CLAIMS IT WASN'T LEGAL, In the Bond Case Plaintiff Attacks tho Validity of an actofthe Last Legislature- They Make no Direct CLarge but Wade in to the Statute Under Which the Bonds Were Voted C. N. Baird et al vs- the Commis sioners of Cass County. The application made at Lincoln yes terday before Judge Field for a tempo rary injunction to enjoin thi county commissioners from issuing the bonds to build a court house recently voted, was brought under the title of "C. N. Baird ct al vs. the conimiirsionei K of Cass county" Mr. Baird is cashier of the First National bank lit Weeping Water, while the et ul is doubtless intended fr various mem bers of the Weeping Water town site company. No direct charges were made that would cause the .court to blush, or wonder why the heathen rage and imag ine ynin things, but with a bare arm they plied the knife of dissection to the law and accused the last legislature of making an illegal amendment. Messrs. Wooley and Webster were attorneys for plaintiff. Wooley held his peace, however, and Mr. Webster done the talking. In their petition filed they attacked the validity of an act of the last legislature iimauding the second subdivision of section chapter l'-, of the statutes of Nebraska, which provides the dutic3 of county boards ;n the erection of county build ings and makco majority vote legal. On this charge they take ih.tz grounds. First: The act (title not broad enough doc nit include this subject of county building.-. Second: Tins amendatory &ct ;jst pas scd does not refer to the section to be f.m ended, as provided by section 11 of article i; of ihe cfatutes. Third; The provision n that subject ,;7;loii n-i to voting bonds was not ger mane to the su:;,:ct 'f ",u section which purports to have beeii amended. And the second subdivision as amendeu is in conflict with section SO of the same chapter, which provides for a two-thirds vote and that it does not purport to re peal said section :)0. A. N. Sullivan, Byron Clark and Matt Gering all made remarks in reply to tho charges by Webster. The application with the petition prayed for a temporary injunction, which was probably granted to-day, and it is the usual practice to allow a temporary injunction unless the claim it is brought for is friyilous. However, the. pai t'es have entered into a stipulation to try the case in the courts in this city on a demur on the Sth of July,aud the party defeated will go to the supreme court from which a hearing can be had by September. At the adjourned session of the city council held last night there were present Mayor Richey, Clerk Fox, and all coun- cilmen. The finance committee presented a re solution levying upon the dollar valua-; tion of the city as follows: Genrnl fund, oj mills; B. & M. R. R., 2 mills; high school bond, 4 J mills; streets, grading and bridging, 5 mills; lire hydrant rent al, C mills; Kcarton bonds, 1 i mills; storm water sewer, 4 mills; intersection paving, 1 mill; fire and water, mill; gas and electric lighting, 5 mills, making a total of 30 mills. This resolution was adopted. The leyy is for the year com mencing on the first Monday in August. On motiou of Mr. Murphy the board of public works was instructed to move the dirt cn Marble street, west of Sixth street aud on the east side of Sixth slope the sidewalk, so that the approaches from either side will conform with the grade of the street. Committee on streets, alltys and bridges was instructed to widen Sixth street, between Vine and Oak, at once. But it did not, the council being restrained by injunction. The case brettly is: The contract under which the sewer was built made Haubens & Shelton liable to protect the city from any damages to come, from the construc tion of tho sewer, to any property or im provements, and a bond of $15,00(1 se cured the faithful performance of the contract; Messrs. Tiieo. Oleson, Nathan Sheltoti and O. II. Ballou being the bondsmen. The council withheld a twentieth part of the total cost of the sewer as a security until the sewer should be proven thoroughly efficient in service and substantially built. This hus been done and the money was due on June IK But, meanwhile, damage claims of $1, 200 by II. Boeck, $:!00 by E- G. Doyey & Son and ir-iO by 4. W. White were tiled with the city clerk, aifd Mr. Boeck's claim carried into the court. At !):2U o'clock this morning, an alarm of fire from the third ward called out a large number of citizens and firemen. The cause of the alarm was the burning of a small house on Ninth street, beyond Gold, belonging to Mr. Billings and oc cupied by Mr. and Mrs. E. M. Gray, who is employed in the hammar gang, in the shops. Mrs. Gray was in the house work ing and not aware of fire overhead till alarmed by neighbors. At the time of the alarm the whole garret was on tire. Neighboring men and women soon emptied the t.vo rooms of the house of their col tents, and an alarm telephoned to Main street. The building was two blocks from any hydrant, but the S-cond and Third ward hose carts were soon at hand and by colliding their hose had a stream of water flowing on the flames five minutes after the ringing of the fire bell, and in five more minutes the fire was out; the roof and upper part of the walls being burned. An unoccupied house north of the burned one might have been consumed had it not been for the hose service. Damages were proba bly $150. Notice to Contractprs.
