township in the lust issue of the Times
Indepei.dent. we believe our readers
would like to know some of the facts,
and on examination of the town
ship records we find that the Burling
ton railroad started a case in the Fed
eral Court to eujoiu the collection of
the interest on the irrigation bouds.
The editor of the Times-Independent
was township clerk at tne time and em
ployed 11. M. Mathew, at that time one
ot tne li. & M. attorneys, to defend lor
Loup City township. Attorney Mathew
acted in said case m conjunction with
the other railroad attorneys, and he per
sonally secured and served subpoenas
on Jt hu Minshuii, John Vandegnft, 11.
Biy and Alonzo Ziuk, to appear as wit
nesses in said case at the mat in Uma
hv and the ofiiee of the gentral solic
itor ot the li. & M. By Co. forwarder
to Air. Mathew a railioad pas» lor four
persons goon to Omaha <.nd return, and
said pass was takeu up by the cuuduc
tor on ihe train on which the above
witnesses came home from that trip.
1 he statute provides the taking of testi
monv of witnesses to the Federal Court

nesses live more than 100 miles from
the court, and they cannot be compelled

Tnese witnesses were not used to give
personal te-tuuony in the case. No
charge for their fees were ever returned
m the bill of costs, w hich has been paid
by the township, and the first bill pre
sented for such costs was filed with the
township cerk on April 2bth, 1004. for
the purported appearance made May
24th. I9ul, which was a lapse ot nearly
three years without filing a bill. In
view oi these facts, the township board
did not feel like assuming tbe responsi
bility of paying 883.20 out ot the town
slap funds, but awarded per diem for
the time actually necessary for these
witness t> to na\e given intir testimnny
betore a notary public here. 1 he «own
ship board is still of the opinion that as
long as these witnesses w ere provided
with transportation, which was to save
the sum ot mi.au each, that m all fair
ness the tow nship should not have been
required to pay them for something i
which w as not expended by them, as
the pass was issu*d for them ro use tor
that specific puri»ose.
For the benefit of the Times-Inde
pendent, we w ill state that as soon as
judgment was rendered against the
township, the board paid the following
sums to these parties:

This appeals to be a saving of $8.75
of the funds of the township over the
amount claimed by Mr. Mathew, attor
ney for the township first and the wit
ne-ses afterward.
Death of an Aged Pioneer.
Last Sunday forenoon occurred the
death of Grandpa French, one of the
oldest setilers in this part of the country,
at the home of his son, Charles French,
in this city, llis extreme age, coupled
with a total blindness, commencing
with loss of vision over two years since
and an enfeebled constitution, has made
him a great care on his son Ch <rlesand
good wife, with whom he lived the past
number of months preceding his death,
but who tenderly ministered to h:s
every want Ilts death came peaceful
as though fallen into sweet sleep The
funeral occurred Tuesday afternoon at
theM. E. church. Rev Cowell deliver
ing an abb- sermon from Ec. 8-8, after
w hich all that was mortal of the aged
father was laid to sleep beneath a man
tel of crystal whiteness in the Silent
City of our Dead. .

Jan. 21,1905. at the age of 84 ye -rs. 11
months and 21 day?. He was married
at Lewis, Essex county, New York, to
Miss Jane Jones,ou the25th day of May,
lb4l To this nnion were born six ehil
dren—Martha, Charles, Reuben, Mary
Ann, David and Rachel, all living but
two, M irtha and David. He was mar
ried the second time-at Loup City. Neb.,
on the *th day ot March. 1884, to Mrs.
Elizabeth William*, of Va ley county.
He was one of the pioneer residents of
| this county, having homesteaded here
in 1875,on the 31st day of December,
and has lived almost all the last years
of his life in Sherman and Valley coun
ties.

Co., of Lincoln, and Lots 2 and 3, as
advertised were awarded to E. A.

County Times-Independent, (except
election ballots) the Times-Indepen
dent also to publish minutes of the
meetings of the board of supervisors.
Ballot printing, legal notices and
delinquent tax list to J. W. Burleigh,
publisher of The Loup City North
western. at legal rates.
Bond of II. J. Johansen, road over
seer district No. 13, was approved.
By motion'the request of county
superintendent for $75.00 allowance
for institute fund was granted.
