It was claimed that the defendant had passed a car on a hill where it was impossible to see If a car was comin;j up the other side of the hill. The defense introduced photographs showing the view was not obscured and that it was easy to see cars at the distance named by the patrolmen in their testimony. Judge Duxbury acquitted the defend ant as the evidence was insufficient to warrant conviction. SUSTAINS FALL RETURNS TO ST, LOUIS Charles Roucfca, who was calleC here by the death of his sister, Mrs. Anna Kozak, returned to his . home in St. Louis, Missouri Saturday eve ning. While here Mr. Roucka had the pleasure of meeting and visit ing with a number of his old ac quaintances of former years. Mrs. Cecil Christensen was the vic tim of a severe fall Monday at her home, which was formerly occupied by the Frank Barkus family. Mrs. Christensen had been busy tending to her household duties and on de scending the cellar steps she fell In such manner as to cause a painful in jury to her foot. She was taken to the office of Dr. Ji. P. Westover wherp medical care was administered. Un C or Glass nl I WE RESERVE THE RIGHT TO LIMIT QUANTITIES MARRIED AT LINCOLN HEARS CASS COUNTY CASE The supreme court took under advisement Tuesday an appeal of Joe Solomon from a Cass county de cision. He had employed C. L. Rein of Lincoln and W. G. Kieck of Platts mouth to prosecute a compensation claim against his employer, A. W. Farney. Under an executed contract he was to pay the attorneys 25 per cent of their recovery. The courts allowed them $350 attorney fees, and the dispute was whether these fees should be credited on the amount of the recovery as part of the 25 per cent. Solomon claims attorney fees were Included in the 25 per cent cf their share. HOLD COMMITTAL SERVICE Sunday afternoon the committal service was held at the Horning cemetery south of the city, for Mar tin K. Ruby, who passed away on February 25th. The church services were held on Tuesday, February 28 at Mynard, but owing to the blocked roads leading to the cemetery, it was impossible to make the interment. The body has been held at the Sattler funeral home to await the bettering of the weather. Qnly. the members of the Immediate family were present. VISITS WITH OLD FRIENDS From Tuesday's Daily Former Judge Jesse L. Root oi Omaha arrived in Plattsmouth this morning to spend the day attending to some matters of business. IOWA PARTIES MARRIED Saturday afternoon at the court house occurred the marriage of Woodrow Wilson Smith and Miss Thelma Margaret Bethers, both of Council Bluffs. The marriage lines were read by Judge A. H. Duxbury in his usual impressive manner and witnessed by Louella Hill and Leslie Smith. SHOWS IMPROVEMENT Dorothea Fulton, who has been quite ill at her home for more than a week with a throat Infection, is reported as being somewhat improved and may be able to return to school within the next few days. W. Eggert of Lincoln, was wed to Fred Fricke, son of Mrs. Carl Fricke, at a ceremony performed at the Holy Trinity Episcopal church in Lincoln at 5:45 p. m. Thursday, when Rev. Harold C. Gosnell read the marriage lines. Mae Ellington served as maid of honor, and was dressed in navy blue crepe. Heril dress was trimmed in white organdy. i She wore blue accessories and a gar- 6 denia corsage. The bride appeared in a navy blue crepe dress trimmed in white lace. Her accessories were of wine and she had an orchid corsage. Walter Kozel was the best man. Fol lowing the ceremony a dinner was served at the Cornhusker and ten were present. The groom ia a former resident here and a member of one of the prominent families of tlje community. He was a graduate here from the local high school' in 1935 and later attended Doane college.
