An Act Providing for the J2eicr Regula tion of Schools in Nebraska. ; APPOIITTMEJTT OF SCHOOL ExAlJINEKS AXD Sec 41. 'It 'shall be the duty of the Probate Judge In the several counties of this Territory, as soon after the electioa of school officers under" the provisions of this act as practicable, to appoint a coun ty board of - school examiners, to consist of three competent persons resident in the county, who shall hold their oce for ths term of two years and until their succes sors are' appointed, and all Vacancies in he said board which- may hereafter oc cur, whether from expiration of the term of office, refusal or otherwise, shall be filled by like appointment by said Jude. bee. It shall- be the duty of the examiners to fix upon the time of holding meetings for the examination of teachers in such-places in their respeciive'eounties as will in their opinion,' best accommodate the greatest number of . candidates for ex amination; notice of all such meetings having been published in some newspaper of general circulation in. their respective counties, zmd at such meetings any two of said board shall be competent to ex amine applicants, and grant certificates', but no fe3 or charge shall 'be made for a certificate. No certificate ; of Qualifica tion shall be valid Sh : any county, except that in which the examination took place nor for a longer period than two years ; and if at any time the. recipient of the certificate shall be found incompetent or negligent, the examiners or any two of them, may revoke the same, and require such teacher to be dismissed ; but such teacher shall be entitled to receive pay ment for his services only up to the tune of such dismissal; and no -person shall be employed as a teacher in any prima ry or common school, unless such person shall have first obtained from said exam iners, or any two of them," a certificate of good moral character, and that she or he is qualified to teach orthography, read ing, writing, arithmetic, geography and Lnglish grammar ; and in case such per son intends to teach in any common school of higher grade, he or she shall first ob tain a certificate of the requisite qualifi cations in addition to the branches afore said, j '. : ',-": Y Sec 43. The said board of examiners shall appoint one of .their number to serve as clerk, who shall keep a record of their proceedings noting the .number and date of each.. certificate given,' to whom, and for what, term of office, and for what branch of studies ; and. the said board may make all needful rules and "regulations for the proper discharge of their duties The members of the board shall be enti tled to receive one dollar . and fifty cents each for every day necessarily engaged in official service to be paid out of the county treasuryjon 'the order of . the coun ty clerk, and the county clerk may re quire the accounts when presented to be substantiated on oath, which said clerk may administer and file ih his office. TERRITORIAL COMMISSIONER. Sec 44. There shall be elected by the qualified voters'of this Territory, at the next annual election tor -1 erriton il and county officers.and every two years there after, a Territorial commissioner of com mon schools, who shall hold his office for the term for two years, and until his suc cessor is elected and qualified. The election of said commissioner and there- turns thereof , shall be the same in all re spects, as is provided for the election 'of other territorial officers ; and in case a a vacancy . shall happen in said, office by death, resignation, or otherwise, the Gov ernor shall fill the same by". -appointment for the unexpired term. ' . ' Sec. 45. Before entering on the charge of his official duties, the said commission er shall give, bond, in the penal sum of ten thousand dollars to the territory of Nebraska, with two or more sureties to the acceptance of the secretary, of the Territory, conditioned that he will truly account for and apply all moneys or other property which may come into hi3 hands in his official capacity, for the use ind benefit of common schools, and that he will faithfully perform the duties enjoin ed upon him, according to law ; and he shall also take, and subscribe an oath or affirmation to support the Constitution of the United Slates and the Organic Law of this TerntorVj and .dilligently and faithfully to discharge the duties of his office as prescribed by law, which bond, with the certificate of his oath endorsed thereon, shall be filed with the treasurer of the Territory. ; Sec. 46. The books and papers cf his department shall be kept at the seat of government, where . a suitable office shall be furnished by the Territory, at which he shall give attendance, when' not ab sent on public business; and the Ternto rial Librarian shall in addition to the du ties of his office, "discharge, the duties of Secretary (o the 'commissioner of com mon schools, under his direction. Sec. 47. It shall be the) duty. of . the commissioner to spend annually, on -tin average at least twenty days m eacn Ju dicial District of the -Territory sopenn- tendinnr and encourarrinlr teachers insti tutes, conferring with .the- township board of education or other school omcers, coan cilin? teachers, visiting schools, deliver in' lectures on topics calculated to sub serve ; the interests of popular educa tion. .1 .:.!- vl ' ; - , : Sec. 4S. As soon as the revenue, to be raised as hereinafter provided, for the - - m m t -1 purpose or iurnisnmsi : me common schoch with libraries and apparatus, will admit;it shall be .the duty of the s : 1 commissioners, to purcha: the sans.rnJ the books and apparatus so purchased, shall be distributed .-thrcjgh ihe.clerk's office of each county to the board of edu cation in each township, city, or incorpo rated village according to the, numera tion of scholars."- ; - Sec. 49. He shall also exercise such provision over the 'educational funds of the Territory as may be necessary to se cure their safety,, and right "application, and distribution accor ngr to lav.; He 1 have power to require of cojuty clerks, township beards of education, or other local school officers, the clerks and treasurers of townships, county treasur ers and clerks, recorders and . treasurers of cities and villages, copies of all re ports' by them required to be made, and all such other information inrelation to the fund and condition of schools, and the management thereof as he may deem im portant. ' " , ' . ' , Sec. 50. He shall prescribe suitable forms and: regulations for .making-all reports, and conducting all necessary pro ceedings under this act, and ; hall cause the same, with such 'instructions as he shall deem necessary and propel4 for the organization and government of schools to be transmitted to the local school offi cers, who shall be governed in accor dance therewith. 