the Qty at O'Neill in the County
of Holt in the State at Nebraska,
met at the Qty Council Room on
the 3rd day of November, 1959 at
8 00 o clock P M in regular ses
sion, the fbllowing being present

ORDINANCE NO. 329-A
An ordinance of the City of O -
Neill, Nebraska, to effectuate ^the
provisions of Legislative Bill 719,
enacted by the Sixty-ninth Session
of the Legislature of Nebraska,
with the emergency clause and
thereafter approved by the Gover
nor of the State so as to permit
the conducting of the game of
••BINGO” within the purview of
such enactment, within its cor
porate limits; providing that an as
sociation or entity designated in
Section 3, of such enactment, and
licensed to conduct the game of
•'BINGO'' by the State within the
corporate limits of the City shall
obtain a permit from the govern
ing body of the City for that pur
pose before commencing opera
tion; designating the permit fee;
providing that the association con
ducting the game of "BINGO
within the City shall pay a tax
of ten per cent of the gross receipts
from such game, payable quarterly
to the City Treasurer, on or be
fore the 10th day of the immediate
ly, succeeding calendar quarter,
and when collected, such official
shall forthwith remit to the Dir
ector of the Department of Agri
culture and Inspection of the State
of Nebraska, one half of the same
and credit the balance to the
General Fund of the City; provid
ing for a written quarterly re^irt
by the association or entity con
ducting the game of "BLNGO
within the City to the City Clerk
containing a detailed financial
statement of each separate Session
i>f "BINGO" conducted under said
permit for the period of the re
port ; enacting by reference as a
part of the ordinance, all precisi
ons of the statutes of Nebraska
applicable to conducting the game
of ''BINGO" within the City, and
providing that a violation of such
txirtion of the ordinance shall con
stitute a criminal offense against
the City as well as the State of
Nebraska, for which the violator
may lie prosecuted and punished
upon conviction, in a separate pro
secution by the City; providing
penalties for its violation; repeal
ing all ordinances or parts of or
riiiuinres in conflict therewith; and
providing when the ordinance snail
become effective and declaring an
emergency.
WHEREAS, at the regular state
election held on November 4, 1958,
the Electors of the State of Ne
braska, through the initiative pro
cess, enacted an amendment to
the Nebraska Constitution authori
zing the conducting of the game
• BINGO" within the State by cer
tain designated entities, but which
amendment was not self-executing
and required State legislation to
effectuate; and . _
WHEREAS, the Sixty-ninth Ses
sion of the Legislature of Nebras
ka, has enacted legislative Bill
719, with the emergency clause
and the same has been approved
by the Governor of the State and
is now in full force and effect
which effectuates said const it uional
amendment; NOW THEREFORE,
BE IT ORDAINED BY THE
MAYOR AND CITY COUNCIL
OF THE CITY OF O NEILL. NE
BRASKA. 4.
Section 1. The word associa
tion" as used in this ordinance
shall mean any board, socien.
corporation, church, or other en
tity that has been duly licensed
bv the State of Nebraska to con
duct the game of "BINGO with
the State. . . , .
Section 2. An association duly
licensed by the State of Nebras
ka to conduct the game of bingo
within the corporate limits of the
City shall obtain a written permit
therefore from the Mayor and
City Council before commencing
operation of the same. Application
for such a permit shall be in writ
ing and filed with the City Cleik
on such form as he shall prescri
be who shall issue such permit
when directed by the governing
body of the City to do so. Such

