Motion Filed for
Appeal’s Dismissal
S-T-A Asks Court to
Ignore C&NW
The Save-the-Trains associa
tion met Sunday evening for a
three-hour session at the Town
House in O’Neill, reelected offi
cers and directors and heard a
report from the association’s le
gal counsel, Einar Viren of
Omaha.
The association decided to "aid
and abet" railroads in Nebraska
in lessening real estate taxes, but
not "if the Chicago & North
Western persists in removing the
last two passenger-mail-express
trains serving northeast and
northern Nebraska.”
S-T-A opposes C&NW’s attempt
to discontinue trains 13 and 14,
which ply daily between Omaha
and Chadron.
Viren told the assembly he
was filing a motion the next
day (Monday) requesting C&NW’s
appeal to the Nebraska Supreme
court be thrown out on grounds
the state railway commission
has not made a final order,
"hence there is nothing to ap
peal.”
In February the commission
authorized C&NW to discontinue
13 and 14 effective March 15. But
parly in March the commission
vacated that stand and set aside
the February 7 order. C&NW ap
pealed to the supreme court and
has been pressing the high court
for an early date for oral argu
ments.
It was reliably reported at the
O’Neill session that windows in
the day coaches on the two trains
are washed only twice a year.
“Such housekeeping is a source
of annoyance to passengers and
certainly discourages rail travel,”
S-T-A officials said.
Reelected by acclamation were.
Cal Stewart of O’Neill, president;
F. L. Hebard of Bassett, vice
president; Ira L. Watson of In
man, secretary - treasurer, and
those directors: Fay Hill of Gor
don, John Cassel of Ainsworth,
District Judge Lyle Jackson of
Neligh, J. J. Moreland of Merri
man and Claude Currie of Valen
tine.
Thirty - two persons attended,
representing Omaha, Lincoln,
Norfolk, Neligh, Clearwater, Ew
ing, Inman, O’Neill, Emmet, At
kinson, Stuart, Bassett, Valen
tine, Gordon, Merriman and Hay
Springs.
