AN ACT to further the atlmliilsirtiou -of jus
tice. Be it enacted- by the Sencuc and House of
Representatives of the UnitcdJStutesof America
in Congress asscrxblcd, Xliat whenever, m
anvfcultorproceotimji In a. circuit court of
the United bUites, being iiehi by a justice ot
tlie Supreme Court anil tin-circuit juui;e or
a district judge, or by the circuit jude and a
distnct judge, there shall occur any diiler
enceof opinion between tliejudesas toany
matter or thing to be decided, mled. or or
dered by the court, the opinion of the pre
Mdinsjubllcc or the presiding judge Miall
prevail, and be con&idrred the opinion of the
court for the time being: but when a final
judgment, decree or order in such suit or
proceeding shall be entered, if bald judges
shall certny, as it shall be their duty to do it
such be the fact, that they dlHercd in opin
ion as to any quotums which, under tne act
of Congreas'ot April twenty-ninth, elghtt-cn
hundred and two, might have been review
ed b the supreme Court on certificate of
tlllleiciice of opinion, then either party may
remove said final judgment, decree, or order
to the Supreme Court, on writ of error or ap
nea I. according to the nature of the case, and
subject to the provisions of law applicable
U other writs of error or appeals in regard
to bail and siipcr-wlesis.
Sec . That no judgment, decree, or order
of a circuit or district couit of the United
Slates. in any civil action at law or in equi
ty, rendered siller this act shall take ellect.
Bhall be reviewed by the Supreme Court ot
the United States, on writ of error orappeal,
unless tin- writ of error be sued out, or tin
appeil be taken, within two years after the
entry of such judgment, decree, or order;
and no judgment, decree or order of a dis
trict court, rendered after this act shall take
jlfect shall he reviewed by a circuit court of
the United Suites upon like process or ap
peal, unless the pioces be sued out, or the
appeal be taken, within one year after the
entry of the judgment, d rree, or older
souglit to be reviewed: J'roitdcd, That wheie
a party entitled to pioseeute a writ ot error
or to take an appeal is an infant, or noil
compos inentN, or imprisoned, such writ oi
error may be prosecuted, or such appeal may
be taken, within the periods above designa
ted after the entry of the judgment, decree,
ar order, exclusive of the term of such disa

Si:c -I. That a bill of exceptions hereafter
allowed in any cause shall be deemed siilll
eiently authenticated it signed by the judge
ot the court in which thecau-e was tried, or
by the pre-.idingjudgc thereof, it more than
one judge sat 0:1 the trial of the cause, itii
out any seal of court orjudge being annex
ed then to; and all process issued lrom the
courts ol the United Stales shall bear teste
lrom the day oi such. issue.
Sc 3. That the practice, pleadings and
forms and modes ot ptoieeding in otticr
than equity and admiralty causes in the cir
cuit and district com tsot ttie United Slates
shall conform, as near as may be, to the
practice, pleadings, and tonus and modes ot
procecling existing at the time 111 like caus
es in the courts of record of the State within
which such circuit or district courtsare hi Id,
any rule of court to the contrary notwith
standing: Provided, hot. ever. That nothing
herein contained shall alter the rules of evi
dence under the laws ol the Uxited States,
and as practiced In the courts thereof.
Six-. 0". That in common-law causes in the
circuit and district courts of the United
totaies llio plaintift shall be entitled to sim
ilar remedies, by attachment or other pio
cess against the propel ty of the delendant,
which are now provided for by the laws ol
the State 111 which such court is held, appli
cable to the courts of such state; and such
circuit or district courts may, fiom time to
time, by general rules, adopt such Statelaws
as may be in force in the Suite in relation to
attach men u and other process; and the par
ty lecovcilugjudgment 111 such cause shall
00 entitled to similar remedies upon the
same, by execution or otherwise, 10 reach
the property of the iudsiment debtor, as :no
now provided by the laws ol the State with
in which said circuit or district couits shall
be held in like causes, or which shall be
adopted by rules as aforesaid: Provided,
That similar preliminary atlldavits or proofs
and similar security as required by such
laws, shall be lirst furnished by the party
seeking such attachment or ottier remedy.
Sue, 7. That whenever notice is given of a
motion for an injunction out of a circuit or
district court of the United. States, the couit
or judge thereof may, if there appear to be
danger of irreparable injury lrom delay,
grant an order restraining the act sought to
be enjoined until the decision upon the mo
tion. Such order may be granted with or
without security, in the discretion of the
court orjudge : 1'rovidcd, That no justice ot
the Supreme Couit shall hear or allow any
application for an Injunction or restraining
order, except within llnciicuit 10 which he
is allotted, and in causes pending in the cir
cuit to wnlch he is allotted, or la such caus
es at such place outside of the cncnit as the
parties may 111 writing stipulate, except in
causes wheie such application cannot be
heard by tiie circuit judge ot the circuit, or
the district judge ot the district.
Sue. &. Tuat no Indictment found and pre
sented by a grand jujy 111 any district or cir
cuit or othei couttoi the United Slates shall
be deemed iiisiiliicicnt, nor shall the trial,
judgment, or other proceeding thereon be
allectedby reason ot any delect or Impel lec
tion in matter ol form only, which shall not
lend to ttie prejudice of the delendant.
Skc. 1). That in all criminal causes the de
fendant may be louud guilty ol any offense
the comni sslon ot which is necessauly in
cluded in that with which lie is charged in
the indictment, or may be found guilty of an
attempt to commit the oHense so chaiged:
Provided, That such attempt be ltbelt a sep
arate ollensc.
Sue. 10. That on an indictment against
several. If the jury caunotagiee upon a ver
dict as to all, they may render a vcidlctas to
those in regard to w I10111 they do agree, on
which a judgment shall be enteied accoid
Ingly ; mid the cuuse as to other defendants
may be tried by another jury.
Sue. 11. That any paity or person desiring
to have any J udgmen t , decree, or order ot any
district 01 cacuit court leviewed on writ ot
error or appeal, and to stay proceedings
thereon during the pendency of such wilt ol
error or appeal, may give the secuuty le

Sue. 1 That in all criminal or penal caus
es 111 which judgment or sentence has been
or shall be rendered, imposing the payment
ot a line or penally, whethei alone or with
any other kind ol punishment, the said
Judgment, so far as ttie fine or penalty is
concerned, may be enforced by execution
against the property ot the defendant In like
manner as judgments in enil cases are en

States, to enforce any legal or equitable lien

one or more ot the defendants therein shall
not be an inhabitant of ur louud within the
said disti let. or shall not voluntarily appear
thereto, it suall be lawful for the couit to
make an order dnecliug .-ueli absent defend
ent to appear, plead, ansvi or demur to the

in to be designated, which order shall be
served 011 such absent defendant, if piactl
cable. wherever lound, or wheie such per

Sue. 11. That when a poor convict, senten
ced by any court ot the United States to be
imprisoned and pay a lino, or line and cost
or to pay a line, or line and cost, has open
confined In prison thirty days, solely for the
non-payment of such line, or tine and cost
such convict may make application in writ
ing to any commissioner of the United stales
court in the district where he is imprisoned
