consequence of a subsequent appropriation
made by law; and a detailed statement of all
such 'proceods of sales shall bo included In
the appendix to tbebook of estimates. But
this section shall not be held to repeal tho
existing authority or law In relation to ma
rine hospitals, revenue cutters, the clothing
fund of the navv. or the sale of commissary
stores, to the olllcers of the army. And it
shall bo the duty of the Register of the Trea
sury to furnish to the proper officers copies
o' all warrants covering such proceeds.whero
tho sumo may be necessary in the settlement
of accounts In their respective offices.
Sec. 6. That the public grounds surround
ing the Capitol shall bo enlarged (according
to the plan approved by the Committees on
Public Buildings of the Senate and House of
Representatives, respectively, which plan is
hereby directed to be deposited in the-custody
of the Secretary ot the Interior) by exten
sion between First street east and First
street west, in the following manner; north
wardly to thoouth side of North B street.
Including In addition to so much of tho re
servations, avenues, and streets u are neces
sary for such extension, the two squares de
signated on the plan of the city of washing
ton as numbers six hundred and eighty sev
en and six hundred and eighty-eight, respec
tHely. Sec. 7. That it shall be the duty of tho Sec
retary of the Interior to purchase, from the
owner or owners thereof, at such price, not
exceeding Its actual cash value, as may be
mutually agreed on between the Secretary
and such owner or owneis, and not exceed
ing the appraisal made by the commission of
nlno in their report to Robert Ouid, United
States (district attorney for the Dlr'-t of
Columbia, on tho twenty-first day of Janua
ry, .eighteen hundred and sixty-one, snch
private property as may ;be necessary for
carrying this act Into eflect, the vnlue of tho
property so purchased to bo paid to the own
er or owners thereof, out of any money in
the treasury not otherwise appropriated, on
tho requisition of said Secretary : Provided,
That before such payment shall be made, the
owner or owners of the property purchased
shall, by good and sufficient deed or deeds. In
due form of law, and approved by the Attor
ney General of the United States, fully re
lease and convey to the Uulted States all
their and each of thelrseveral nnd respective
rights In said titles to such lands and prop
erty co. purchased.
Sec. 8 That if the Secretary of the Interior
shall not be able to agree with the owner or
owners of any private property needed Tor
the purposes of this act upon the pr'.fe to be
paid therefor, or If for any othc cause he
shall be unable to obtain tho title to nny such
property by mutual agreement with the own
er or owners thereof, it shall bo his duty to
make application to thesupremec'irtof the
District of Columbia, which court Is hereby
authorized and required, upon such applica
tion. In such mode, and under such rules and
regulations as It may adopt, to make a just
and equitable appralsementof tho cash val
ue of the several interests of each and every
owner of tho real estate and Improvements
thereon necessary to be taken for the public
use in accordance with the provisions of this
act. and to which theSecretary has been un
able to obtain the tltlo by mutual agreement
with the owner or owners thereof.
Sec. 1. That the fee simple of nil premises
so appropriated for public use, of which an
appraisement shall have been made uuder
the order and direction of said court, shall,
upon payment to theowner or owners, res
pectively, of the appraised value, or incase
tho said owner or owners refuse or neglect
for fifteen a.., after the nnpraisementof the
cash value of said lands and improvements
by said court to demand the same from the
Secretary of the InU.ior, upon depositing
the said appraised value in tho said court to
the credit of such owner or owners, respect
ively, be vested In tho United States. And
thoSecrotary of tho Interior Is hereby author
ized and required to pay to the several own
er or owners, respectively, the appraised val
ue of the several premises as specified In the
appraisement of said court, or pay Into court
by deposit, as hereinbefore provided, the
said appraised values; and the sum necessa
ry, not exceeding four hundred thousand
dollars, for such purposo is hereby appropri
ated out of any moneys in the treasury not
otherwise appropriated: Provided, That tho
Secretary of the Interior Is hereby author
ized to sell at publlo auction such materials
In the buildings In squares numbers six
hundred and eighty-seven and six hundred
and eighty-eight as nro not necessary for the
public works in thlsDIotrict; and further,
that the moneys realized by such sales shall
beapplled'to the improvement and exten
sion of tho Capitol grounds.
Sec. 10. That said court may direct tho
tlmoand manner in which possession of tho
property conuemnea snail ue taken or deliv
ered, and may. If necessary, fenforce any or
der or Issue any process forgiving possession
Tho cost occasioned by the Inquiry nnd as
sessment shall bepnld by tho United States,
and, as to other costs which may arlso. they
shall be charged or taxed as the court may
direct.
Sec. 11. That no delay in making an as
sessment of compensation, or iu taking pos
session, shall be occaslonod by any doubt
which may arise as to tho ownership of the
properly, or any part thereof, or as to the
interests of tho respective owners, but in
such cases tho court shall rcqulreadeposltof
tho money allowed as compensation for tho
wohle property or tho part In dispnte. In all
cases, as soon as the United States shall have
paid the compensation assessed, or secured
its payment, by a deposit of money, under
the order of the court, possession of tho pro
perty may bo takn.
Sec. li That tho Washington and George
town Railroad Company and the Metropoli
tan Railroad Company be.nnd theyare here
by, required to remove their tracks, respect
ively, from the Capitol grounds, ns hereby
established, and to run the same as they may
be directed, from time to time, by tho officer
in chargeof the public buildings and grounds
as tho grading and filling up of said grounds
may render necessary. Thut a commission
consisting of tho Secretarv of the Interior
the Chief Engineer of the Armv. and the of
ficer In charge of public buildings nnd
grounds. Is heroby xsathorlzed ard directed
to examine- and reps:! t " s, prior to
the-secoud Monday of December next, a plan
by which the locomotive railroad track in
front of the western entrance of the Capitol
shall be removed, with due regard to the
rights ofall parties concerned, nnd by which
proper connections with othsr mi' roads may
be made.
Sec.- 13. That from aruisAer the first day of
July, eighteen hundred and, seventy-two the
annual salaries of the Second Comptroller of
the Register, and of tho Supervising Archi
tect of tfc Treasury Departnxwt. shall be
four thousand dollars each j and tho ancual
salary of the Judges ol the Cort of Claims
shall be four thousand rive hundred dollars
each, mid a sufficient wtim to carrvlnto effect
the provisions of this section to.' the end of
