Councilman Merriman intro duced an Ordinance entitled: AN ORDINANCE GRANTING A FRANCHISE TO MIDWEST TRANSEVIDEO SERVICE SYS TEMS, INC., A CORPORATION ORGANIZED UNDER THE IJVWS OF THE STATE OF NE-1 IJRASKA, TO OPERATE, CON STRUCT, AND MAINTAIN TEL EVISION COAXIAL CABLES UPON, ALONG, THROUGH, OVER AND UNDER STREETS, ALLEYS, BRIDGES, AND PUB-! LIC PLACES OF THE CITY OF O'NEILL, NEBRASKA. Said Ordinance was fully and distinctly read, and on motion duly made and seconded and adopted, it was designated as Ordinance No. 297-A of the City of O'Neill, Nebraska, and the ti tle thereof was approved. Councilman Stutz moved that the statutory rule requiring Ordinances to be fully and dis tinctly read on three different days be dispensed with, which motion was seconded by Coun cilman Golden, and the Yeas and Nays being called on the passage of said motion, the following councilmen voted Yea— Golden, Crabb, Stutz, Merriman and Heermann; Nay—none. The mo iinm hnvinv been concurred in by three-fourths of the Council, was declared passed and adopted, and said statutory rule suspended. Thereupon said Ordinance No. 297-A was read by its title a sec ond time and was then read at large and put upon final passage. The Mayor stated that the ques tion is: “SHALL ORDINANCE NO. 297-A BE PASSED AND ADOPTED,” The Yeas and Nays were called and the following Councilmen voted Yea — Stutz, Merriman, Golden, Heermann and Crabb. Nay—none. The pas sage and adoption of said Ordi nance having been concurred in by a majority of all members elected to the Council was by the Mayor in the presence of the Council signed and approved and the Clerk attested the pas sage and approval of same anc, affixed his signature thereto. The following is as true and , correct and complete copy of | said Ordinance. ORDINANCE 297-A Section 1. BE IT ORDAINED by the Mayor and the City Council of the City of O Neill, Nebraska, that the Midwest Trans video Service Systems, Inc., a corporation organized under the laws of the State of Nebras ka, its successors and assigns be and the same is hereby granted the right, privilege and author ity to construct, operate and maintain lines of television co axial cable including poles, wnres and fixtures where necessary upon, along, through, over ana under the streets, alleys, bridges and public places of the City of O’Neill, Nebraska, under the terms and conditions hereinafter provided. But such cables shall not be placed except upon appli cation in writing to the Electrical Department and/or Northwestern Boll Telephone Company of the City of O’Neill, Nebraska, and the approval by said Department. The application will carry details and plats showing the locations of any such cables. Section 2. The poles used for the said coaxial cable shall be those erected and maintained by the Northwestern Bell Telephone Company and/or the Electrical Department of the City of O - Neill, Nebraska, when and where practical, providing satisfactory rental agreements can be enter ed into with the said Northwest ern Bell Telephone Company and the Electrical Department of the City of O’Neill, Nebraska. All streets and sidewalks that may be disturbed or damaged in the construction of said lines shall be promptly repaired by the said Midwest Transvideo Service Sys tems, Inc., at its own expense and to the satisfaction of the Governing Body of the City of O’Neill, Nebraska. Section 3. Said Corporation shall be subject to all ordinances now in force or that may be hereafter passed relative to the use of highways, streets, alleys, bridges and public places of said City. Section 4. Said corporation shall hold the said City of O’ Neill, Nebraska, safe and harm less from all damages or claims for damage arising by reason of the negligence in constructing or maintenance or operation of said coaxial cable. WHEREAS, by virtue of the provisions of Ordinance No. 266-A of the City of O’Neill, the City Council is empowered to regulate traffic and parking of vehicles on certain streets within the City, and to provide rules and regulations therefor, and the City Council deeming it neces sary and proper that the follow ing rules and regulations be pro mulgated and enforced within the City of O’Neill, NOW THEREFORE, BE IT RESOLVED BY THE MAYOR ANt> COUNCIL OF THE CITY OF O’NEILL, NEBRASKA: 1. That hereafter, on Douglas Street within the City of O’Neill, from the East City Limits to the West City Limits, and on Fourth Street, from the intersection with Douglas Street to the South City Limits, all vehicles shall park not more than one tier deep, and when parked shall stand parallel with and adjacent to the curb. 2. All members were present. Roll call was answered by na ming favorite sports. Barbara Way man and JoAnn Searles gave a demonstration on how to build bird feeders. Dick Pongiatz and Connie Jean Brockman gave talks on “What We’ve Learned in Lets Help Mom and Dad.” Our club received nine awards which were presented at fun night. Mr. and Mrs. Harold Waldo and family of Denver, Colo., spent the weekend with his par ents, Mr. and Mrs. B. W. Waldo, and other relatives and friends. They were supper guests Satur day evening at the home of his brother, Lloyd Waldo, and fam ily. Mr. and Mrs. B. W. Waldo were also guests. Mrs. Lloyd Clemens and fam ily of Ravinia, S.D., were visiting relatives in the Aelia commmun ity during the April 21 weekend. They stayed at the home of their brother, Frank Pierce. Andy Robak of Omaha brought his wife and family to the home of her mother. Mrs. Margie Sam mons. on Saturday night. They were called here by the death of Mrs. Robaks grandmother. Mrs. Mamie Sammons Mr. Robak could not stay for the funeral and returned to Omaha Sunday. Mr and Msr. Charles Bligh of Omaha were here for the funeral of Mrs. Bligh’s aunt, Mrs. Mamie Sammons. Mrs. Etta Ott plans to leave on Sunday, May 6, to visit her daughter, Mrs. Burton Kiltz, at Arlington, Va. She plans to go from Omaha by plane. Miss Sievers Shower Honoree— EWING—Attending the mis cclleneous shower held for Miss Marion Sievers at the Clearwa ter Legion club on Sunday after noon were Mrs. Ralph Eacker, Mrs. Jessie Angus, Mrs. Rose Good, Mrs. Everett Ruby, Mrs. Gene Ruby, Mrs. Bertha Urban, Mrs. William Spence, Miss Hazel Ruby, Mrs. Perry Saiser and Mrs. Josie Versaw, all of Ewing. Miss Sievers is the daughter of Mr. and Mrs. Walter Sievers. She will be a June bride. Miss Sievers is teacring at Madison and will complete the school term in a few weeks. •Air Age' Discussed by Miss Way— The Holt County teachers as sociation held a meeting Wed nesday evening, April 25, at the O’Neill Public school. This was the last meeting until fall. Miss LuLu Way of Wayne State Teachers college spoke on the topic, “Air Age” and showed two films. Some helpful material on aviation was given the teach ! ers.
