Writing Tenative Opinions to Clear
the Docket, Now Fifty
Years Behind.
Oklahoma City. The nation's le
gal fraternity is watching with in
terest an unusual experiment in Ok
lahoma. Fifty years behind on its
docket, the state supreme court has
drafted several hundred prominent
attorneys who will become tempor
ary Justices and prepare tentative
opinions for approval or rejection of
the court. In addition forty district
Judges and the three Judges of th?
criminal court of appeals are busy
writing tentative opinions without
additional compensation.
Chief Justice Fletcher Riley, at
41, one of the youngest men in hi
position in the nation, originated th.j
plan less then a year ago. lie now
declares it successful and predicts
it eventually may be adopted in oth
er states where dockets are congest
ed. With more than 2,000 cases on tl..
docket of the court, Justice Riley
told a recent state bar convention
that unless help were received it
would require more than fifty years
to catch up with the cases altho Ok
lahoma justices were writing 1U
opinions a year each and more than
keeping abreast of current filings.
He presented his plan of t reat in;;
a state Judicial council and of using
the court's "inherent power" of hav
ing district judges and attorneys pie
pare tentative opinions. A legisla
tive act was not required, he said.
His plan received immediate ap
proval. He added that Oklahoma justice
during the last year have urittin
twice as many opinions as courts in
Missouri and Kansas and more than
in most states. Hundreds of suits ar
filed annually in Oklahoma due to
new quetions arising over oil, min
ing, political, industrial, and agri
cultural and tax Issues.
