sous named in the first section of this act, togeth
er with such as may be elected according to the
form of the constitution under thisact, shall be the
first trustees of the corporation ; ail all vuancies
caused by death, resignation or otherwise, ia the
office of trustee, shall be fidei by the boand, by
ballot, without unnecessary dilay, as miy be pro
vided io the constitution aal by-la -.rs of the cor
poration. Sec. 3. And be it further enacted, That said
corporation shall hove pwar to provide a home
lor, and to sur port arid educate the destitute or
phans cf tidier or sailors who hare dial ia the
lato war in behalf cf.tho Union of these States
from whatever Stute or Territory they taty have
entered the cational aervice, cr their orphans may
apply to dnicrthe Home, and which is hepghy de
clared to be the object and purpbre of said corpora
tion ; and to such end, and for such use , tbe said
corporation may take and hold i roperty real cr
ptrsonal to an amount nocqssary for the support
and maintenance of the Hciao and the orphans par
taking of its benefiu.
Sec. 4, And be it further enacted.. Tfc,at the afr
fairs of this corporation shall be managed by a
board of directors consisting of not less than seven
teen representing tho !tstrict i t Coluinbiannd of
Columbia, and of seven each, from the respective
States and Territories, to be choseo in such manner
as the constitution and by-iaws of said corporatioa
shall direct, and that the said directors shall have
power to leak by-laws prcrcribing the duties of the
ciacers of said corporation! t&eir term of office, and
to wake all other rnlcs and regulations for said cor
poration and the management of its affairs, subject
to the prone ioni of this act.
Sec 5. And be it further enacted, That said
corporation shall have power to recejve under its
charge for support and edacatiodany minor child
of any snck soldier or sailor, if so placed ia its
charge by its surviving paaent or guardian, or, in
the absences f either, by any. person having the
care or cxistedy of such orphan; and while such
child remains under its care, and' until withdrawn
as hereinafter provided; pr discharged according to
the regulations of said corporation, it shall be sub
ject to the same power and control by said corpora
tion as any father or lawful guardian has by law
over cr relating ro such minor child.
Sec. 6. And be it further enacted, That no such
orphan child shall ver bo bound out by said corpo
ratioa. See. 7. And be it further enacted, That the
survivirg parent or lagal guardian of any child
placed under chargo of said corporatioa may at any
timO be by them withdrawn therefrom , and any
minor over sixteen years of ege, upon his or her
owo request in writing, shall ba discharged there -frcm.
Sec. 8. And be it further enacted, That any
minor child so withdrawn or discharged as provi
ded in the proceeding section of this act shall ner
ertholess coutinue until mijority under charge of
aaid corporation to such a extent as that the said
corporation shall have tha ODtrol and management
of any moneys wbich may bd due to such minor
from the government f the United States by vir
tue of the services of the fathers of such minor
childern, paying to such minor child or childern
only such amount thereof as in the judgment of
said corporation shall bo cocessary and beneficial
for such minor.
Sec. . And ba it further enacted, That the
property of said corporation, held or oooupied by
them for the uses and purposes of teeir incorpora
tion, shall bo nxempt from all taxes to be levied
under tb authority of the Congress of the United
States, or any municipal corporation within th e
District cf Columbia, and no person shall lose cr
aoquire a legal settlement by residence in the
L'cme to be established by said corporatioa.
Sec. 10. And be it further enacted, That Con-'
grjssmayat any time hereafter repeal, alter, or
amend this act.

Washington canal at its intersection with D Street
south, of such plans and dimensions as cay be ap
proved by the corporation of Washington, and so
as cot to interfere with the navigation of said canal-
And also to use steam power in the transpor
tation of passengers and freiget over Said railroad
and branches, subject, however, o such restrict
ions and regulations as may be imposed by the cor
porate authorities of the city of Washington in

sent of Congress be, and tho same is hereby, gran
ted for a period of eighteen months from the pas
sage cf this act, to the Alexandria, Washington,
and Georgetowa Railroad Company, to. use steam

damogos, or the value of any private property so

.That the Baltimore and Ohio Railroad Com pan
shall be, and they are hereby, authorised to extend
into and within the Distriot of Colombia the road
aforesaid, to such point or points, torrninns or ter
mini, as may be agreed upon between the said
company and the corporation cf Washington, in
respect of a roud within the limits of Washington',
and betwe the said company and the corporatioa
of Georgetown, as respects a road within the limits
of Georgetown. And the said Baltimore and Ohio
Railroad Company ane hereby authorised to have
and exercise the same powers, rights'' and priva
ieges,and shJI bo subject te the Same restrictions
cf the said road, into and within the sail District
as they have, may exercise, or'pos3ess, or are sub -ject
to within tbe State of Maryland, under and
by virtue of their charter or act of incorporation
from the State cf Maryland ; and shail be entitled
to the same franchises, righU, compensation, bene
fits, and immunities in the uso of the said road
as are provided in the said charter.
Sec. 2. And be it further enaated, That all the
provisions pf the several acts of Congress relating
to tha lateral road authorized to be built into and
within the District of Columbia by an act passed
51 aoch' second; eighteen hundred and thirtv-one,
and entitled "An act 10 aumorjza tne extension,
construction, and use of a lateral branch of the
Baltimore nd Ohio Road into and withia tho Dis
liict of Colombia," and the supplements thereto,
bo. and they are hereby, declared to apply to the
Baltimore and Oh lo'Railroad Company si far as
they are severally applicable to the location, con
struction, and use by the said eompany of the road
now authorized to be constructed into and withia
the 6aid District.
Sec. 3. And be it further enacted, That the
said railroad company shall commence the conr
structton of said extension ef said road within one
year, and complete the same within three years af
ter the passage of this act ; and on failure to co
so, tbe privileges granted by this act shall be for
feited by said company.

Kansas, or near said military reservation, thence down
the valley of the Neosho to the southern lino of the
Stato of Kansas, with a view to an extension of the
same throngh a portion of the ludiaa Territory to fort
Smith , Arkansas, there Is granted to the State ot Kan
sas for the use and benefit of said railroad company
every alternate section of land or part thereof de ig
nated by odd numbers, to tbe extent of five alternate
section per mile on each side of said road and not ex
ceeding in al ten sections per mile ; tut In case it
shall appear that thcUnitod States have when the

of one hundred feet in width on each side of said road
