S .1 i '.i.'f ' 'liltl , To The Voters of Nebraska There is but ode state issue of im portance before you this fall, and that is, shall Maxwell or Xorval he elected judge of the supreme court. There ara other candidates for this position, but. none of them stand the slightest chance of election. To vote for any of them is practically mudes?. Samuel Maxwell has been en the bench for over twenty year. He is everywhere rect gmzed as the ablest and purest judge the slate ever hud. His law books and decisions are authori ties all over the United States. He lectures before the j;rtat law schools. While on the bench he w as always on the Bide of the peopto, of law and jus tice. He was turned down because the railroads could not use him. He is a man of ripe experience and would be an honor to the bench. T. L, Nerval was nominated by the railroads six jeais aco to defeat Judge Kccse whom they could not use. Since he has been on the bench seventy live per cent of the cum-s involving railroad interests coming before his cojut were decided in favor of the roads and against the people. Norva! is not re garded as" an able judge, and outside of his own sstate has very little reputation. He has made, or coiicurad in a half d o.(ii partisan decisions t but have brought our court into little less than open disgrace. One of these was thi decision to ous t ov. J!iyd. from which Judge Maxwell dissented and was up held in his position by the l S. su preme court. Another was the Kruse- Norton contest c hi, where the supreme court attempted to decide a legislative contest, although the constitution de clares that, sin h contests shall he de cided by the legislature alone. From this decision M xwell also dissented. Another was the decision shielding the doodling fcMe officials, from which Maxwell again dissented. Tin-re are many more. In all these Maxwell rose above partisanisin and stood on the side of justice and right. For this he was defeated in a convention packed by the railroads and the friends of the im peached state ollicials. This tall he is the iinaniinou nominee of the peoples' part y as a nonpartisan candidate. It depends upon the voters of the j state to say whether the wrong he i suffered shall he. righted and his long urd work for the people, and his fidelity to right, shall be rewarded. It depends upoifthe voters of the state to say whether a man of such ability. ! honestly and unlliiiching courage Hhull e turned down by a lot, of railroad ! satraps and bundling politician who could not use him for t heir dishonest, J schemes. t The issue is clearly drawn. It is not ; a partisan question. Jt Is above that. , ( js a question of the good of the stale land the purity of the courts.
