Motion by Dierking, seconded by Davis that the following Re solution be adopted RESOLUTION Whereas, Holt County Welfare Warrants, No. 2173 and No. 2174 were issued to William Kipple and Lela Bessie Kipple on 3-16-61 in the amounts of $55.60 each, and Whereas, said warrants No. 2173 and No. 2174 have not been presented for payment, eight months after date of issue and, Whereas, the State Depart ment of Public Welfare now re quests that these two warrants numbered 2173 and 2174 be can celled. MINUTES OF MEETING OF SCHOOL BOARD OF DISTRICT NO. 49 OF HOLT COUNTY, NEBRASKA Nov. 10, 1961, a meeting of the newly appointed School Board of School District No. 49, of Holt County, Nebraska, was held, and the Board met in executive ses sion. Present: William Hibbs. President, Albeit Derickson, Sec retary and Joe Kubik, Treasurer. Absent: None. The meeting was called to or der by the President, and the matter of submitting the issue of building a new school house and voting upon a special tax levy for a sinking fund for such purpose was discussed, together with the necessity of selecting and designating a new school site within said district. Thereupon it was moved by President Hibbs, that a special meeting of the Electors of School District No. 49, be called by this Board, the same to be held on the 21st day of November, 1961, at eight o’clock P.M., in the Ash Grove Community Hall within said School District No. 49, and that the Secretary of the Board be instructed to immediately post legal notices of such Special Meeting. The purpose of such special meeting, and the business to be transacted there at, and the information to be set forth in the posted notices of said meet ing, shall be as follows: The purpose of the meeting is to vote on the proposition to build a new Schoolhouse in District No. 49, and to vote a special tax to be levied over a period of not more than ten years, sufficient to raise the sum of not to exceed $18,500.00 said tax to commence in the year 1962, for a sinking fund for the construction and the equipment of said Schoolhouse, such tax to be not more than five mills annually, and to authorize the School Board to proceed im mediatelv with the acauisition of a school site and with the con struction and equipping of said School House, and to authorize the issuance of warrants to pay the costs thereof as provided by law, and to select and vote upon a site for the new School House within said School District. And that the foregoing proposi tion be submitted at said special meeting of the electors of said District for their approval or re jection. All members present voting in favor of said motion, the same was duly passed and adopted. Upon motion the Board ad journed. Dated this 10th day of Novem ber, 1961. HELD BY THE ELECTORS OF SCHOOL DISTRICT NO. 49. OF HOLT COUNTY. NEBRASKA ON NOVEMBER 21. 1961 On November 21. 1961. at eight o'clock P.M., the legal electors of School District No. 49 of Holt County. Nebraska, met in a spec ial meeting, in the Ash Grove Community Hall, within the boundaries of School District No. 49. as now constituted, pursuant to the notice and call for such meeting, a copy of which ia at tached hereto. At such meeting 61 legal electors were present and attending. The School Board of District No. 49. to-wit: William Hibbs, President. Albert Derickson. Sec retary and Joe Kubik, Treasurer, were all present. The meeting was opened by President Hibbs, who declared the same ready for the trans action of business. The President ordered the Sec retary to read a copy of the no tice of this Special Meeting, which was done, and the same was ordered filed and made a part of the records of the School District. A true copy of such no tice of Special Meeting, together with certificate of the Secretary, is attached hereto and made a part hereof as an Exhibit. It was next announced by the President, that voting upon all issues before the meeting would be conducted by written ballot. Thereafter, and following a general discussion, it was moved by Bill Hansen, that the site for the location of the School House in District No. 49, be determined and fixed as the Southeast Cor ner of Section 33, in Township 31, North, Range 9, West 6th PM., in said District No. 49, within said District. The motion was seconded by Emmet Re veil. There being no other or further motions the bal lots were distributed, cast and tallied, and the vote on said mo tion was as follows: For: 47 votes. Against: 12 votes. Said motion having received the af firmative vote of more than 55% of the electors present, the Presi dent, declared the same duly passed and adopted, and the site of the Schoolhouse fixed as: Southeast Comer of Section 33, in Township 31, North, Range 9, No. 49. Thereafter it was moved by Bill Hansen, that the School Dist rict No. 49 of the County of Holt, proceed to construct, erect, and equip, a new School House, of frame construction, according to the plans and specifications in the hands of the building com mittee, the total cost of said con struction and equipment, not to exceed the sum of $18,500.00, and that for the purpose of paying for said school building and equipment, said School District No. 49 levy a special tax, in ad dition to all other general and school taxes in the amount of four mills on the dollar upon the assessed value of all the tangible property in such district, except intangible property, for a period of ten years, said levy and tax to commence in the