A terrible battle, the wounding of ex Sheriff Houck, of Valley county, the killing of one horse thief and the capture of another was the re sult of a persistent chase by fanners of two notorious horse thieves last Saturday. The theiving is reported to have been done near Spaulding, Greeley county and the thieves with their stolen chattels were pursued through Greeley and Valley countits and into the northeast part of Sherman where the) were overtaken, the property recovered, and the baadits taken as above stated. The following facts as gath ered by G.H. Gibson, county clerk, who attended the inquest in his official capicity and explored the battle ground is here given: “Last Saturday evening about 7:00 o’clock a telephone message to coro ner Hunter notified him that a des porado had been killed near the Van Horn ranch in the northeast eorner of the county and that his presence was demanded as soon as possible. It being just night Mr. Hunter decided to wait until morn ing, when Sheriff Snyder, County At torney Nightingale, Dr. Main, D. C. Grow, VV. P. Reed, J. L. Owen, Mr. Ogle, W. Betts and G. H. Gib son accompanied him to the scene of the tragedy. The desperados and horse thieves were at brst suspected to be of Wheeler county but later it was learned that the captured was a Harry hill of Greeley county and the killed is said to be one Joseph Ram boe, of near York, Neb., at least he ^ has been so identified by a party living here by the name of Jeffereys who reoognizes the scar on his face and on his nose which was caused by being struck with a ball bat. They stole four horses and two mules near Spalding, Greeley county, last Thursday night and were endeavor ing to get away with them, and the authorities immediately located their trail and followed it pretty acurately. Tbe Lincoln blood hounds were sent for and were on tap Fri day night at North Loup to assist in the chase. On Friday eveuiDg tbe outlaws applied to Harry Me vers in the south edge of Valley county for food aud graiQ, and Mr. Meyers becoming suspicious went to North Loup and telephoned Sheriff Kokus of Valley county the facts and the Sheriff at once sent ex-Sheriff Houck on the scent. Houck with a deputy sheriff from Greeley county went to the vacinity of Mr. Meyers, arriving on the scene at an earlv hour. About 7 o’clock tbe officers ap proached the borne of Mr. A. K Cress, and ex Sheriff Hauck being acquainted with Mr. Cress concluded to stop and inquire for news, little thinking that tbe thieves were just silting down to breakfast at tbe Cress homestead. The Deputy sher * iff knocked at tbe door and when Mr. Cress opened it he saw the offi cers and at once stepped outside and closed the door and was informing them as to bis suspicious guests, when the thieves, ascertaining from Mrs. Cress who the callers were, at once put on their hats and walked out past the officers. They walked out into the yard and toward tLe barn hut were ordered to surrender, when without a word they turned and bgean tiring pertniscously at the two deputies and Mr Cress. ()m* ball passed betwten Mr. Urers’ legs anti killed bis dug* behind him, another strut'll « Ulcer Knock in the calf of the left lee, causing that, gentleman to pull too hard on a self cocking revolver which went off and shot himself in the left foot, and the thieves went to ttie barn unhur'. The deputy from | Greeley county then watched the barn until Mr. Hauck.wbo bad been placed hots de combat, hurried to town for assistance arid in due time sheriff Kokus and the man with the poodles arrived on the scene. An investigation disclosed the fact that the barn was empty as far as thieves were coucerned ard then the chase began anew. By this time some fifty of the neighbors had gathered and the posse took on the appearance of a small army, some in wagons, some afoot, and a few on horseback. The dogs readily took the scent and good time was made for several miles when the dogs were hauled up by their master and the officers and dog man conferred. From local infwr mation it seems the limbs of the law and the dog man concluded that “he who fights and runs away will live to fight another day,” or at least it is said that they shamefully aband oned the chase and went back to North Loup, about eight miles, as they said “for dinner and to let the dogs rest.” This was objected to by the farmers, whe had do horses to give to the thieves aDd who had lost their first booty at the Cress homestead that morning; so they, the farmers demurred, but the offi cers and the dog man from Lincoln retired, evidently thinking dis cretion the better pait of valor, and uot one of them was present at the final wind up. The posse of farmers then held a hurried consul tation and the five men on horse back, Messrs Orell and Ansel Van Horn, Wesley and Eugene, Hutch ins of North Loup Harry Meyers and Mike Palu took up the trail that “the dogs had lost," and about 4:30 were rewarded by a glimpes of their men about a mile and a quarter south east of Messrs. Van Horn's house, and about two miles inside Sherman county. They were walk ing south in the bottom of a canyon and in a ditch several feet deep. They were ordered to surrender but refused. The boys then deployed, two takiDg the east side of the gulch, two pushing on up the center and the remaining one rode up a pocket endeavoring to head them off. The thieves undertook to leave the canyon and when nearly to the top faced Mr. Orell Van Horn, who had rode within 125 feet of them be fore either party discovered it. The thieves made no answer to a de mand to surrender but took a bead on Mr. Van Horn and turned loose their arsenal which was vigrously replied to by .Mr. Van Horn, all parties missing. Just at this time one of the boys from another quarter meandered a shot that dropped just in the rear ot the right ear of one of the desporados, and his song was sung. This ended the fight as the other one threw down his gun and up bis hands and was arrested witb out further trouble. A coronet’s inquest exbonorated the boys ai d the people of that j community expressed themselves ns being more than satisfied with their own local protectors of their lives and property. The corpse was brought to Loup City, after the coroner’s jury was through and after keeping the body the required length of time and using all means possible but tailing to find frier,ds or relatives it was shipped to the 9taie authorities. The following is the finding of the coroner’s jury: At the Inquest held at the residence of Jay Van Horn In Oak Creek township. Sherman county. April 27, 1802, before me, George \V. Hunter, coroner of said county, upon the body of Baldwin, lying dead, by the jurors whose namesare hereunto subscribed, the said jurors upon their oaths, do say that on April 28, luttt. said Baldwin, alias Hennett w hose true name is to the jurors unknown, died by a gunshot, wound inflicted by a sheriff's posse while re sisting arrest for the crime of horse stealing, with fo-co and arms, and had shot at members of said posse at the time of his death, and we further find that said shooting of the said Baldwin, als is Binnett whos true name is to the said jurors unkn iwn, was justifiable.
