Charley Black held ticket No. 5, and
was declared the lucky man. They not
only drew for the stove alone, but there
was $15 worth of other furniture with
it. such as boilers, kettles, etc. The

THE DR. FISHBLATT CASE.
The Facts
in the Matter

We made imjuiiies today rela
tive to the suit between Daniel
F. Kiser and Dr. Fishblatt. We do not
belk'VC in trying to prejudice the minds
of the public relative to any issue tc be
tried before the courts before a hearing
has been had. In this case, however,
the Journal seems desirous of agitating
the matter, and trying to prejudice the
public prior to any hearing in court.
From an examination of the pleadings
filed in the case, we learn the following
facts, viz :
That on February 24th, 1883, Daniel
F. Kiser gave four notes for fifty dollars
each, payable in thirty, sixty, ninety
and one hundred and twenty days, re
spectively, and to secure the payment
of the same gave a chattle mortgage on
a team of horses; that the notes were
not paid when due, nor any part "ot
them, and were placed in the hands of
Strode & Clark for collection; that to
prevent the taking of the team on the
chattle mortgage, Kiser begun a suit
and obtained a temporary injunction be
fore County Judge Johnson. lu his
petition upon which the temporary in
junction was allowed, Kiser alleges
that Dr. Fishblatt received the notes in
consideration of treatment for deafness
and that the doctor contracted to cure
him in eight months. He alleges that

for a short time, hi tenth became seri
ously allected. and his mind Hrrioudy
imfiaired, and that th effects of the
medicine were such that he was com
pelled to abandon It. He sues for dam
ages caused by the same in the sum of
one thousand dollars. Kiser further a!
leges that the doctor is an itinerant
quack and a fraud and wholly insol
vent.
The doctor in answer says the treat
ment was not lor nearness but lor '
private raalady.which we prefer not to
name. That the patient, Kiser, agreed
to report thn result of his treatment
from time to time and receive further
instructions. That the patient failed
to report and soon abandoned the treat
ment. The doctor denies the allega
tion that he is a quack and a fraud but
alleges he is a graduate of a medicu'
college, has his diploma and has been
n active practice for several years.
The doctor alleges in his auswer that
he is not insolvent, but is financially
able to respond iu anydamages to which
the plaint iff may be entitled upon a
final hearing. He is corroborated in
this statement by the affidavit of
Joseph II. Millard who says the doc
tor has property, money and credits in
the city of Omaha to the amount and
value of $10,000.
Strode & Clark filed a mo ion to dis
miss the injunction and the motion
was argued before Judge Pound in
Lincoln last week.
From Mr. Strode we learn that the
njunction was sustained but Judge
.und said it was going a long way
to do so, but he would in this case do
so on condition that the nlaintilf.
Kiser, gave security in the sum of
$400 and if he failed to give the se-
urity in ten days then the injuction
to be dissolved. Judge Pound san
he would not have sustained the tern
porary injunction were it not that by
Kiser s giving good security the doc
tor would lose nothing in the end
should he be entitled to a judge
ment upon the final hearing. Ho
further said all the issues could be
tried in one suit and thereby save a
multiplicity of suits.
The Journal intimates that Judge
Pound has disposed of the whole
matter except the claim of Kiser for
damages when in fact he has decided
nothing except to continue the in
junction restraining the doctor from
selling the team under the chattle
mottgage, upon condition that Kiser
give security in double the amount
of claim against him. These are the
facts as we have been able to find
them.
The trouble between our Bohemian
friends was finally settled among them
selves without the aid of the "coort,"
which saves them considerable money
and possibly ill feeling. They used
poor judgment In getting into a diffi
culty, but good judgment in settling as
they did.
