An Associated Press dispatch under date of Denver, April 13, follows: "Chief Justice Gabbert of the state supremo court yesterday filed a sup plemental opinion in the Moyer case. It is generally conceded that this new opinion Will take precedence over the former majority opinion as the latest expression of tho court. The chief justice declared that the governor of tho state has the power to suspend habeas corpus at his discretion and that the courts can not review the action. The body of the new opinion is taken up with excerpts from an opinion of Justice Johnson In a case in the Philippine islands in which the power ofhe governor general to sus pend the privileges of the writ of habeas corpus during a state of in surrection in the province of Bantan gas was upheld. The chief justice finds the case analogous to the situa tion presented in Colorado during the labor troubles and draws conclusions in which the incarceration of Moyer by the military is upheld." An Associated Press dispatch un der date of "Washington, April 13, fol lows: "Senator Tillman today filed formal charges with the sub-committee considering the nomination of Ben jamin F. Barnes, assistant secretary to the president, to be postmaster at Washington, and protested against his confirmation. These charges re late to the expulsion of Mrs. Minor Morris from the executive ofilce, and assert inhuman and brutal treatment of the woman, and also allege that Barnes made a false statement about tho case."
