Transactions of County Board the Past Month Routine Business and Claims Take Up Time of Commissioners Approve Official Bonds Routine business and allowance of claims comprised most of the busi ness transacted by the County Com missioners during February. Orders of County Judge granting Mother's Pension to Louise Petereit sind renewing Mothers' Pensions of Minnie Eledge. Gretchen Simmons and Hattie Fidlier. were approved. The appointment of Wm. H. Por ter by County Assessor for assessor in Liberty precinct to fill vacancy was approved. J. M. Kokjer, Justice of the Peace of Avoca precinct, filed his annual report of cases and fines for the yar 1938. On request of John McKay that valuation be fixed on 40 acres of school land in SWU NWU of Sec. 16. Twp. 10. Range 11. the Board set the valuation of the land not to exceed $40 per acre and notified the Department of Public Lands and Funds, at Lincoln, of its action. A resolution -was adopted approv ing substitution of escrow securties to guarantee county deposits by the Plattsmouth State Bank. The claim of Cass County Farm Bureau, in the amount of $232.91 for the month of January was die allowed, as no appropriation could be made for this work under rulings of the Attorney General and County Attorney. A petition for appointment of P. A. Jacobson as Justice of the Peace to fill vacancy in Louisville precinct, was approved. The Board also approved his bond as well as those of numerous other precinct officers and voted to release the Sun Indemnity company from lia bility under the bond of Harold C. Mehlig. as Constable, from, and after January 4. 1939. State Attorney G. A. Worley said he would start injunction proceed ings against any gambling house that disobeyed. All in Dade county com plied and were darkened last night. River Bank Land Owner Has Title to Former Bed Supreme Court Holds Where Stream Recedes That Adjacent Owner Acquires Formed Land. LINCOLN, March 10 (UP) The Nebraska supreme court today affirm ed a Dakota county district court decision filing with the river bank proprietor the right to certain land Trom which the river has receded. The district court left the tit'e with the plaintiff, Ben Conkcy. Four defendants who also claimed the land appealed. The court ruled that Conkey's ownership of property ad joining the former river bank en titled him to ownership of the dry river bed. The defendants contended they had obtained title to various parts of the river bed ly taking possession. The supreme court cited a pre vious Nebraska supreme court de cision that "where the waters of a river gradually recede, changing the channel of the stream and leaving the laud dry which was theretofore covered by water, such land belongs to the riparian proprietor." Tho court added that title to land by adverse possession (claiming posses sion adverse to other claimants) to be effective "must be proved by ac tual, open, exclusive, and continuous ownership for the full statutory period of ten years." The defend ants added neither fenced in or lived on the land they claimed since only about 1933. Waugh, 90, former Lincoln business man and one of four organizers of the Lincoln Commericial club, died at his home in Los Angeles according to word here today. Waugh came to Lincoln in 1887 and incorporated the Lincoln Paint and Color company of which he was president until 1913. He later entered clothing and furni ture ventures but retired in 1920 and moved to California. Waugh was also a director of the Midwest Life Insurance company and of the former City National bank of Lincoln. OMAHA, March 11 (UP) Shot five times as he attempted to rob a grocery store, Bennie Brott, 22. pa roled from the stats reformatory six months ago. was believed dying at a Lospital today. Brott was shot by the grocer, Em manuel Wolfson, who became en raged, he said, because Brott "both ered my customers." After rifling the cash register of $20, Brott had started to rob Ethel Harroun, 18, a customer, when Wolfson grabbed a levolver and began firing. Brott was struck in the chin, in the shoulder and three bullets penetrated hia body. Brott, whose criminal career be gan when he was sentenced to the state industrial school at Kearney, was sentenced to the state reform atory for two years for a robbery at Kearney on Jan. 30, 1937. GEESE LIKE KANSAS PRISON FIND MILLER NOT GUILTY BENKELMAN, Neb., March 10 (UP) A verdict of "not guilty" was returned by the jury this morn ing in the trial of Leonard Miller, 26. of Benkelman for the murder of Francis Edwards on a Benkelman street three months ago. The jury returned its verdict at 7:30 a. m. after having been in session since 4 o'clock Thursday afternoon. Miller was freed and was reported to have left Benkelman immediately by auto mobile for an unknown destination.
