The following notice was present
ed to the Board:
To the Honorable Board of Coun
ty Commissioners of Cass' county,
Nebraska "
As County Clerk of Cass county,
Nebraska, and a member of the can
vassing board. I herewith report to
you that the said canvassing board
ha3 canvassed the returns of the
epecial bond election held in Louis
ville precinct on the 14th day of
April. 1925, at which special elec
tion the proposition of issuing bonds
in the sum of $28,000.00 for the
construction of highways within
said precinct, by grading, draining
and graveling or quarry run lime
stone Jhe same, and the levying of a
tax annually upon all the taxable
property in said precinct to pay the
principal and the interest on said
bonds, find as follows: There were
cast at said special election in Louis
ville precinct, Cass county, Nebras
ka, a total of 3tl votes. Th?re were
cast in favor or" said proposition, 223
votes. There were cast against said
preposition. 137 votes and more than
three-fifths of the total vote cast was
cast in favor of said proposition and
the said proposition was carried in
aecnr-1" nre to taw.

The following resolution was pre
sented: "Whereas, it appears from the af
fidavit of publication on file that No
tice of Special Election of Louisville
prerinct, heretofore called and or
dered to be held on the 14th day of
April, .1925. was published in the
Louisville Courier, a legal newspaper
published in Louisville precinct in
Cas3 county, Nebraska, for more than
thirty (30) days immediately prior
to the date of said special election,
and
"Whereas, It appears from the af
fidavit of the Sheriff of said county,
that the County Clerk of said coun
ty delivered notices of said special
election to said sheriff and that said
sheriff did on the 14th day of March,
1925, more than twenty (20) days
prior to the date of said special elec
tion, post at least three of said no
tices in three of the most public
places with each of the voting divi
sions of said precinct, and - '-
"Whereat' said special ejection
was held at the time and place given
in said notices and in accordance to
law, and returns made by the elec
tion boards of said precinct to the
County Clerk of said county, and
'Whereas, the County Clerk, did
on the 17th day of April, 1925, ap
point a board of canvassers, a3 pro
vided by law, to canvass the returns
of said special election and it ap
pears from the returns of said board
of canvassers, herein filed, that the
returns of the special election held
in Louisville precinct on the 14th
day of April, 1925, to vote on the
proposition of issuing bonds of said
precinct in the sum of $28,000.00
for the construction of highways by
graveling, or quarry run limestone.
said limestone not to exceed one and
one-half inches in diameter, drain
ing and grading the same, and levy
a tax to pay for the same, that there
were cast at said election a total of
361 votes, 223 votes being in favor
of said proposition and 137 votes
being against said proposition, of Is
suing bonds, and
"Whereas, it appears that more
than sixty (60) per cent of the votes
cast at said special election were
cast in favor of said proposition of
issuing bonds in the sum of $28,000.

"Therefore. Be it Resolved, by the
Chairman and Board of County Com
missioners of Cass county, Nebraska,
that theproposition of issuing bonds

struction of highways in Louisville
precinct, as submitted to the voters
of said precinct at a special election
held in said precinct on the 14th
clay of April. !925. be and the same
is hereby declared to have carried as
provided by law, and that issuance
of said bonds be and the same are
hereby declared to be duly author
ized. "Be it further Resolved, that the
County Clerk be and hereby is au
thorized and directed to enter upon
the records of said county, the peti
tion, notice of election, the result of
the vote and the procedure herein,
in full and publish a notice of the
Adoption of the proposition to issue
bonds in the sum of $28,000.00 to
construct highways in said precinct
and to levy a tax to pay said bonds
and interest, as submitted, for two
consecutive weeks in the Louisville
Courier, a legal newspaper publish
ed in said precinct -and county.

It was moved by Spangler and
seconded by Harris that the above
and foregoing resolution be adopted
as read: Carried, the vote being as
follows: Fred H. Gorder, aye; C. F.

Chairman declared the above Reso

Louisville Precinct
You are hereby notified that the
proposition submitted to the quail
tied voters of Louisville precinct in
Cass county, Nebraska, at a special
election of said precinct, held on the
14th day of April. 1925, at which
election the proposition of issuing

construct highways in said precinct
by graveling, or quarry run lime
stone, said limestone not to exceed
one and ono-half inches in dianieter,
draining and grading the same, and
to levy a tax annually on all tho tax

are to be serial bonds, $2,000.00 of

per cent per annum, payable semi
annually, and which proposition was
duly presented to the County Board
by a petition signed by more than
twenty (20) freeholders in said pre
cinct, and an election duly called by
Bairl board and notice thereof duly
given by publication and by posting
up notices within said precmci, t

ance to said petition and notice of
elfction together with the levy of a

precinct to pay said bonds and in
terest, to have been duly authorized
by the voters at said special election,
and that eaid proposition was duly
adopted and authorized by more
than sixty (60) per cent of the votes
cast at said election, voting in favor
of said proposition and that said
County Board did by resolution duly
adopted, authorized, instructed and
directed the County Clerk to enter
upon the records of said county, the
petition, notice of election, and the
result of the vote and publish this
notice of the adoption of said prop
osition for two consecutive weeks in
the Louisville Courier, a legal news
paper published in said precinct and
county.

