tractor for and in consideration
of the sum of *19,668.75 Dollare,
payable as set forth in the speein
cations constituting a part of this
contract, hereby agrees to con
struct O'Neill Sewer District No.
1. consisting primarily of Sewer
Pipe and Culverts, and appurten
ances, complete, in accordance
with the plans? specifications and
<3>ccial provisions therefor, and in
amount of $19,668 75 for the con
struction and furnishing of all
labor, materials, use of con
tractor's equipment and plant
and all else necessary to pro
perly construct all of the im
provements within Sewer Dis
trict Number 1 as submitted on
October 6, 1959, was the only bid
submitted and therefore tht
lowest and best bid.
2 That the contract, perfor
mance and maintenance bond of
the Missouri Valley Construction
Company be approved and the
Mayor and Clerk be authorized
to sign the said contract.

Contractor’s bond, the proposal
all project specifications and
special provisions, and all supple
mental written agreements are a
part of this Contract.
The Contractor expressly war
rants that he has employed nc
third person to solicit or obtair
this Contract in his behalf, or tc
cause or procure the same to be
obtained upon compensation ir
any way contingent in whole or ir
part uixin such procurement, and
that he has not paid or promised
or agreed to pay, to any third
person in consideration of suer
procurement, or in compensatior

with, any brokerage, commission^
or percentage upon the amount
and that he has not, in estimat
ing the contract price demanded
by him, included any sum by
reason of any such brokerage,
commission or percentage; and
that all moneys payable to him
hereunder arc free from obliga
tion of any other person for ser
vices rendered, or supposed to
have been rendered, in the pro
curement of this Contract H
further agrees that any breach
of this warrant shall constitute
adequate cause for the annulment
of this Contract by the Owner, and
that the said Owner may retain
for its own use,' from any sums
due or to become due hereunder
an amount equal to any broker
age, commission, or percentage,
so paid or agreed to be paid.
All work required in carrying
out this Contract shall be per
formed in complance with the
laws of the State of Nebraska.
The Contractor states that he is
complying with and will continue
to comply with fair labor stand
ards in the pursuit of his business,
and in the execution of the Con
tract pursuant to this bid.

administrators, jointly, severally
and firmly by these presents.

The condition of the obligation
is such that whereas, the above
bounden Missouri Valley Construc
tion Co., of Grand Island, Ne
braska, has been awarded by the
City of O'Neill, Nebraska, the
Contract for the Construction of
O’Neill Sewer District No. 1, copy
of which Contract together with all
of its terms, covenants, conditions
and stipulations is incorporated
herein and made a part hereof as
fully and amply as if said Con

NOW THEREFORE, if the said
Missouri Valley Construction Co.,
as Principal shall in all respects
fulfill this said Contract according
to the terms and the tenor there
of, and shall faithfully discharge
the duties and-obligations therein

tion is to be void otherwise to be
and remain in full force and

It is expressly understood and
agreed that this bond is given to
secure and does secure not only
the faithful performance by the
