The treasurer could not see Ins way clear to do that under the law iind asked that that por tion Ik; paid under protest as the statute provides nad then ask the commissioners to make an order that the amount be refunded, and in case refus.il the matter could lie taken lo the district court and question of the legality of the. levy set tled. This the representative of the railroad declined to do, and the taxes remain unpaid. The climate is more pleasant than that of the eastern portion of Nebraska. There is still OVER 800,000 ACRES of land in Sioux county yet open to homestead entry. It is better land and more, desirably located than that for which such rushes are made on the open ing of a reservation.
