chased of J. D. Sumner the eighty just
southeast of town.
Alvln Ileiter loaded his household
goods Into a car Saturday and shipped
them to Orchard, Colorado. Mr. and
Mrs. Keiterand Frank Ileiter left for
there Monday.
Mr. and Mrs. W. F. Matson returned
the latter part or last week from
Washington. They are thinking or
buying property in Eagle to make
their home.

Andy Hess was thrown from his
wagon on Thursday of last week In a
runaway just east of town. Mr. Hess

Mrs. W. I!. Stull (formerly Mrs.
Webb) was plaintilT and sued the

The plaintiff secured a judgment nt

made during the proceedings of the
former hearing. The ease was called
yesterday afternoon in tlie district,
court of Mills county, Iowa, at Glen
wood and the following from the

extent why the defendants were wil ing
to compromise the mat ter.
"Judge Green this afternoon over
ruled a motion for a change of venue
on the part of the company. 'I be
change was asked for on the grounds
of undue influence In Mills county on
the part of the attorneys for the
plaintilT, Genung&Genung. Gillilland
& Logan and Matt Gerlng."
It seems that when the above ruling
was announced the attorneys for the
defendant began a consultation with
the plaintiff's attorneys, and It was,
not long before terms of settlement'
was reached, by the payment of $:i,ooo
to the plalnt'fT, she nnvlng her own
costs In i he matter and the railroad
company paving tbeir own costs.
Thus another Important damage
suit against, tlie liurhiigton has been
erased from the court dockets after
running through several terms, and
which should have been settled before
they had been even entered upon a
court docket.
