Be it Enacted by the Legislature of the
State of Ntbr.txka : ,
Section 1. TIio county board of
euch county may grunt license for the
sale of mult. tpiiituous and vinous
liquors, if deemed expedient, upon tlie
application by petition of thirty of the
resident freeholders of the town, if
tlie county is under lowiiship organiza
tion, and if uol under tovnshii orga
nization, then thirty of the resident
freeholder: of the precinct where t lie
sale of such liquors is proposed to take
place, sett ing forth that the applicant
is a man of respectable character and
standing and a. resident of this stale,
and praying that license may be issued
to him. Such app'ication to lie fiied
in the ofliee of I lie county clerk and up
on the payment into the county treas
ury of such sum as the hoard may ie-'
quire, not less than live hundred

Sec. 2. No action shall be taken n li

or if no newspaper is published in said
county, by posting written or priuled

be satisfactorily proven that the appli

violation of any of the provisions ot
this act within the space of one year,

same Compensation, as now provided
by law in the district court, to be paid
by the party calling said witnesses-.
The testimony on said hearing shall
be reduced to writing an 1 tiled in the
ortice of application, and if any party,
feels himself aggtieved by the decision
in said case he may appeal therefrom
to the district court and said testimo
ny shiili be transmitted lo said district
court and such appeal shall be decided
by thejudge of such court upon said
evidence alone.
Sec. i. That license shall state the
time fur which it is granted, which
shall not exceed one year, -the place
w here the liquor is to be sold, and
shall not be transferable; and any li
cense granted under this chapter .may
be revoked by ih" authority issuing

Sec. C. No person shall bo licensed
to sell malt, spirituous or vinous
liquora by any councy board, or the
authorities of anv city or vilage, un
less he shall first give bond in tlie pen
al sum of live thousand (Sj,000j dol
lars, payable to the state of Nebraska,
with at least two good and sufficient
sureties, freeholders of the county in
which the .license is to be granted to
be approved by the board who may he
authorized to issue tha license, condi
tioned that he will nwl violate
any of the provision- of this act.

Sec, 10. Every person so licensed
who shall sell any intoxicating liquor

SEC. 11. All persons who shall sell
or give away, upon any pretext, nult,

intoxicating drinks, without having

Sec. 12. The magistrate before
whom any complaints is made of a
violation of the provisions of the pen
ding section, shall issue a warrant for
the arrest of the offender, and if upon
an examination the magistrate shall
have reason to believe ihe party guil
ty, ho shall recognize him to appear at
the next term of the district court as
in case of felur.y.
Sec. i:. Every person so licensed, or
any person, who shall intentionally or
otherwise, sell or give away, or direct
or permit any per-ou or persons in his
employ to sell or give away any malt,
spirituous or vinous liquors, which
shall be adulterated with strychnine,
st rout i.i. sugar of lead, or any other
substance, shall forfeit and pay the
sum of one hundred dollars for every
such offense. An analysis made by a
practical ehem st sh.ill bo deemed com
petent testimony under the provisions
of this section.
Sec. 14. Every person who shall sell
or give away any malt, spirituous and
vinous liquors on the day of any geu
eral or special election, or at any time
iuriug the first day of the week, com
monly called Sunday, shall forfeit and
pay lor every sinm oltense, the sue ot
one bundled dollars.
SEC. 15. The person so licensed shall
pay all damages that the community
or individuals may sustain in conse
quence of such trallicjie shall support
all paupers, widows and orphans, and
the expenses of all civil and criminal
prosecutions growing out of, or justly
attributed to, his traffic in intoxicating
dtinks; said damages and expenses to
bo recovered in any court of competent
jurisdiction by any civil action on the
bond named and required in section C
of this act, a copy of which properly
authenticated shall be taken in
evidence in any court of justice in this
atte; and it shall be the duty of the
proper clerk to deliver, on demand
such copy to it: y person who may claim
to be injured by such traffic
EC. 10. It shall be lawful for any
married woman, or any oilier person
at tier leuuest, to institute and main
tain in her own name, a suit on any such
bond lot all damages sustained by Her
self and children on account of such
traffic, and the money when' collected

S' C. IT. When any poison shall be
come a county or city charge by ieason
of intemperance, a suit may be insti
tuted bv the proper authorities, on the
bond of any person licensed under this
act, who may have been in the habit
of selling or .giving intoxicating liq
uors lo the person so becoming a
charge: Prodded, That the person
against whom a judgment may bis ren
deied under tlie provisions hereof, may
recover by. a similar action a. propor
tionate pari of said judgment from
any and all persons engaged in said
tlilic, who have sold or given liquor to
such person becoming a public charge,
or to any person committing an
offense.
sec IS. On the trial of any suit un
der the. provision hereof, the cause or
foundation of which shall be the acts
done or injuries indicted by a peis.m
under the lollueuce of liquor, it snail
only I e necessary to sustain tte action
lo prove lhat the defendant or defen
dants, sold or gave liquor to the person
so inioxicatedor under the influence of
liquor, whoso acts or injuries are com
plained ot on lhat day or about that
time hen said acts w ere comtnitted
or said injuries received; and in an
aclioi. for damages brought by a marri
ed woman, or other person whose sup
port leg. illy devolves upon a person
disqualified by intemperance from earn
ing the same, it shall only bo necessary
to prove lhat tho defendant has given
or sold intoxicating chinks to such
person during the period of such dis
qualification. Sec. l'J. All suiis for damages and
expenses arising under this act may
be commenced and prosecuted before a
jualiui of ihe peace, where the damages
claimed do not exceed tl.e jurisdic
tion of said justice, althongh the pen
alty in the bond may exceed that
amount, and the. judgment shall be
for the damages pioved.
Sec. 23. All lines and penalties so re
coveied under the provisions of this
act shall, when collected, be paid into
the proper treasury for the use of the
school land, and the corporate author
ities by whom such license was issued
shall pay to the complaining witness
in such action, out of the, general fund
of the county or city, an amount equal
to one fourth of the sum actually col
lected and paid over to thy school fund
as aforesaid. .
Sec. 21. I ho oouuiy board, under the

SEC 125. The corporate authorities
of cities and villages shall have power
to license, regulate and prohibit the
selling or giving away of any intoxi
cating, malt. fcii i'ous and vinous, mix
ed or fermented liquors within the
limits of such city or village, tho li

cipal year in which it shall be granted,
and to determine the amount to be
