Mlll, fc r an election for Representative in Congress, or prior to any election at which a Representative in Congress is to be voted for, shall make known, in writing, to the judge of the circuit court of the United'States for the dis trict wherein such county or parish is situate, their desire to have said reg istration or election both guarded and scrutinized, it shall be the duty of the said judge of the circuit court, with in not less than ten days prior to said registration or electj6n, a.3 the case may be, to open. the said court at the most convenient poinl:in said district; flinLthesaid court, when so opened by said judge, shall proceed to appoint and commission, from day to day, and from time to time, and uncier uie hand of the said judge, and under the seal of said court, for such election dis trict or voting precinct in said con gressional district, as shall in the manner herein prescribed, have been applied for, and to revoke, change, or renew said appointment from time to time, two citizens, residents oi said election district or voting precinct in said county or parish, who shalj be of different political parties, and able to read and write the English language, and who shall.be known aniT designa ted as supervisors" of election ; and the said court, when opened by the said iudge as required herein, shall, there from and thereafter and up to and in cluding the day following the day of election, be always open for the trans action of business under this act j and- the powers and jurisdiction granted and conferred shall be exercised, as well in vacation as in term time; and a judge, sittingat chambers, shall have the same powers and jurisdiction, in cluding the power of keeping order and of punishing any contempt of his authority, as when sitting in court: Provided, That no compensation shall be allowed to the supervisors herein authorized to be appointed, except those appointed in cities or towns of twenty thousand or moreinhabitants. And no person shall he appointed un der this act gs supervisor of election who is not at the time of his appoint ment a qualified voter of the county, parish, election-district, or voting precinct for which he is appointed. And no person shall be appointed denutv marshal under theact of which this is amendatory, who is not a qual ified voter at th? time of his appoint ment, in the county, parish, district, or precinct in which his duties are to be performed. And section thirteen of this act of which this is an amend ment shall be construed to authorize and require the circuit courts of the United States in said section men tioned to name and appoint, as soon as may b'o after the passage of this act, the commissioners provided for in said section, in all cases in which such appointments have not already been made in conformity therewith. And the third section of the act to which this is an amendment shnll be taken j and construed to authorise each of the judges of the circuit courts of the United States to designate one or more of the judges of the district courts within his circuit to discharge the du ties arising under this act or the act to which this is an amendment. And the words "any person" in section four of the act of May thirty-first, eighteen hundred and seventy, shall be held to include any officer or other person having powers or duties of an official character under this act or the act to which this is an amendment: Provided. That nothing in this section shall be s-o construed as to authorize the appointment of any marshals or deputy tnarslials in addition to those heretofore authorized by law:' And provided further, That the supervis ors herein provided for shall have no power or authority to make arrests or to perform other duties than to be in the immediate presence of the officers holding the election, and to witness all their proceedings, including the counting of the votes and the making of a return thereof. An so much of of said sum herein annronriatpd as may be necessary for said supplemen tal and amendatory provisions is here by appropriated from and after the pasao or this act. For the support and maintenance of convicts transferred from the District of Columbia, ten thousand dollars. For the compensation of special counsel and other legal services, and for incidental expenses in taking testi mony, fees of witnesses and of com missioners in relation to claims before the mixed American and Rrit.sh claims commissioner, twenty-five thousand dollars. For defraying the expenses of de fending claims under the convention with Mexico of fourth July, eighteen hundred and sixty-eight, to be expen ded under the direction of tho Attor ney General, ten, thousand dollars. For payment of the nece9sar ex penses incurred in defending suits against the Secretary of the Treasury, or his agents, for tho seizure of cap tured or abandoned property ; and for the examination of witnesses in claims against the United State pend ing in any Department; and for the defence of the United States in the Court of Claims, to be expended un der the direction of the Attorney Gen eral, thirty thousand dollars, no part of which shall be paid to attorneys or counsellors at law for professional ser vices, for appearing and assisting in the trial of causes, in the Suprc-nYe, ci rcuit, or district courts of the United States, or Court of Claims ; and that the Attorney General make report to Congress at the end of the fiscal year of the manner of the expenditure of this fund, and to whom nud for what purpose paid. For this sum, or as much thereof as may be necessary, to bo expended un der the direction of the Attorney General in the detection and prosecu tion of crimes against the United Stales, fifty thousand dollars. For expenses to be incurred in the prosecution and collections of clajms due the UniUd States, to be disbursed under the direction of the Attorney General, twenty-five thousand dol lars. To enable tho Secretary of the In terior to pay only the reasonable ex penses heretofore incurred for piling road-way nnd curbing and paving sidewalks in front of the property of the United States in the District of Columbia, one hundred and ninety two thousand six hundred and twen ty dollars, or so much thereof as may be necessary ; and all railroads are hereby prohibited on the I street and, K street fronts of Farragut, Scott, and Franklin squares ; and no further street railroads shall be laid down in the city of Washington without the consent of Congress.
