I. 1S37, pursuant to the call of the county clerk, to consider the propriety of constructing county buildings, and received a proposal from L. G. Jeffries to build and furnish a court house for the con sideration of thirty lots in Platts mouth, belonging to Cass county, N. T. Court then adjourned to meet at 1 o'clock. After again considering the pro position of L. G. Jeffries, agreed to accept the same and signed articles for a court house to be built, furnished and completed by the first da- of December. A. (After the general routine of busi ness as appears on record the fol lowing levy was made, being the first lev3' made in Cass county June 25, 1S9L County Clerk.) "It is ordered that a tax be levied for various purposes as follows: "Territorial. 3 mills on the dollar. "County, 6 mills on the dollar. "School, 1 mill on the dollar. "Road, 1 mill on the dollar. "Resolved. That we. the county commissioners of Cass county, do hereby order and appropriate so many of the lots in the city of Plattsmouth (belonging to the count of Cass) as may be necessary to build a temporary Court house in the city of Plattsmouth, Cass county, N. T., of the following di mensions, to-wit: fourty-four feet long by twenty-four feet wide. m-o storie high, the lower story to be divided into four rooms, with a hall in the center, the upper story to ln all in one for a court room and other purposes all to be com pleted this summer. And we do hereby appoint and authorize Jacob Vallery to procure the aid and assistance of a compet ent draftmati to make a draft and plan for said house and to advertise the same to be let on next Saturday it which lime the commissioners have agreed to meet again. The court then adjourned till next Sat urday, 22nd inst. at l o'clock a. in. J. N. Wish, . clerk commissioners. Seventh session of commissioners, vol. 1, p. in. We find the following: "It is hereby ordered that Jacob Valley be and is h.'leby authorized to" pro cure a room suitable for the diiler ent county officers, for which the county has to provide. lie is also authorized to procure for each of said oflicers one table and desk (or bookcase) not to cost more than twenty dollors each, also to procure one dozen chairs for the use of said offices. April 2, l.sns - County commis sioners met pursuant to call of county clerk on Tuesday April 20th, lNfiO; present Jacob Vallery, William Young and Iv R. Davis. (Among other thits we find the following) "The commissioners then took into consideration the propriety of erecting a court house at the ex pense of thirty-four lots of the county being those already entered ami an additional amount of two thousand dollars subscription to be made up by the citizens of Platts mouth. After considering the matter at some length, it was ordered that the county clerk be authorized to get one hundred notices printed and to cireualte the same for the reception of proposals and drafts and speci fications for said building. A court house was then began by one F. R. Dertiardiu, upon the court louse square, and built during the year 1S.1S, and at the July session 18.")S. we find the following entry in Vol- 1, Page 4o. "The foundation wall being completed according to contract of the new court house the contractor, K. R. Hernardin, asks for deeds for certain lots in accordance with the commissioners." (It here sets up the lots.) It will be remembered that the said court house was completed to the first story and then was swept away by a wind storm and it was not rebuilt. Tlio records show (Vol 1, Page 2S1) that bids were received for the cleaning up of the ruins of the court house that was built, Au gust 1st. 1SG1. The county officers during the several years previous to 1M4 had their offices in different rooms about the city of Plattsmouth. and anoth er move towards getting a court house was made in 18ti3 as follows: March term, 1SG3. vol. 1, p, 420. - The hoard deeming the county records and other valu able papers and books, belonging to the county, in imminent danger of being destroyed by fire, in con sequence of the exposed condition of the building now occupied by the several county officers; and having on hand a considerable amount of county and territorial funds, belong ing to the court house fund, in structed the county clerk to ad vertise for proposal for the erection of a building for county offices and court room, on lot 8 in bl'k No. 30, Plattsmouth, City; as per plans and specifications of the same on file in the county clerk's office; the kind of pay to be one-third cash, one third territorrial, and one-third county warrants court then ad journed till to-morrow L. G. Todd, Ch'm Co. Com. B.' Spuklock, County Cashier Vol. 1, p. 435 May term A. D. 1891: Commissioners met in regular ses sion, present L. G. Todd, Jacob Vallery and Win, L- Thompson, commissioners, when the following was done to-wit: The first business of the session was the consideration of the con tract for building the court house. The article of agreement drawn by J. N. Wise was presented and af ter careful examination by the board and the contractor (K. R. Her nardin) was signed by both parties to the contract and filed in the clerk's office. The contractor then presented his bond which was ap proved by the board and filed with the county clerk, which concluded the contract. Thus was began the second court house that was built in Cass county and the latter was erected upon the present court house ground and was a structure 2t0Oft. with a story above which was used as a court room, and two rooms beneath which wtre tised interchangeably part of the many years, from lMi4 to the present time for treasurer's and county judges office. and some years for sheriff, register of deeds and clerks office. At the October term of commis sioners lH'ii, Daniel II. Wheeler came before the board in behalf of the A. H. & A. M. and I. O. O. K. lodges of Plattsmouth City and made a proposition to the board that the said lodges, in consider ation of the use of the upper floor, or court room of the new court house for lodge purposes, they would finish, complete and fix'up in good shape for court purposes, the entire upper lloor of said court house. This proposition was ac cepted by the board and the same lodges used the rooms for several years for lodge meetings. On March 5, 1SSO, the citizens of Plattsmouth, made a proposition to the county commissioners to erect a court house free of cost to the county. The following is a copy of the proposition: To the Hoard of County Commis sioners, of Cass County: "The undersigned, a committee having in charge the proposition lo erect a public building and do nate the same free of charge to the county of Cass for court house purposes having raised a large amount of money by subscription for the purpose of building and completing said structure are in structed to submit to your honora ble board the proposition. Will the county commissioners of the county of Cass, accept said building free .of cost to the county for court house and county office purposes when the same is com plete d. Fra.VK CARRI'TII. j H. This was the last attempt to build a court house in Cass county until a petition was presented to the commissioners at their regular meeting in May. 1889, asking that they call a special election to vote bonds to the amount of $SO,0C0. On May 9. 1889 a special election was ordered called to be held June 8. 189. The result of the election was as follows: For bonds 3.078 votes. Agiiiiist bonds. . .2.87.") Heing a majority in favor of bonds of 208 votes. The election was contested by the citizens of the western part of the county and a trial was had during the month of November 1889, in the district court of Cass county before Judge Hroady of Heatrice, Nebraska The contestants were represented by K. if. Wooley, of Weeping Water and the contestees were represent ed by A N. Sullivan, Hyron Clark, J. H. Strode and County Attorney Mafliew Gering. It was the largest case of the kind ever known in the history of Nebraska and lasted over nine days. Over 75 wituessss were examined and after taking the case under advisement for several days Judge Hroady set the election aside thus defeating the validity of the bonds. An appeal was takeu by the county commissioners from the decision given by Judge Hroad, to the supreme court of Nebraska and the case was reversed by the su preme court of November 25th A. D. 1891, which made the bonds good when issued, The commissioners therefore is sued and put upon the market 80 bonds of $1000' each due in 20 3ears. The bonds were sold at par value in January 1891, and proceeded to advertise for bids for the building of a court house. The contract for the arcitectural work was let to Wm. Gray of Lincoln Nebraska who completed his work for the said building to the satisfac tion of the board. The contract for the building was let to O. J. King, of Omaha, Nebraska, he being one of nine competitors for the work, for $V7.910. The first earth was broken for said building about the first day of April. 1891 and at the present time. (June, 25. 1891) the first story is nearly completed.