The fee for such a pernjit. or each
renewal the reof, shall be the sum
of Ten Dollars ($10.00» which the
applicant shall pay to the City
Treasurer just prior to filing its ap
plication for such permit; or re
newal thereof, and a receipt for
payment of the same shall lx* filed
with the application. When a per
mit is issued, the City, Treasurer
shall credit such fee to the Gener
al Fund of the City. The permit
shall at all times be displayed
conspicuously at the place where
the game of “BINGO" is con
ducted.
Section 3. No permit for con
ducting the game of “BINGO"
shall thereafter be issued by the
City should a majority of the quali
fied electors of the City voting
thereon at the election at which
the proposition was submitted de
termine that the game of "BINC.O"
should not lx? conducted within
the City, until the same quota of
the qualified electors of the City
again authorize the operation of
the same.
Section 4. Games of Bingo
shall lx> conducted within the City
strictly in accordance with all or
dinances of the City, not incon
sistent with the Statutes of the
State.
Section 5. Any permit issued
under the provisions hereof may
he revoked or suspended by the
Mayor and City Council for cause,
when the state license of the as
sociation has been revoked or
suspended, but such revocation or
suspension order shall be identical
in substance with that issued by
the State of Nebraska.
Section 6. A tax of ten-per-cent
of the gross receipts of each li
cense association from the con
ducting of the game of "BINGO"
within the City, is hereby im
posed and levied against each
such association, payable on or
before the 10th of the immediately
succeeding calendar quarter, to
the City Treasurer, when col
lected, cine-half of such tax shall
forthwith be paid by the City
Treasurer, to the Director of the
Departfent of Agriculture and In
spection of the State of Nebras
ka and the remaining one-half
thereof shall be credited by the
City Treasurer to the General
Fund of the City.
Section 7. Each association con
ducting the game or
within the City shall submit a
written quarterly report to the
City Clerk covering the preceding
calendar quarter on or before the
10th day of the immediately suc
ceeding calendar quarter. The re
port shall include a detailed fi
nancial statement of each separ
ate session of Bingo conducted by
such association, prepared on a
form prescribed by the Director
of the Department of Agriculture
and Inspection of the State of Ne
braska.
Section 8 All the provisions of
I the said Legislative Bill 719, and
all other applicable provisions of
other state statutes, as the sairu
now exists or may hereafter be
amended shall be and constitute
a part of this ordinance the same
as if repeated verbatim herein,
| and violation of the same shall be
' a distinct and separate offense
; against the City, as well as against
the State, and any violators there
j of shall be separately prosecuted
by the City for each offense and if
convicted * shall be famished as
hereinafter provided for the viola
tion of other provisions of this or
dinance.
Section 9. Any association viola
1 ting the provisions of this Ordi
nance shall be guilty of a misde
meanor and if convicted shall be
:t fined in any sum not less than
ten dollars (SlO.OOi nor more than
one-hundred dollars ($100.00i for
each offense and shall automatical
ly stand committed to the City
I Jail, until such fine and costs of
prosecution are paid in full Each
day a violation of this ordinance
continued shall be considered a
separate and distinct offense.
Section 10. That all ordinances
or parts of ordinances of the City
in conflict herewith, are hereby
repealed.
Section 11 Whereas, an emer
gency exists, this ordinance shall
be in full force and effect from
and after its passage approval,
and publication according to the
law.

recommends it highly for those
who want a light, refreshing des
sert for Christmas dinner. It can
be baked in individual custard
cups and stored safely in the re
frigerator until serving time.
Y uletide Dessert
(Six servings)
3 eggs, beaten
1/3 cup brown sugar, firmly
packed
Mi teaspoon salt
1 teaspoon rum flavoring
1 teaspoon vanilla
1 tablespoon lemon juice
1 xk cups egg nog
2 cups cottage cheese, sieved
Whipped cream
Nutmeg
Gradually add brown sugar to
eggs; beat until well mixed. Add
salt, flavorings, lemon juice ami
egg nog; mix well. Stir in cottage
cheese. Spoon into buttered cust
■rd cups or a 1M quart casserole.
Set in ba!< pan and pour hot
wate into . I inch deep Bake
at 325 fl .'?•< s for about 45
minutes for custard cups and 1
hour for ca serole, or until silver
knife inserted near edge comes
out clean. Serve warm or chiil
