Be it enacted ly the Legisla ture of the State of Nebraska, That each orgaDvzed county shall be divided by the Couuty Superintendent into as many school districts may from time to time be'f oiind necessary; but no grirar Jip trict shall contain more than sixteen sections of land. Sec. 2 Every duly organized school district shall be a body corporate, and possess all usual powers of n, -corporation! for public purposes, by the name and' style of kSchool District number , count 7," and in that parse may sue and be sued, purchase, hold and sell such personal and real estate as the law allows. Sec. 3. VVhen&ver the County Su- penntendent ot any county snail torm a new district therein, it shall be the duty of the said superintendent to deliver to a taxable mnabitant ot sucn district a no tice in writing cf the formation of - such district, describing its 'boundaries and specifying the time and place of holding the first meeting; which notice, with the fact of such delivery, sb!aijl'b.3 enter ed upon the record by the superinten dent. Sec. 4 The aajd notice shall also di red such inhabitant to notify every qual ified voter of such district, either per sonally or iy leaving a written notice at his place of residence, of tfie time and place of holding said jcaeeiinfr' at least five days before the time appointed there for, and it shall be the duty of such in habitant to notify the qualified voters of said district accordingly. Sec. 5 The said inhabitant, when he shall have notified the qualified vo ters as required in such notice, shall en- dor&3 thereon a return showing such no tification, with the riate or dates thereof and deliver such notice and return to the .chair man of the rneeting Sec. 6. The said chairman shall de liver such notice and reture to the di rectors chosen .at such me.et,ing, as .here inafter provided, who phalr record the same at length in a book to be provided by him, at the expense of the district, as a part of the records of such district. Sec. 7 aoh and - every sub-district now existing under provision of law shall be deemed to constitute a district, and be controlled and governed as here inafter 'provided. ' ' " Sec. 8. The qualified voters of eve ry new district when assembled pursu ant to the above mentioned notice, and all existing tistricts, at their annual meeting in the year one thousand eight hundred and sixty seven, shall elect from the qualified voters of such district a moderator for three years, a director f cr two years, and a treasurer for one year ; and on the expiration of their res pective terms of office,, and regularly thereafter, their several successors shall be elected for the term of three years each. Within. ten after their elec tion, these several officers shall file with the directors a written acceptance of the offices to which they shall baavs .been respectivly elected, whicji shai be recor ded by said directors. Sec. 9 Every such school district shall be deemed duly organized when apjr,two of the officers ejected at the first meeting shall have iiled their acceptance as aforesaid. Sec. 10. In case the inhabitants of any district shall fail to. organize th same in pursuance of such notice as' aforesaid, the said county superintdent sh'ali give a new notice as hereinafter provided, and the same proceeding shall be had thereon aa if no previous notice had been deliv exed. Sec. 11. The record made by ths directors as required by the sixth section of this act, shall he prima facie evidence of the.lact therein set forth," and of the legality of all proceedings m the organi zation of the district prior to th9 first district meeting, but nothing in this sec tion contained shall be so construed as to impair the effect of tha record ,kept fby county superintendent as evidence. Sec 12. Every school district shall in all cases be presumed to have been legally organized wfcen.it sha.Il have ex ercised tthe franchises and privileges cf a district for the I terra or two j'eats. Sec. ,13. Special meetings may be called by the district board, or by any ens cf then, on the written request of any five legal voters of the district, by giving tne notice requires jn , uio nen section, and in all notices of special meet ings the object of the meeting shall be stated. , Sec. 17 , All notices of annual or special peetcngs, afler ths first meeting has been held, as aforesaid, shall specify the (lay and hour and place of meeting, and shall be given at least six days pre vious to such meeting by posting up cop ies thereof in three cf the most public fclaces.'or by publication,' or 'by publca tion in the district, and in case of any special meeting called for the purpose of establishing or changing the cite of a school house,' 'such notice 'tKall he' given at least ten day's previous thereto. Sec. 18. No 1 