridiculous light
the democratic calculations on the electoral
vote next year. Oret-on and Wisconsin
they have put down as "doubtful states,"
while Connecticut, New York, New Jcr
cy and Indiana they put in the democratic
column. By this figuring the democrats
make for thtir side 2.)3 votes, cive the
Republicans 153 and leave 13 doubtful.
This is a striking confession of weakness.
Oregon is not a doubtful state it is Re
publican. Wi-consia is now so surely
Republican that it is simply absurd to
call it doubtful. Connecticut and New
Jersey are

other timber trees. I do not think, how
ever, that it was the intention of U'onrre.ss

containing Krowin timber trees of any of
the above varieties, for the purpose of
the act wis to encourage the cultivation
of timber trees, and if that clans of tpjes
arc growing naturally on the land the ob
ject of the law uukets will lie accomplished
by natural means and thero will be no
necessity for rccourso to artificial cultiva
tion. Where a section of land contiins
a few oittoRwoJ tiecs 'cattercil along
tho banks of a stream of water,! do not
think it shouid be exclude 1 from entry.
The eottonwood belongs tn the poj hr
varieties, aud while the necessity of the
settler may sometimes compel them to
u'e it as timber, it is uot properly a liui
ber tree, the species' to which it belongs
being of rapid growth, soft woo i, and
gem rally used fir ornamental purposes.

1S73, and the act o? March 1 1, I 7 1, con
tained no provisions relative to tho char
acter of the land which were allowed to
be entered, but both of s'icli acts allowed
he UommisMoncr of the General Land
Oilice to make such rules and regulations
consistent therewith as were necessary to
cairy their piovUions into effect.
Under the authority thus given, a form
of affidavit was prescribed by your office
by which the applicant was required to
swear, "that the section of land specified
in my said application is CJinpos2d exclu
sively of priirie lands naturally devoid of
timber.' The onlv difference between
the language of this regulation an 1 that
contained in tho act of June 13, 1S7, is
that the word "naturally" is left out of
the act of Congress and the words "or
other landp" arc added. The obvi-m in
tention of both of these requirements is
the same, viz: That such Unds only a.s
were naturally devoid of timber should be
allowed to be entered, and 1 do not think
that in the construction of this statute
there should be a wide departure from
the construction placed oa the former
regulations of your office.
After a careful con.stdcratiou of the
question presented I am of the opinion
that where a section of land contains any
piue. oak, ash, elm, maple, walnut, hickory,
or other natural timber trees, an entry for
the cultivation of timber should not bo '
permitted, a.s such sections cannot be I
