Entitled an ordinance to prevent min ors from drinking in or loafing in or about saloons or from playing any game of chance or other game there in and to inflict punishment for vio lation there of. BE IT ORDAINED BY THE MAY OR AND CITY COUNCIL OF THE CITY OF PLATTSMOUTH, NEB Section 1. That it shall be unlawfu for any minor to drink in or loaf in or about any saloon in tne City of Platts mouth, where intoxicating liquors are sold, or to play any game of chance or any other game therein; or to enter any such saloon except as a duly autb orized agent of his parent, master or guardian of such minor and for a law ful purpose only. Sec. 2. That when any such minor shall have been duly authorized in writing by his parent, master or guar dian to enter any such saloon, for a lawful purpose only, be shall not re main therein any longer than is actu ally necessary to transact the business for which he was sent. Sec. :5. Any and all persons violat ing the provisions of this ordinance shall be fined in the sum of not less than $5.00 and not to exceed $20.00 at the discretion of the court. This ordinance shall be in force from and after its passage and publication for one week. Plattsmouth, Neb., Mar. 20, 1907 To the Mayor and City Council of Plattsmouth, Nebraska: Gentlemen: I herewith submit to you Ordinance No. , prohibiting minors from loafing, drinking or play' ing games in saloons. I find from an examination of the authorities that a minor cannot be ab solutely prohibited from entering a saloon, if he be sent by his parents, guardian or master, for a lawful pur pose. I therefore make the exception in the ordinace, so that all may un derstand what it means and its full scope. I will cite one case as explanatory of the law. In the case of Monaghan vs State, 66 Miss. 513, the court says: "The sale of liquor to a minor as agent for an adult, for whom, and with whose money be procures it, and to whom be takes it, and of which fact the dealer is cognizant when the liq uor is gotten, does not constitute a sale to a minor but is a sale to the par ent. master or guardian." Of course the sale must actually be made in good faith to the principal through the agent. If it should ap pear the minor had no authority to purchase the liquor, the saloon keeper would be liable under the statute and the minor under the ordinance. . . The object of the ordinance is to keep minors out of the saloon, but we can not prevent the parent, guardian or master from using his ward as an agent. The asrency under the ordin ance must be established by the writ ten consent to the parent, master or guardian. This, I think is necessary in order to protect the saloon keeper as well as the minor, and also to assist the city in making its prosecutions for violation of the ordinance. Vandenburg, Tues day evening, when quite a number of their friends dropped in for an even ing's visit. Miss Nettie Neitzel departed for Lincoln, Tuesday evening, where she will nurse a sick friend until out of danger. A party was given at the home of Emil Lau, Monday evening. A good crowd was in attendance of jolly young people, and the evening was spent in proper style. If any of the' nearby towns wish a game of base ball with Murdock, they can write or call up Mr. Dave Thim gan, who Is manager for the locals. On Thursday of last week the Rock Island local, No. 38, sidetracked an El Paso & Southwestern car here, which contained fifty Japanese labor ers, who are now engaged in, putting shoulders on the grade, and after they are finished they will put on rock bal last. The sturdy little fellows are very sociable, and are forming a good impression with the people of this neighborhood. A Good Law. Insurance swindlers who have made t a practice to write bogus policies, accepting the notes of their victims and then getting them cashed at a discount and departing before the fraudulent nature of the transaction is discovered, have played their last card in Nebraska. George Halmes was out of school work for a few days, suffering from rheumatism. A. P. McDonald left Monday for Spokane, Wash., where he expects to spend the summer. Will DeWolf has been very sick the past week with pneumonia but is im proving some at present. W. O. Ogden, living, on the South Side, has been quite ill the past week. Miss Laura Kennedy was taken ill while at work in S. F. Girardet's store Tuesday, and after being revived from a fainting spell, was conveyed to her heme in a carriage. Simon Hanson is reported still aUve and still remains in a critical condi tion. He has not been able to retain nourishment since the fateful day, two weeks ago, when he ate the match heads, and there are no signs of im provement. Convicted of Petit Larceny. A special from Nebraska City, under date of April 3, says: "For two days the case of Edgar Goff was on trial in the district court. He was charged, in company with two negroes, Pearl Burnell and John Price, with robbing a Missouri Pacific car and taking there from a number of pairs of shoes. He and one of the negroes were arrested at Plattsmouth two years ago and sent to the penitentiary and as soon as Goff was released he was arrested and brought here to be tried for the crime committed here. The jury after being out six hours brought in a verdict of petit larceny and the prisoner will get a jail sentence.
