Patrick O'Brian's little boy, Michael tibout nine years old was swimming in O'Xeil's pond Wednesday morning, when stepping in a deep hole he went under, and before the boys who were with him could rescue him, he was drowned. Dr. Livingston was sent for but lie did not reach him in time to resuscitate him. This second drowning should be a warning to pa rents, to keep their small boys from going in swimming; there are too many small boys who are in the habit of going in the Missouri rjver, and as several have had very narrow escapes it is time they were kept out of the watir. This little boy was drowned in O'Xeil's pond which is a compar atively safe place for bathing and if a boy will drown there, what chance will one have in the treacherous river? C-41II A MALINHl'ttY, DENTISTS. omee over Smith. Black & Co'. Drug Store. lint class dentistry at reasonable prices, 31 y 1 he Latest About The Shooting Scrape. Last week we published what we supposed to be the facts iu relation to the Kuhlmann and Rudebeck shooting affair at the bridge. We have s'nee learned more fully the particulars of the case and in justice to all parties we give the facts as elicted at the pre liminary examination before G. E. Cole, Justice of the Peace, at Pacific Junction. Kuhlmann nd Rudebeck wero both night watchmen at the bridge. Rudebeck had at one time caught Kuhlmann asleep while on du ty and a quarrel engendering "bad blood" ensued. Kuhlmann made many threats against Rudebeck to third parties (it was proven by sundry witnesses at the preliminary examina tion that Kuhlmann threatened to teat, tie and gag Rudebeck if an op portunity to do so presented itself.) On the night of the shooting R. had gone to the eastern end of his "beat" when he was assaulted by K. who car ried a heavy blub or mallet. K. had pursued R. about 100 yds. (according to his own admissions) when R., after ordering him to stop several times, fired. Kuhlmann still continued the pursuit until R. turned on him the second time and ordered liim to stop or he would shoot him again. K. then stopped and R. came over on this side the river and gave himself up to Sher iff Hyers, not knowing whether the shot fired took effect or not. He af terwards voluntarily gave himself up to the officers of Mills Co., Iowa, with out any requisition from the Gover nor. He was charged with an assault with intent to kill. At the prelimin ary examination it was satisfactorily shown that Rudebeck was not the as saulting party; that Kuhlmann as saulted and pursued him a long dis tance on las (R's.) own beat, and that R. did not fire his pistol until it be came necessary for him to do so in self protection ; and that he was fully justified in shooting. The preliminary examination was not concluded until Monday last. R. is now at liberty not being boudover for his appearance at the next term of the District Court. He was defended by Smith & Strode of this city and Kelly Bi os, of Glen wood. Mr. Kuhlman, th man shot by Rud ebeck, called last week and requested us to state that he had been misrepre sented in our last weks report. He wishes it distinctly understood that he had a wan ant issued by Judge Sulli van, not under oath, but under affirm ation, a mode prescribed by the laws of the country to be just as binding and liable to penalties as oaths; but as the shooting wa3 done over in Iowa, Judge Sullivan had no jurisdiction over the affair and no preliminary ex amination was had before him.
