Potter, and Alfred E. Perry, assumed by John G. Potter, and that the said Alfred E. Perry assigned said mortgage to de fendant James M. Baldwin, md that said James M. Baldwin further a-wign' ed said mortgage to plaintiff, and that since the giving of said mortgage, the defendants composing tbe said firm of Schuster, Ketcbam k Co., and J. C. Ogden k Co., claim to hare acquired some interest in tbe premises no mort gaged, and praying that mid John G.
