Sec. 3 On petition ofexecutors or administrators to sell the lands of any decedent to pay debt?, who shall have left a widow and minor child, or chil dren, unmarried and composing a part of decedent's family at the time of his death, the appraisers shall proceed to aet apart a homestaad in tho same manner as provided in the preceding section, and the bamo shall remain exempt from tale on execution under any order of such court, so long s any unmarried children shall resido there on, although the widow may have previously died, arid tho unmarried child or children of any decedent, actually reading on tho family home stead, shall be entitkd to hold the same exempt from sale upon execution as herein provided for. although the parent from whom the same descend ed may have left no wife or husband surviving. - Skc, 4. Every widower, or widow having an unmarried minor child, or children residing with him or her, or supported by him or her, as a part of his or her family, shall have the benc " fit of this act, in the same manner as married person. And mairicd per sons living together as husband and wife, shall be entitled to the exemp tion of this act: Provided, al though they may havo no minor chil dren. Sec. 5. Any person owning a dwelling house occupied as a family Jiomestead, shall be entitled to the benefit of this act, although the title s to tho land on which the same may be built shall be in another ; and lessees shall be entitled to the benefit of this act, in the same manner as owners of the freehold or inheritance ; Provid ed nothing herein contained shall be construed to prevent a sale of the fee simple, subject to such leave Sec 6. Whenever the homestead of any debt or in ex'cuticn shall con sist of a house and lot of land, which, in the opinion of the appraisers, will ' sot bear division without manifest in jury and inconvenience, the plaintiff in execution shall receive in lieu of the - proceeds of a sale of the homestead, the amount over and above three hun dred dollars annually, of which shall be adjudged by the appraisers as a fair and reasonable rent for the same. The said rent over and above the said three hundred dollars-ahall be payable in quarterly payments, commencing threo months from the time of the hvyofthe execution, and the said rest shall be paid to the clerk or the court from which the writ was issued, for the beocfirof the plaintiff in exc cation.