district rnsetirg shall be deemed illegal for want of due notice, unless it shall appear that the omission to give such notice was wilful and fraud ulent : Provided, 1 hat for all meetings to provide for the location or removal bfasite'foj: a scjiooj house, the notice required' in the last' preceding' section, shall in:all cases be given. Sec. 19. Every male inhabitant of the age of twenty one years, residing in the district, and liable to pay a school district tax therein, !sb all bs entitled to vote at any district "meeting. Sec 20. If any person ottering to vote at a school district meeting shall be challenged as unqualified by any legal voter in such district, the chairman pre siding at sncb meeting shall declare to the person challenged, the qualification of a voter, and if such person shall state that he is Qualified and the challenge shall ncl be withdrawn, the said chair man shall tend to him an oath In sub stance as follows : "You do swear (or affirm) that you are twenty-one years of age, that' you a're an actual resident cf this school district and liable to pay a school district tax therein," and every person taking such oath shall be permit ted to vote on all questions proposed at such xaeeting. Sec. 21. If any person so challenged shall refuse to .tajifi such oath, hi3 vote shall ibe rejected, and 'any person who sha'U wilfully take a false oath or make a false ararmation under the provisions of the preceding section, shall b9 deemed guilty or perjury. Sec. 22. When any question is tatten in any other manner than by ballot, 'a challenge immediately after the vote has been taken.and previous to the announce ment of the vote by the chair, shall b$ deemed to be made when offering to vote and treated in the same manner. Sec. 23. The qualified voters in such school district when lawfully assembled sB'StUihave power to adjourn" from time to time as may be necessary ; to designate a site for a school house by a vote of two thirds of those present and to change the same by a similar vote at any ' regular meeting. ' ' Sec. 24. When no site can be estab lished by such inhabitants, as aforesaid, the County Superintendent of the county in which the district is situated shall de termine where such site shall be,- and his determination shall be certified to the director of the district and shall be final, except thaTsuch decision may fce changed by theCpunty 'S'uper.intend'ent on a writ ten request of a majority of the qualified voters of the district.' Sec. 25. The said qualified voters shall also have power at any such mee ting to direct the purchasing or leasing of any appropriate site, and the building hiring or purchasing of a school house, and the amount of fuel to be furnished and the, tine and mode cf furnishing it for the succeeding .year, whether by ap portionment to persons having scholars to send to such school in weed, to be de livered at the school house or in money to bs assessed on a rate bill, or by a .tax on the property of the district, 'and to impose' such ta as rnay :be sufficient for the payment thereof, subject to the lim itation contained in the succeeding sec tion. Sec. 26. The amount of takes to be raised in any district for the purpose of purchasing or building a school houie than ppt.ezccep.the sum pi :tiree hun dred dollars ip any one year,unless there shall be more than thirty scholars re siding therein between the ages of five and twenty-one years, and the amount thereof shall net exceed four hundred dollars in any one year unless there shall more than tiny scholars .resiin.in tne district .between the ages last aforesaid; one! no sum shall be raised exceeding two hundred dollars for the purpose cf building or purchasing . a school house cf less dimensions thin sixteen , feet. by twenty-four feet aal ten feet between floors, not exceeding one hundred dol- lars for the purpose of building or pur chasing a school house constructed 0: round or hewn logs. ec. 27. The qualified voter?, when assembled at any annual or regular meeting, may from time to tima impose such tax as may ba necessary to keep their school house in repair End to pro vide the necessary appendages, and to pay and discharge any debts cr liabilities of tha district lawfully incurred ; may raise a sum not exceeding forty dollars in any oh8 year, for the purchase cf books of reference, globes, triads, di atfy apparatus for the purpose cf illustrating tlia principles of astronomy, natural phi losophy, natural history, and agricultural! Sec. 29."' They may also ' determine at each annual meeting "the length of time a school shall ba taught m their district during the" ensuing yearj which shall not be less than three months, and whether by male or female teachers, or both, and whether the moneys apportion ed for tlie support of the school