act, it shall be iHSvfut for the levy court of Wash
ingtoa county, ia the District of Columbia, to altar,
repair, widen, aud regulate the public, wads and
highwaysin sail county, and to layout additional
roads as hereinafter Secified.
Sec. 2. Ami be H jurtler enacted, That all roads
within saidcounry of Washington which have been
used for a period of twentv- five years or more ja.i a
highway, and have been i.ognizel as such by the
lcy court as public -cob sty rouds, aud for iho re
pairs of which the eaid levy eourt has appropriated
and expended money, are declared public highways,
or any one of them, without autuori'y from said levy
co.urt,shall be subject to a fine for each and every
otfeuee of not less than one hundred or more tbun
two hundred and fifty dollars, to be imprisoned till
the said fine ai.d the costs of suit and collection of
the same arc pa id said line in be collected in the
name of tho L 'cited States for tho use of the levy
cour'-
Sec- 3. And It it further enacted. That within
one year from the passage of this act the levy court
shall cause the surveyor of the said county of Wash
ington coAinfy to survey and plat all such iaals as
are named iu the last preceeding eecoioii,and hive
the same recorded among eke records f aid county
now used ror recording surveys an J plats of other
public county roads ; and, ia making said survey,
the county surveyor shall follow, as nearly as possi
ble, the lines and boundaries heretofore Used and
knowu as a highway, and he 6hall cause the lines
end boundaiies of she same to bo permanently
marked and fixed by the -erection of stones or posts
at the different aDgles thereof.
Sec. 4. And be it further enacted, That all
such roads as are named in the second section of this
act as have beeu obstrusted by any person or persons
In any manner within the last six ytars shall be re
opened by the levy court, if, in the judgement of
sa id court, rhe public convenience requires it ; and
the oxpentes thereby incurred shall be paid by the
person or persons who shall havoobsructcd the same
which expenses shall bo coliettod as fine are requir
ed to be collected under the second section ot this
act..
Sec. 5. Audit it further enacted, That hereafter,
in laying out new roads in said county of Washing
ton, the levy court sball cause such roads to be of a
width of not less than fifty no more than one hun
dred f oot, ajid it may also cause the width of auy of
tho existing roJtUs in sa;d couuty to le increased to
r.ot niv re tLan one hundred feet, and change tho lo
cation of any cf them, as the said levy court may
deem best for the public interest ; and, for tho pur
Ieio of opcuing or widening sueh roads, the said

demned any land or lands teessary for the jaine, ai
other lands arc now condemned by law.