1 : ' -- Sec. 51. die shall cause as rfuiny cop ies of the laws relating to-' schools and teachers' institutes with' an appendix of appropriate i forms and ' instructions for carrying into execution all such law s, to be printed in a separate'volume and dis tributed in each county with' the laws, iournala ana other: documents for the use of the school officers therein as often af ter the first distribution as any change in said law may be made of sufficient impor tance in tne - opinion oi me commissioner to require a republication and distribution thereof. . Sec. 52. It shall be the duty of said commissioner of common schools to' make an annual report in each and every year to the General Assembly who shall cause the same to be published. , . Sec. 53. The Territorial Commission er in,lhe annual report of his labors and observations, shall preseLt a statement of the conditiori and amount of all funds and property appropriated to .the purposes cf education; a statement of the number or common schools in the - Territory, the number of scholars attending such school, their 'sex, and the branches taught ; a statement of the number of teachers in stitutes, and .of the number of teachers attending them, a statement of the esti rhates and" accounts of the public school fund of every description a statement of plans for the management and improve ment of common schools, and such other information relative to the. .educational interests of the territory as he may think of importance. The said commissioner shall be entitled to receive for his services the sum of one thousand dollars annually pay able quarterly : out;- of the r Territorial Treasury, on the warrants of the Territo rial Auditor.' For the purpose of furnishing school libraries" arid apparatus to all the common schools in the Territory, and for the further purpose of sustaining and in creasing such libraries and keeping up a supply of school apparatus in the schools as aforesaid, from time to time, as may be considered necessary, in order to afford equal facilities to the said schools" in' this respect, as nearly as applicable there shall hereafter be assessed, collected and paid annually in the same manner as the ter-; ntonal and county revenues are assessed, collected and paid on the grand list of property taxable for territorial purposes, a territorial tax of one tenth of one mill on the dollar valuation,' "to be Applied ex clusively for , the purposes aforesaid, and tne attendant- expenses under tne direc tion of the commissioner or common schools. In purchasing libraries for the common schools no books of a sectional or denominational character shall be pur chased for said library. . Sec. 56. The amount of said tax when collected, shall be paid over by thecoun ty treasurer to the territorial treasurer, at the time of making their annual set tlement, and shall be paid out by that of hcer, . for, the purpose aloresaia upon the warrant of the Territorial Auditor Sec. 57. It shall be the duty cf .the county clerk: when the said libraries or apparatus shall be received; to distribute the same to the clerks of the township boards of education or, ether local school officers, in their respective counties, ha v injr charrxe' of the interests cf common schools ; and the books and apparatus, So furnished shall be- deemed the property of said several boards, or local school of ficers, to whem the same may have been delivered, and shall not be subject' to exe-t ecution, sale or alienation for any cause whatever. . : ' : 1 Sec. 53. . TERRITORIAL SCHOOL ICTTES. Sec. 60. For the purposa cf affording the advantage of a free education to all the youth of this Territory, the Territo rial common school fund shall hereinafter consist of such sum, a3 will be produced by the annual levy and assessment cf two milh upon the 'dollar valuation on the grand list-of the taxable property of the lerntory, and there is hereby levied and assessed annually in addition to the reve nue required for general purposes, the said two mills on the dollar valuation as aforesaid, and the amount so levied and assessed shall be collected iri the same manner . as other Territorial taxes, and when collected, shall be annually distrib uted to the several organized counties of the territory, in proportion to.theennu meration cf scholars and be applied ex clusively to the support cf the common schools. . .' ' Sec. 61. All fines - assessed for the breach of the penal- laws of the Territo ry and all forfeitures which may ac crue, all lands and other estates which shall escheat to the Territory for the want of heirs or kindred entitled to the inher itance, all lands which have been or may hereafter be 1 granted to the Territory when no special purpose is expressed in Lthe grant, and all unclaimed fees,, as pro vided by law, shall be denominated school funds, the income of which, together with the taxes mentioned and specified in this act, shall be applied to the support of common schools. MISCrLLANEOUS PR0VISI05S. Sec. 62. The debts which have been heretofore contracted by any school dis trict for school - purposes, shall be provi ded for by the estimates of the. proper school boards created under the provis ions or mis act. . oec. oj. ine process, in ail suits against any township board of education or other local officer having charge of any of the public schools, under the provision of this act, shall be by summons, and shall be executed by leaving a copy thereof with the clerk or secretary of such board or other school officer, .at least ten days before the return day thereof. And any suit, either in favor of or against any such board or other school officers, shall be prosecuted or defended, as - the case may be, by the District Attorney of the proper district, as a part of his official duties. Sec. '64. The local board of education. or other local officers having charge of schooliin any city, township or village in. which common schools have been or ganized under the act for the better reg ulation of public schools in cities, towns. Sec.; or under any special act shall be and are hereby authorized, whenever they may deem it expedient to call a meeting of the qualified voters of any such city. township or villa ge,: on giving thirty days public notice thereof, to determine by vote whether the common schools of such city, township or village shall be con ducted and managed in accordance with the provisions of this act: and if a ma jority of the voters are found to be in favor of the changer then said local board cr other school officers shall there after proceed, in accordance with the pro- visions or mis act, until their successor shall" be. elected "and qualified, and, such city or village may provide by ordinance for the election or appointment cf a board cf education, prescribing their number and terms of office ; and such board when so elected or appointed and qualified shall together with the clerk or recorder cf such city crviUase possess the same pow ers and discharge the same duties within the. Iimit3 of their jurisdiction, as local directors and boards cf education in town ships. - . . Sec. 65. "The", respective township beards of education, and their successors in office shall have power to take and held in trust for the use and benefit of any central, or mgh school, or sub-ditnc school m the township, any grant or de vise of land and any donation or beques cf money or other personal property, to be applied by me beard to the maintain ance and support cf any school or schooh according to the intention cf the grant or donation.