Cass, Nebraska:
Gentlemen: We, the undersigned,
respectfully petition your honorable
body to change the public road now
running through the southwest quar
ter of Section 30-12-14 and south
east quarter of the northwest quar
ter of 30-12-14, Cas3 county, Ne
braska, so as to run said road north
and south on a direct line along the
east side of the one-eighth section
line running north and south thru
the southwest quarter and the south
half of the northwest quarter of
Section 30-12-14. The undersigned,
Blanche Horning and Olive Horn
ing, and James E.. Griffin, the own
ers, hereby agree to give for the use
of said road sufficient land without
expense, providing that the road now
angling through the northeast quar
ter of the southwest quarter and
southeast quarter of the northwest
quarter be vacated and closed, and
returned to the respective property
owners thereof.
We further respectfully show thai
the road as now laid out is a longer
milt than tnm nrnnninl rnaA-
'the proposed road is shorter, better
ana more economical way and can be
better maintained and kept open for
travel.

The following business was trans
acted in regular form:
Graveling Bonds -
RESOLUTION providing for the Is
suance of $28,000.00 Bonds of
Louisville precinct, in Cass coun
ty, Nebraska, for the construction
of highways in said precinct.
Whereas, a petition signed by
more than twenty (20) freeholders
of Louisville precinct, iu Cass coun
ty, Nebraska, was presented to the
Board of County Commissioners,
asking that due notice be given to
all the legal voters in said precinct
and that a special election of the
qualified electors of said precinct be
called as provided by law to vote
upon the question of issuing bonds
of said precinct in the sum of
$28,000.00, and the levying of a
tax annually upon the property In
said precinct to pay the principal
and interest thereon aa the same be
comes due, to pay the cost of the
construction of highways in said
precinct, by graveling or quarry run
limestone, said limestone not to ex
ceed one and one-half inches in
diameter, draining and grading the
same, which petition designated the
highways in said precinct to be Im
proved, the maturity of the bonds of
said precinct, and the rate of inter
est thereon, and
Whereas, in accordance to 6ald
petition the Board of County Com
missioners, at an adjourned meeting
held on the Eth day of March, 1925,
by resolution duly passed and adopt
ed determined that the assessed prop
erty valuation of said precinct for
the year 1924 was $2,711,185.00 and
that the proposed bond Issue whs
less than two (2) rcr ceut of the
assessed valuation, and crlled a
special election of said procinct to
be held on Tuesday, the 14th day
of April. 1925, for the nubmi.ision
of the proposition of the is&uanco of
said bonds to the qualified voters of
said precinct, and
Whereas, notice of such election
and the submission of . said" proposi
tion was duly published an by law
required, and
Whereas, said election was held
cn the 14th day of April, 1925. pur
suant to said submission and notloe
thereof, and there were cast at said
election a total of 361 votes. 223 of
which votes were cast in favor of
said proposition, and 137 of !i'h
votes were cast against said propo
sition, and that more v than sixty
(60) per cent of the votes cast at
said special election on the proposi
tion therein submitted were 'n favor
of the issuance of such pr'nirct
bonds, and that a legally anpeint-ed
and constituted board of canvastiprs
did on the 17th day of April, 1925,
canvass the returns of said Kpocal
election and so found and determined
and duly certified the result of the
cenvam to this Board of County
Commissioners, and
Whereas, the Board of County
Commissioners did by resolution
duly pissed at an adjourned session
of said board, declare said proposi
tion of issuing bond.s of said Louis
ville precinct in the sum and amocnt
of $28,000.00, for the construction
of highways in said precinc t to lu-.ve
been authorized by the legal votrrs
of said precinct and directed the
County Clerk of said county to enter
upon the records of said county, the
petition of the freeholders herein,
the notice of election and the result
of the vote at the special election in
said precinct, and directed the pub
lication of said result for two f2)
consecutive weeks in a legal news
paper published in said precinct;
Therefore, Be it Resolved, by the
Chairman and Board of County Com
missioners of Cass county, Nebras
ka: Section 1. That it be and is here
by found and declared that more
than sixty (60) per cent of the bal
lots cast bv tbe leeal voters of
Louisville precinct at a special ejec
tion of said precinct duly and legal
ly called and held on the 14th day
of April, 1925. were cast in favor
of the proposition of issuing bonds
of said precinct in the sum of $28,
000.00. and the levying of a tax
annually upon all the taxable prop
erty in said precinct to pay Raid
bonds and Interest as the same be
comes due and payable, to pay the
cost of construction of highways in
said precinct by graveling or quarry
run limestone, said limestone not to
exceed one and one-half inches in
diameter, draining and grading the
same.
Section 2. That for the purpose
of paying the cost of construction of
highways in said precinct by grav
eling, or quarry run limestone, said
limestone not to exceed one and one
half inches in diameter, draining
and grading the same, there shall be
issued bonds of Louisville precinct
in Cass county, Nebraska designated
"Louisville Precinct Bonds." in the
sum and amount of $28,000.00, con
sisting of twenty-two (22) bond of
$1,000.00 each and six (6) bonds of
$800.00 each and two (2) bonds of
$600.00 each and numbered from
one to thirty, both inclusive, all of
which bonds shall be dated July 1st.
1925, shall bear interest at the rate
of five (5) per cent per annum trom
date, payable semi-annually on the
first day of January and July in each
year, and said bond3 shall become
due and payable in numerical order
on each of the following dates and
in the amounts designated:

denced by coupons thereto attached
and said bonds shall be signed by
the Chairman and the Board of
County Commissioners, and attested
by the County Clerk of said county,
and the seal of said county to be
impressed on said bonds, and that
the coupons thereon be executed by
the fac-simile signature of the Chair
man and Board of County Comniis-
sioners and County Clerk appearing
on each coupon, and have endorsed
thereon forms and certificate of reg
istration by the Auditor of the State
of Nebraska, and the County Clerk
of Cass county, Nebraska, and that
said bonds shall be executed in the
form and shall contain recitals sub
