Mrs. Watson did this, but alter a few

Hermann advised him to gi back to
Oregon and get his proof.
DltAMATIC SITUATION'

I'uter testified that he at once called
on Mitchell, who also advised the same
way, after hearing the situation. I'u
ter said he told both Mitchell and Her
mann that it was useless to do this;
that the people who had made the en
tries were scattered, and it would be
useless to try to get proof from them;
beside, he said further, if he did get
them together they would hold him
up for more than he had first paid
him. Ho talked the matter over witb
Mitchell for two Lours, as the result
of which iMtchell went to see Her
mann that day. .That. night, he called
'on Mitchell' and had : another confer
ence with him.
It was at this conference, he said,
that he took out two $1,000 bills and
laid them on the table in front of
Mitchell, saying that this amount rep
resented all that he(Futer) could spend
on the claims, and get out whole if
he got the patents. He testified that
he told Mitchell to take the money and
ge the patents. He said that Mitchell
took one of the bills and tossed it over
to Filter, saying that Puter could not
afford to spend so much.
Puter said he tossed the bill back,
and it passed several times in this
way. Finally, Puter testified. Mitchell
took both bills and kept them, and said
he would see What could be done.
Mitchell called on Hermann that day,
and then advised Puter to call off him.
This Puter says he did, and Hermann
told him. that he thought things could
be arranged so that the patents would
issue. He said he had taken the mat
ter up personally. The witness testi
fied that Iitehell saw Hermann again
t'"e next day, and later that day I'u
ter met Hermann on the street. Her
mann shook hands with him. he said,
said he had seen Mitchell, and that his
patents would be issued.

STULL GRANTED NEW TRIAL
After Hearing Arguments on Motion Made
by Defendant Court Sets Aside Verdict.

After bearing the arguments Fri
tion for anew trial in the criminal
case of State. vS C. L. .Stull, the court
set aside the verdict of guilty returned
by the jury, and granted the defend
ant a new trial, which will be had at
the September term of district court.
The trial, which was had at the
February term of court, and in which
the jury found Stull guilty of assault
to commit great bodily harm upon a
young man namea Jesse tureen, at
tracted wide spraad attention, and
was attended by many citizens.
Among the reasons advanced by A
N. Sullivan for tha defendant, in the
motion for new trial, was that the
verdict given appeared-to have been
rendered under the inlluence of pas
sion or prejudice, and that the verdict
was not sustained by sufficient evi
dence The trial of John SebestB, sr., et al,
vs The Supreme Court of Honor, a
fraternal organization, was concluded
at the session of district court held
yesterday afternoon, and the case sub
mitted to the jury, who after being
out but a short time returned a ver
dict awarding the plaintiff a judg
ment in the sum ot $1,197.56, which
was accepted and tiled by the clerk
and thfe jury discharged ri -
The above suit was brought by the
legal heirs of Antone Sebesta to re
cover $1,000 on a death benefit certifi
cate issued by the defendant, the
Supreme Court of Honor. At a former
trial before a jury, the plaintirTs were
awarded judgment, but the defendant
appealed to supreme court, where the
verdict was reversed and a new trial
ordered.
The following gentlemen composed
the jury who tried the case: B. W.

Bartlett, Walter Barker, Wm. Niday,
A. C. Tulene, J. D. Bramblett, F. A
Cremer, J.JH. Salsbury, F. A. Davis,
Fred Denson and John Busche.
After a jury had been selected and
sworn in to hear the case of Bank of
Cass county vs J. H. Hall and J. M.
Craig, the plaintiff moved that the
case be dismissed at its costs except
cost of deposition taken by the defend
ants. . The case having been settled
out of court, the jury was discharged.
The action was brought to recover
judgment on two promissory notes
given to the plaintiff by the defend
ants. The settlement of the aqove case
brought to a conclusion the jury term
of district court, and the jurors were
accordingly discharged and allowed to
return home. Court adjourned this
noon until Wednesday, Judge Jessen
and Court Reporter Tuggart returning
to Nebraska City this afternoon.
