Polk departed this morning for Gosper county to try a law suit in the district court at Elwood. John Boetel and Miss Gorman, both of this city, were united in marriage this afternoon by Judge Archer. John Knabe made an appearance yesterday in the criminal case and secured a continuance for thirty days, his brother Henry, going surety for his appearance. The old merry-go-i ound which was stranded here over a year ago is being moved out, a man named Gus Holen l)urg of Knox county, having traded some land for it. W. L. Pickett and family have re moved into the Sura Patterson resi dence on Vino street next to the old Herald office. The residence was made vacant by Mr. and Mrs. Patter- . son's removal to Lincoln. Superintendent Hawksworth re turned home last night from Fort Madison, Iowa, where he had been called to attend the funeral of his brother John, who was a well-known engineer on the Rock Island. Mrs. Fred Beaken and three children of Fulton, 111., arrived in this city yesterday and are visiting with the family of Mr. R. B. Carlyle. Mrs. Beaken's husband is on his way to this state. They will make Nebraska their home. Mrs. Paul Gering and her nephew, Washington Pfeiffer, with his family from Bologna, Italy, stopped in Wash ington today to witness the inaugura tion ceremonies. Mrs. Gering is ex pected home in a few days, after an absence of several months in Europe. Mrs. F. S. White, whose elegant china painting has won prizes, and much favorable comment at request of tho Omaha society sent a beauti ful plaque this morning, up there when it, with others, will be sent to Nashville, and form a part of a fine exhibit at the Tennessee Centennial exposition. Plead Ouilty to the Charge. George Reynolds and Daniel Folson, the two men from South Bend pre- inct who lured away a B. & M. steel rail to break stalks with, were up be fore Judge Archer today. Both plead uilty, restored the property which they claim was only borrowed and the court fined each a dollar and costs. which was paid. Tho con firmation by the senate yesterday of thirty -one nominations of presidential postmasters is expected to be unavail ing so far as about twenty-six of them are concerned. The obstacle is tho fact that the filing of a bond is a pre requisite of tho issuance of a commis sion. The Missouri Pacific bonds, voted hero a few years ago, were sold for cash and ttas money used to buy right of way by private individuals which right of way was turned over to the Missouri Pacific. Is is now claimed that these bonds are of no value and should not be paid, and a case from Otoe county now in tho supreme court will probably settle the matter. A correspondent in the Nebraska City Press 6ays. In tho supreme court on Tuesday the case of J. Sterling Morton and others against the county commissioners of Otoe county was argued and submit ted. This is the action brought in the district court of this county some time ago by tho plaintiffs to enjoin the collection of the tax levied to pay the principal and iuterestof the Missouri Pacific railway bonds, upon which a hearing was had before Judge Chap man, who refused to grant tho injunc tion and the application dismissed for want of equity. . From that finding of tho court the case was taken to the supreme court and it is contended thero that the bonds aro void, whoever may own them, because they were not issued in aid of works of internal improvement, but to reimburse private citizens for monies expended and obligations as sumed for the benefit of a private cor poration, and because furtber. the bonds were voted and issued by a pre cinct Dot organized legally. "In reply thereto the county com missioners contend that the bonds show on their face the purpose for which they were issued, and after allowing the same to be hypothecated and pass into the hands of innocent purchasers, and paying interest there on for ten years, the plaintiff should not be permitted to maintain that the same are illegal and void that in com pliance with the law then in force the bonds were legally voted by the citi zens of Nebraska City precinct and issued for the purposes intended, and that Nebraska City precinct was or ganized according to law. An early decision is anticipated in the matter n tho supreme court. It is believed by your correspondent that the deci sion of Juage Chapman will be re versed." Wood of Mount Sterling will succeed J. S. C. Blackburn in tho United States senate by appointment of Gov ernor Bradley, to be announced prob ably tomorrow. Tho appointment was decided upon after the governor had offered tho honor to St. John Boyle of this city, who refused it. Boyle was the republican caucus nomi nee at the last session of the legisla ture and his action indicates that he hopes to bo elected to serve the full term by the special session of too legislature, which Governor Bradley will call within a few days. Decatur, Neb., March 3. There was recently cut down on one of the town, lots of Mr. James Ashley, a wealthy land owner of this place, a very large cottonwood tree, measur ing at tho butt five feet through. It was cut up into stove wood lengths, and in the center of the butt was found a well preserved monkey wrench. The tree is forty years old, if a day. Mr. Canfield, cashier of the City bank, unravels the strange mystery. Ilo is a pioneer settler of this place and was one of three men who could claim tho honor of being the proud possessor of a complete kit of carpen tor tools. A Mr. Thompson built i house on this lot, and shortly after its completion Mr. Canfield and his famiiv moved in. To the left of the house were some switches miniature cottonwooJ trees. His only little girl borrowed the tool one day and in the evening it was missing. A search was instituted, but tho monkey wrench was never seen afterward. The supposition is the little girl hung the wrench in the crotch of one of these trees and it grow there. You will find a lull line cf Mrs Crawford's pickles at Zuckweiler & Lutz's.