therein shall. be applied "to the wjhie 'cr sum mer term, or a certain portion of each. Sec. SO. In case any of the matters of the preceding section mentioned are not determided at the annual meeting, 'the a'jiirici' bodrd shaI have jpovtar, and it shall be their duty,' to iU.te;rpi 'the same. Sec. 31. Said qualified voters may also, at any reglar meeting, authoroze and direct (he sale of any school house, site, building, or other property belong ing to the district, when the same shall no longer be needed for the use of the district. v ' ' ' ' Sec. 32. They rnay also give such directions and make such provisions as they shall deem necessary in relation to the prosecution or defense of any pro ceeding in which the district may be a party or interested. Sec. 33. The moderator shall h?.ve power, and it shall be his duty, to pre side at all meetings of tha district, to 'sign all' warrants for ' the collections of of rate bills after they shall have been prepared and signed by the 'i redo r.and to countersign all orders upon the treas urer for moneys to be disbursed by the district, and all warrants of the director upon the county treasurer for moneys raised for district purposes or appor tioned to the district by the county clerk. But if the moderator shall be ab sent froni any district meeting, the qual ified voters present taay elect a suitable person to prescribe at the meeting. Se:. 34. If at any district meeting any person shall .conduct himself in a disorderly manner, and after ictjee frcm the moderator or person presiding, shall persist therein, the moderator or per son, presiding may order him to with draw from the meeting, and on his re fusal may order any constable, or other person or persons, to take him into cus tody until the meetinshajl be adjourned Sec. 35. A'ny f person who shah re fuse to withdraw fram such meeting on being so ordered as provided in the pro ceeding section, or who shall wilfully disturb such meeting, shall for every such offence fc-tfeil a sum not exceeding twenty dollars. Sc 36. The treasurer shnll pay over all moneys in his hands kbeloning to the district' on the " warrant of the di rector, countersigned tby he moderator, and shall collect all' rata bills for tuition and fuel in obedience to the command contained in' the .warrant annexed theroto Sec. 37. In case anj pe.rscp '.ihalt re fuse or neglect to pay the amount cn such rate bill lor which he is liable, on demand, the treasurer sbail collect the same by distress and sale cf any goods chatties of such person, wherevor found, within any county in which the district, or any part of it, is situated. Sec. 39- The treasbrtjr shall give at least ten days' notice of such sale by posting up written noticesthereof inthree public places ia the precinct where the . . hi ii 1 ' property snail oe sq:a. ,Sec. 2p. At the expiration cf his warrant the treasurer shall make a ra turn thereof in writing, witH the rate bill attached, to the director, stating the amount on said rate bill collected, the amount uncollected, and tha names of the persons from whom collections have not.been paie. Within ten days next pre vious to the annual district meeting tha director shall take tha census of his dis trict and make a list in writing cf tha n-nes cf all the children beJonsic.t 'thereto between the ages cf five and twentY-ons years. ' He shall furnish a copy .of such Hst'to each teacher employed in the 'district, and require such teacher to carefully note the daily attendence 'of eac scholar and to make returns there of to him, including the ages of all schol ars whose names are not on such . list, and such teacher shall also certify and return, Recording to his best information and .belief, the name of the peroa lia ble for tha tuition of each tchclii'. ' ' 'r : Sec. '47. 'Incase tha director shall not have furnised such' list as aforesaid, the teacher shall keep a list of all tha scholars attending school, and the naca ber of days each scholar shall attend tha same, with the age of each, and ibe name of the person liable for the tuition of e.ich, according to his best informs, tion and belief, which list he shall re turn to 'the director ft3 aforesaid.' ' Sec. 43. ' Tha director shall ascertain from the return of such teacher the num ber of days for which each ptraon not exempt shall be liable to pay tuuion and the amount payable C7 each. Seci 49. ! Within twenty days after receiving such list and certificate from the teacher, the director shall maka out a rate bill, containing the name ot each person so liable and the amount dap from him for'tuition and fuel, "or either, adding thereto five cents on each dollar of th5 sum due for treasurer's fee3, and shall annex'' thereto a warrant "for tha collection thereof, to be signed 7 Ma and the moderator. Sec. 50.
