Jas. McHealy, a Louisville Citizen,
I Killed By Caving Sand.
WERE POWEBLESS TO ASSIST.
Bystanders Were Forced t Stand By and
Sea the Man Covered Up With the
Sand and Killed Various
Other Motes.
Some time within the past year the
people of tbe village of Louisville be
came unusually excited over the re
ported discovery of gold close to that
town by an ex-miner named Huber.
The find was made in an old deserted
well and, although the genuineness of
the gold was clear, a quantity of the
sand was sent to an assayist to deter
mine what proportion of the yellow
metal it contained. The result of tbe
assay was not at all encouraging, but
this fact did not deter the people of
the town from having faith in the
claim that gold in paying quantities
existed in that immediate neighbor
hood and ever since that time certain
parties have continued to prospect for
the Yellow metal. Jas. McNealy, a
well-known Louisville citizen, has been
one of the prospectors, and as a result
of his determination to prosecute the
search he met with an awful death
yesterday.
McXealy 's prospecting has been con
fined to an old well in the near neigh
borhood where Huber made bis find.
McXealy had sunk a shaft to a depth
of thirty feet through the sand, and as
he went down failed to take the usual
precaution of curbing the sides of the
shaft. He was at work yesterday af
ternoon when, without a moment's
warning, a large body of sand caved
off one side of the shaft and completely
enveloped his body, his head alone
protruding above the surface. His
cries attracted assistance, but as there
was immediate danger of a further
caving of the sand, one of the party
hurried off for a barrel to put over Mc
Xealy's head and thus protect him
Their fears of a further caving of the
sand proved only too true, for a few
minutes afterwards a large body of
Band fell with a crash and poor Mc
Xealy was buried to a depth of several
feet. The men at tbe top of tbe well
were absolutely powerless to save him
and he was smothered to death within
their very sight. Work was then com
menced to get the body out in tbe hope
that it might be revived, but the task
was more difficult than supposed and
it was eleven o'clock at nuht before
the body, cold and lifeless, was res
cued and removed to the ground above
McXealy was well-known in and
about Louisville. He was about thirty
five years of ajje and leaves a wife but
no children. His untimely end is an
exceedingly sad affair and tbe wife has
tbe sincere sympathy of hosts of
friends in her awful affliction.
An Aecldental hhooting.
By the accidental discbarge of a shot
gun in the southern limits of tbe city
at about ten o'clock this morning
Miles Curry, a young man about
twenty-eight years of age, was maimed
for life, with a further possibility that
the young man's death may ensue.
Corry is a son-in-law of S. R. Car
rigan of this city, and came to town
yesterday from bis home in Xance
county by wagon, accompanied by his
wife. This morning Curry and Mr
Car rigan 'b son, joe, maae arrange
ments to go hunting out on the Platte
bottoms north of town, the intention
being to journey in Curry's wagon
Before departing they loaded a muzzle
loading shot gun with a charge of
goose shot and placed tbe gun with tbe
butt resting on the bottom of tbe
wagon and the barrel on the side of
the wagon box. One of Mr.Carrigan'a
ittle girls was inside of the wagon,
and while she was moving about tbe
gun was jarred sufficiently to make it
fall onto the bottom of the wagon box,
the result being that the cap exploded
ami released the heavy charge of shot.
Curry was standing on the ground
close to tbe wagon and the charge tore
a bole completely through tbe side of
the wagon box and tben struck him in
the right arm close to the shoulder.
The muscles were completely shot in
twain, tbe bone was shattered and a
few of the shot were carried on and
penetrated the right lung. A physician
was immediately called and tbe flow
of blood stopped, after which tbe
wounds were dressed preparatory to
ward an amputation of the arm. Tbe
atter operation was performed late
this afternoon. Tbe physicians are
hopeful, but the young man's recovery
is by no means assured.
Difficulty Over a Banning; Horse.
Abe Billings of Nebraska City is tbe
owner of a running horse which is his
pride and delight. For some time the
animal has been at Syracuse in the
hands of a man named McFadden for
training. Abe learned in some way
that bis horse was not at Syracuse and
asked Constable White to hunt the
animal up. White started on the trail
and soon located the animal at Elm-
wood, this county, where McFadden
had sold it to a liveryman. Abe re
plevied tbe horse and when the case
was beard McFadden swore that he
had purchased it from Billings for the
magnificent sum of $15. This was
easily proven not to be tbe fact and
Abe secured his horse. He says he
will swear out a warrant for McFad-
den's arrest on the charge of horse
stealing.
The Bennett-Rosewater libel case
has been finally disposed of. Judge
Scott, criminal judge of the district
court in Douglas county, took it up
yesterday, and alter a lengthy talk
dismissed it upon representation ot the
plaintiff. Judge Scott comment-d
warmly upon the transfer of the case
from his court. The case had been
transferred to Judge Ambrose and
was set for hearing when the case
pending should be finished. Applica
tion was made to the supreme court
for a writ of mandamus to compel
Jude Scott to turn the case over to
Judge Ambrose. County Attorney
Kaley afterward appeared before
Judge Ambrose and entered a nolle.
The order was made and the suit dis
missed from tbe docket, which ends
the case in all branches of the district
court, civil and criminal.
Henry Englekemeier. a former Cass
county farmer, but now a resident of
Cherokee Strip, returned home today
after a short stay in this vicinity on
business. lie is well pleased with his
new home and reports that corn went
35 bushels to the acre and wheat about
40 bushels during the season just
passed. He says that land in the strip
is still cheap and will prove a profitable
investment. He has sowed 130 acres
in fall wheat and looks for a big crop