year 1962 for the purpose of providing a special fund for the payment of the cost of construction and equipment of the aforesaid School Building, and the interest on any warrants issued thereunder, and that the School Board of said District be authorized to at once proceed to carry out the purpose of such levy, and to construct and equip said School House, and that for such purpose, the school board be authorized to issue war rants, as needed, not to exceed eighty-five per cent of the amount to be raised by said levy, against the fund voted, and the interest on any such warrants, to be paid annually. This motion was sec onded by Ben Vonasek. Ballots were thereupon distrib uted, collected and tallied, and the result of the vote on said mo tion was as follows: For: 50 votes. Against: none. The President thereupon declared that such mo tion and proposition had received the affirmative vote of more than 55 percent of the electors present and voting, and that the same was duly passed and adopted by said School District. Secretary RESOLUTION WHEREAS, there has been presented to the Board of Super visors of Holt County, Nebraska, a duly certified transcript of the proceedings of Special Meeting and election held by the Electors of School District No. 49 of Holt County, Nebraska, on November 21, 1961, wherein the Electors of said School District Have, ac cording to law, voted to l>uild a new’ school house in said District at a cost of not to exceed the sum of $18,500 00, and to equip the same, and for the purpose of paying for said school building and equipping the same, said school district has voted to levy a special tax in addition to all /\fhnt» eoh/vil to vnc in Hut om/\iint of four mills on the dollar upon the assessed value of all the taxable property in such district, except intangible property, for a period of ten years, said levy and tax to commence in the year 1962, and, WHEREAS, the Board of Supervisors have carefully re viewed the records of said pro ceedings, and has found the same to be legal and in all respects to comply with law, and has ap proved the sanve in all par ticulars. NOW THEREFORE, l>e is re solved by the Board of Super visors of Holt County, Nebraska, that the action of the electors of said School District No. 49 be, and the same hereby is ratified and confirmed in all respects and particulars, and that the record of such proceedings shall be en tered upon the records of the County Board, and that there shall hereafter be levied, com mencing in the year 1962, a special tax in the amount of four mills on the dollar upon all of the taxable property in such School District No. 49, except intangible property, for a period of ten suc cessive years for the purposes aforesaid, and that said School District shall be authorized to proceed with the purchase of said School House and the equipment thereof, and that the School Board of said District be and the same is authorized to issue war rants for such purpose, all as provided by law. A roll call vote was taken thereon, which resulted as fol lows: AYES: Dierking, Flood, Smith, Ernst, Davis, McConnell. NAYS: None. Whereupon the Chairman of the Board declared said Resolu tion had received more than a majority of the affirmative votes of the whole Board, and the same was duly passed and adopted. 5:00 P.M. Holt County Board of Super visors met as per adjournment. All members present except Ernst. Meeting called to order by the Chairman. Minutes of the pre vious meeting were read and approved as read. The Finance Committee re ported that the fees of the var ious County Officers have been remitted to the County Treasurer, as required by law. 11:30 A.M. This was the time set for the Hearing on the an nexation of the following territory to the Spencer Rural Fire Dis trict, beginning at the South west comer of Section 19, Town ship 32, Range 11, running thence one mile east, thence one mile north, thence two miles east, thence one mile north, thence one and one half miles east, thence north to the south bank of the Niobrara River, thence running northwest along the south bank nf tho MinKrora Ptt/nr fA kaH section line in Section 30, Town ship 33, Range 11, thence south a distance of approximately five and one half miles to the place of beginning. No one appeared for the Hear- j ing and after consideration by the Board, motion was made by Mc Connell, seconded by Davis that the prayer of petition be granted. Motion carried. 12.00 Noon. This was the time set for the Hearing cm the closing of the section line between Sec tion 34, Township 31, Range 14, and Section 30, Range 14 Mr. Lee appeared before the Board representing Mr. Curry and Mr. Trowbridge, Mr. Ohde, Clerk of Atkinson Township ap peared on behalf of the Atkinson Township board. After discussion motion was made by Dierking, seconded by Davis that the Peti tion be denied. Motion carried. 2:00 P.M. This was the time set for hearing on the map of the County Road sysytem. Petition was filed to add to the County Road system beginning at the Northeast Comer erf Section 6, Township 30 North, Range 15, West of the 6th P M , In llolt County , Nebraska After discussion, motion was made by Smith, seconded by Dierking, to continue the Heanng to January 9. 1962 at 1:30 P M Motion carried. Motion by Flood, seconded by Dierking to grant the Sheriff authority to cancel distress war rants two years or older on de ceased persons and persons moved from the County and where abouts unknwn.
